A CAPITAL PROJECT AUTHORIZING RESOLUTION OF
THE VILLAGE COUNCIL OF THE VILLAGE OF KEY
BISCAYNE, FLORIDA, AUTHORIZING THE PURCHASE OF
A NET MOTION MOBILITY, A VIRTUAL PRIVATE
NETWORK FOR THE VILLAGE OF KEY BISCAYNE
POLICE DEPARTMENT; PROVIDING FOR
IMPLEMENTATION AND AUTHORIZING THE VILLAGE
MANAGER TO COMPLETE THE PURCHASE OF THE
EQUIPMENT AND EXECUTE AGREEMENTS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Section 3.07(b) of the Village Charter, the Village Council desires
to authorize expenditures for the purchase of a Net Motion Mobility, a virtual private network (the
"Equipment") to be used by the Village of Key Biscayne Police Department; and
WHEREAS, new Federal Standards have been established for Advanced Authentication for
Law Enforcement Agencies; and
WHEREAS, the Equipment in -place now has become outdated and does not meet the new
federal standards and therefore requires this one-time expenditure to provide our police officers with
maximum secure and uninterrupted reliable wireless access to all mission -critical data and
applications; and
WHEREAS, the Chief of Police has recommended adoption of this Resolution and
determined that the proposed expenditure is an authorized category "Communications and
Computers" contained within "A Guide to Equitable Sharing of Federally Forfeited Property for
State and Local Law Enforcement Agencies"; and
WHEREAS, funds for this expenditure is not included in the Police Department's operating
budget costs; and
WHEREAS, the Police Department has in excess of $281,635.46 in the Federal Asset
Sharing Account as of August 2010; and
WHEREAS, the monies for the proposed expenditure are the results of seized assets from
joint investigations between the Village of Key Biscayne Police Department and other law
enforcement agencies, not from tax revenues; and
WHEREAS, this expenditure is from said forfeit properties, this Police Department need
can be satisfied at no cost to our residents; and
WHEREAS, the Village has taken the necessary steps, including those relating to any
applicable bidding requirements, to arrange for the acquisition of the Equipment and finds the
purchase of Equipment to be exempt from competitive bidding pursuant to Village Code Section 2-
86 as being derived from another government entity's bid process.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That each of the recitals stated above is hereby adopted
and confirmed.
Section 2. Capital Project Authorizing Resolution. The Village Council hereby
authorizes the Chief or Police to purchase the Equipment subject to the restriction that the total cost
of the Equipment authorized herein shall not exceed $12,000.00. The funding source shall be the
Federal Asset Sharing Fund.
Section 4. Effective Date. That this Resolution shall be effective immediately upon
adoption hereof.
