OFFICE OF THE BOARD OF WORKS
CITY OF RICHMOND, INDIANA,
FRIDAY, SEPTEMBER 30TH, 1941.
The hoard of Public Works and Safety of the City of
Richmond, Indiana met in the office of said Board,
Tuesday, September 30th, 1941, at 10000 o ' clock A. M. in
a Special Session Messrs. S. W. Hodgin, Winfield Urban
and Earl Keisker being present the following proceedings
were had to-wit;
The reading of the minutes of the preceeding meet-
ing was dispensed. with;
A letter was presented to the Board from the National
Automatic Tool ,Co. located on South N Street requesting
permission to construct a railroad switch track leading .
from the 0 & 0 Rail Road to their factory , the same run-
ping acros° ' N Street to their Factory and to their load-
ing platform.
A form of contract for this purpose was presented
and the same was discussed, On -roper motion with a second
the. following resolution was unanimously adopted by the
Board.
BE IT RESOLVED , that it is the desire and intent of
the Board of Public .Works and Safety of the City of Rich-
mond, Indiana, to enter into the following contract with
the National Automatic Tool Company operating a factory
in said .City, to-wit;
CONTRACT
THIS COlP1'RICT made and. entered into by and between the City of
Richmond, Indiana here and after designated as City, and The National
Automatic Tool Company, and Indiana Corporation here and after
referred to as the Company.
WITNESSETH:
Said City hereby grants to said Company and its assigns the right
to bill, maintain, and use a railroad switch, with a branch there-
from for industrial purposes over and across South U!Nn. Street in
said City, more fully described as follows, to wit:
Beginning at a point in the westerly side track of the Chesa-
peake and Ohio Railway, said point being two hundred eighty five
(2S5) feet north of the center line of South N Street in said City:
thence by a 13 degree curve to the right a distance of two hundred
thirty nine and five tenths (239.5) feet to a point near the north
line of said South N Street; thence by a straight line, tangent to
the above curve line four hundred fifty three and five tenths (453.5)
feet to the end of the proposed track.
All in accordance with a plat attached hereto showing drawing
number 1451S all of which shall be considered as and become a :part
of this contract and the record pertaining thereto.

Said tracks shall be of standard gauge and shall be laid and
maintained by said. Company to conform to the established grade of
said street, and said Company of its assigns, shall keep and main-
tain said portion of the street occupied by said tracks, and for
18 inches on the outside of each rail thereof, in proper and safe
condition at its expense.
In the event that said tracks shall be removed from 'said street,
whether the same be done voluntarily or by authority of said City,
then in either event said Company shall immediately thereafter, at
its own expense, place said street as occupied by said track in a
proper and safe condition for public travel.
Said Company agrees to save said City harmless frot any lia-
bility'arising during construction of said tracks by reason of the
maintenance of the same in that portion of the street so occupied.
In the event that the. City shall determine to permanently
improve said street at the place occupied by said track, then said
Company shall bear the cost of improving such portion of said street
as •is occupied by said track and 18 inches on the outside of each
rail thereof.
IN WITNESS WHEREQF said parties have hereinto affixed their

The Board now fixes Oct. 17, 19411 at :30 A.M. as the time
which said contract will be finally considered, and at which time
a public hearing shall be held thereon.

The Clerk , at the expense of the said National Auto-
matic Tool Company shall cause the complete text of the
gaid-Contract to be published in the palladium -Item
two dailey newspapers 'of general circulation, published •
in said .City of Richmond, together with the time of said
hearing.,_ Said notice shall be published. in each paper
twice, one ' week apart, and the last publication to -be. at
least one week before said hearing, and said contract
and notice shall be posted in 10 public places' in 'said-
City. .
There no further business , the Board adjourned. •
