RESCINDING AND APPROVING THE RENEWAL OF PLENARY RETAIL
CONSUMPTION LIQUOR LICENSE NO. 1201 -33- 029 -010 FOR THE 2016 -2017
& 2017 -2018 LICENSE TERMS PURSUANT TO A SPECIAL RULING
WHEREAS. Pursuant to Resolution No. 08 -16 adopted by the ABC Board of the
Borough of Carteret ("ABC Board") on June 27. 2016. Plenary Retail Consumption
License No. 1201 -33- 029 -10 ("License ") was formally renewed for the 2016 -2017.
Licensure Term; and
WHEREAS, the ABC Board was subsequently notified by the New Jersey Division of
Alcoholic Beverage Control ("Division ") that a Special Ruling pursuant to the provisions
of N.J.S.A. 33: 1 -12.18 was required for the renewal of the aforesaid License for the
2016 -2017 Licensure Term, and ultimately for 2017 -2018 Licensure Term as well; and
WHEREAS, the Licensee, the Carteret Business Partnership, Inc., filed the required
Verified Petition with the Division for the required Special Ruling pursuant to the
provisions of N.J.S.A. 33: 1- 12.18, and
WHEREAS, according to the Acting Director's Special Ruling, dated March 29, 2017,
the ABC Board has been authorized to now properly consider the Licensee's application
for renewal of said License for the 2016 -2017 & 2017 -2018 Licensure Terms, in the
reasonable exercise of the ABC Board's discretion, and subject to the Licensee
complying with all of the established legal requirements therefore: and
NOW, THEREFORE, BE IT RESOLVED by the ABC Board of the Borough of
Carteret, County of Middlesex, State of New Jersey, as follows:
That the prior renewal of Plenary Retail Consumption Liquor
License No. 1201 -33- 029 -10 for the 2016 -2017 licensure Term is
hereby repealed.
2. That Plenary Retail Consumption Liquor License No. 1201 -33-
029-10 is hereby approved for renewal for the 2016- 2017 & 2017-
2018 Licensure terms, as authorized pursuant to the N.J.S.A. 33: 1-
12.18 Special Ruling relief granted by the Acting Director on
March 29, 2017, subject to the Licensee having met all of the other
requisite requirements therefore.
3. That two (2) certified copies of the within Resolution be forwarded
to the New Jersey Division of Alcoholic Beverage Control,
Licenses Bureau as may be required or provided for.
