KOCH, JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order. Chairman, Thomas Smith called the meeting to order at 8:30 A.M. II. Roll Call. Minutes of the Regular Meeting and Public Hearing 7-3-19. Vice Chairman Murphy moved and Board Member Roach seconded the motion to approve the minutes of July 3, 2019 and all voted AYE at roll call. IV. Additions, withdrawals, deferrals, arrangement of agenda items. There were no changes to the agenda. V. ANNOUNCEMENTS. A. Meeting Dates 1. Regular Meeting & Public Hearing a. No August meeting b. September 26, 2019 at 8:30 A.M. c. October 24, 2019 at 8:30 A.M. d. TBD e. TBD Chairman Smith called attention to the future meeting dates. Vice Chairman Murphy and Alternate Board Member, Caroline Delafield, stated they will not be able to attend the September meeting. The Board determined the meeting dates for November and December to be November 21, 2019 and December 19, 2019. VI. PUBLIC HEARING. A. Declaration of Ex -Parte Communication There was no ex -parte communication. B. Administer Oaths The Town Clerk administered the Oath to Sophie Bent, Dan Carter, Eddie Dalidowicz, Bryan Donahue, David Gunther and Rob Lehner. C. Applications for Development Approval 1. An application submitted by Gary Eliopoulos, GE Architecture, Inc., as agent for Mr. & Mrs. Richard Wilson, owner of property located at 3420 Gulf Stream Minutes of ARPB Regular Meeting & Public Hearing Held 7-25-19 @ 8:30 A.M. Road, Gulf Stream, Florida 33483, legally described as Lot 1, Block 1, Plat No. 1 Polo Fields. a. Land Clearing Permit to trim, treat and shape existing hedge, remove dead stump and vines, and trim existing trees. b. Demolition Permit to remove two-story, single family dwelling, swimming pool and all other structures on the property. c. Level 2 Architectural/Site Plan Review to permit the land clearing and demolition permits, the installation of a 4'x5' aluminum gate in the center of the south property line, and an irrigation system along with new sod on the entire property. Mr. Dan Carter, of Landscape Architects, made the presentation beginning with the fact that they would like to put a clusia hedge instead ficus. He then explained that the demo and land clearing was basically making way for a back yard. Chairman Smith asked if there was going to be a Unity of Title, to which Assistant Town Attorney answered there was not. Town Manager Dunham asked if the Queen Palms were going to be removed as they were in bad shape and Mr. Carter answered in the affirmative. Town Clerk Taylor stated that there had been a call from a neighbor asking what the hedge was going to be but did not say he was opposed to a variety of hedging. Vice Chairman Murphy made a motion to approve a land clearing permit to trim, treat and shape existing hedge, remove dead stump and vines, trim existing trees and remove the three Queen Palms. Board Member Roach seconded the motion with all voting AYE. Vice Chairman Murphy made a motion to approve a demolition permit to remove a two-story single-family dwelling, swimming pool and all structures on the property. Board Member Roach seconded the motion with all voting AYE. Vice Chairman Murphy made a motion to approve a Level II Architectural/Site Plan Review to permit the land clearing and demolition permits, the installation of a 4'x5' aluminum gate in the center of the south property line and to sod, landscape and irrigate the entire lot with the following conditions: 1. Any minor modifications in the approved landscaping shall be submitted to the Town Manager for review and approval and any major modification shall be brought back to the ARPB for review and approval, prior to commencement of landscaping. Board Member Roach seconded the motion with all voting AYE. 2. An application submitted by Bryan Donahue, Insite Studio, as Agent for The Little Club, the owners of property located at 100 Little Club Road Gulf Stream, Florida, which is legally described as lying in Section 3, Township 46 South, Range 43 East Palm Beach County, Florida. 2 Minutes of ARPB Regular Meeting & Public Hearing Held 7-25-19 @ 8:30 A.M. a. Land Clearing Permit to permit the removal of existing 48" diameter Green Buttonwood tree from construction site. b. Level 2 Architectural/Site Plan Review to permit the construction of 2 Pickleball Courts with a spectator area, a total of 3,300 square feet, in an open area west of the existing Hillside House Condominium. Chairman Smith noted that the Town had received communication from some of the neighbors and then asked Town Clerk Taylor who was notified besides The Hillside House. Ms. Taylor stated that the applicant is responsible to supply the Town with the names of all the abutting neighbors as well as stamped and addressed envelopes for them. All of those were sent out and approximately a week after being sent, the letter that went to Las Casitas was returned to the Town by the Post Office. Ms. Taylor informed the applicant who at that point sent notices to the residents within the organization. Mr. Bryan Donahue of Insite Studio made a PowerPoint presentation on behalf of The Little Club. Mr. Donahue showed where the courts were projected to be and the landscaping that was being proposed. He added that for noise mitigation purposes, the Little Club was proposing a cushioned court surface and sound mitigating paddles that would be the only paddles allowed for use. Mr. Donahue said that in the application it was stated there would be a sound mitigating screen, but they were taking that off the table believing that all the other sound mitigation proposals would be enough. Board Member, Curtiss Roach, stated that he had received several phone calls regarding the pickleball courts and wanted to know if any consideration had been made to move one of the croquet courts to the proposed pickleball site and the pickleball courts to one of the croquet courts because two pickleball courts will fit into one croquet court. Mr. Donahue stated that the additional croquet court had just been added and it didn't make sense to separate them. Mr. Roach added that he had been told 80% of the Hillside House were opposed to the pickleball courts and in the process of being a good neighbor, some accommodations should be made by The Little Club. Mr. Donahue stated they were open to having conversation with any of the neighbors in opposition. Board Member, Jorgette Smith, asked why they had done away with the sound mitigating screen. Mr. Donahue answered they felt the paddles and court surface were enough to mitigate the sound and the screen was fairly expensive. Mrs. Smith then asked how much quieter were the paddles and cushioned surface to which Mr. Donahue said he did not know technicalities as far as decibel levels, etc. Chairman Smith asked Mr. Donahue to expound on the discussions to put the pickleball courts at the proposed location. Mr. Donahue deferred to Mr. Eddie Dalidowicz, who said that the proposed pickleball location does not grow grass well and it would not be a good location for a croquet lawn. Mr. Dalidowicz added that game play would be hurt as well since 30-40 people are off and on 3 Minutes of ARPB Regular Meeting & Public Hearing Held 7-25-19 @ 8:30 A.M. the lawn every 20 minutes or so and it's not conducive to the sport for the lawns not to be next to each other. Alternate Board Member, Caroline Delafield, stated that she understands the noise complaints the neighbors have, but stated that the Club is acting within what it is zoned for so it's a tough situation. Vice Chairman Murphy asked if there had been any response from the neighbors, to which Town Clerk Taylor read a letter from Mrs. Carol Stanley, a resident of Hillside House in Unit 11, affirming the pickleball courts. Ms. Taylor then read letters from other residents of Hillside House, John and Cynthia Gallagher, Sophie Bent and Wendy Barroll that were in opposition to the pickleball courts. Chairman Smith said there seemed to be a majority against the pickleball courts noting noise abatement. He added that the Bath and Tennis Courts were 300 feet from his home and he could hear them, so he knew 25 feet away would definitely be heard. Vice Chairman Murphy asked about the discussion between the two presidents and Mr. Dalidowicz said that it had been his understanding that Mr. Gallagher was not opposed to the pickleball courts, but that his letter now said differently. Mr. Roach and Ms. Taylor added they had received phone calls from Mr. Gallagher as well. Mr. Rob Lehner, the General Manager of The Little Club, stated that the proposed site for the pickleball courts was not large enough for a croquet lawn. He added there would also be nowhere to put the golf carts when they had tournaments. Ms. Sophie Bent stated she was at the meeting representing 11 out of 12 units who are opposed to the pickleball courts and that sight wasn't the issue, but it truly was the noise. Town Manager Dunham stated that when in discussions with the staff, it was his understanding that the sound mitigation screen was to be included. Mr. Donahue apologized and said it could be looked at again, if that is what the Board felt necessary. Mr. Dunham also added that future expansion had been mentioned when the staff asked the Club to look at moving the courts a little to the south. Mr. Donahue wanted to make clear that they were meeting all the requirements per the Code for this property. Alternate Board Member, Caroline Delafield had to excuse herself from the meeting at 9:20 A.M. David Gunther of Lang Realty suggested dual pane/impact windows for Hillside House residents. After much deliberation, it was decided to table this application until the September 26, 2019 meeting. The Board asked that noise abatement be addressed by a quantifiable third -party consultant, decibel testing, playing times, nuisance ordinances and additional landscaping for screening purposes all be addressed. Vice Chairman Murphy made a motion to defer Application 19-05 to September 26, 2019 when the points made have been addressed and brought back to the Board. Board Member Roach seconded the motion with all voting AYE. VII. Items by Staff. There were none. VIII. Items by Board Members.
