The Board of Public Works .and safety of the City
of Richmond, . Indiana, met in the-office of said
Board Friday, February 2, 1940, at 9 :00 o ' clock A.
M. Nessrs. John R. Britten, Simeon W9 Hodgin and^
Henry U. Johnson being present the following pro-

ceeding were had to-wit ;
The minutes of the preceeding meeting were read
and approved.
A copy of a claim was presented and filed with
the City Clerk by City':; ttorney Johnson for the
° City of Richmond, Wayne County, Indiana, vs the
Henke Construction Co. of Chicago , Illinois , in
matters of the final settlement of the Auditorium-
Gymnasium,' as follows ;
Whereas i,ne Henke Uons truc-tion Co . of Chicago .
Illinois, has been the principal cont.ractepr, and
the City of Richmond , Wayne County, Indiana, the
owner of a certain Auditorium-Gymnasium, Project
Indiana 1401-F, recently constructed by said Henke
Construction Company under contract between the
above named parties, in which contract and modi-
fications completion date was set and agreed to be
es of August 15th, 1939 , and,
Whereas actual completion date of said principal
contracror was actually and in fact on the 28th day
of November, 1939, now,
Therefore, said City of Richmond, Wayne County,
Indiana, has sustained and suffered loss and damage
in the sum of p5,000.00 as adirect consequence and
result of said principal contractor's failure to
comply with the terms of said contract as modified
as to the completion date, and now files and presents
this , its claim for said sum as damages therein.
