RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES
CONTRACT FOR LEGAL SERVICES WITH KENNETH LEBRATO, ESQ.
WHEREAS, on 3uly 19, 2001, the Governing Body of the Borough of
Carteret adopted Resolution No. 01-233, authorizing a professional
services contract with Kenneth Lebrato, Esq. for specialized legal services
in connection with an investigation of citizen complaints regarding alleged
Election Day incidents at the Housing Authority Election District during the
November 2000 election; and
WHEREAS, pursuant to said resolution, Kenneth Lebrato, Esq. was
retained as special counsel at an hourly rate of $125 per hour not to
exceed an initial maximum cost of $5,000.00; and
WHEREAS, the initial authorization provided for pursuant to the above
described resolution has been virtually exhausted; and
WHEREAS, the Governing Body has determined that an increase in the
initial authorization is warranted and necessary for Kenneth Lebrato, Esq.
to continue his legal services in connection with the prosecution of this
matter; and
WHEREAS, the Chief Financial Officer has certified that funds are
available for the same.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret as follows:
1. The appointment of Kenneth Lebrato, Esq. as special
counsel pursuant to Resolution No. 01-233 is hereby
continued at an hourly rate of $125 per hour.
2. The initial authorization for a maximum cost of $5,000
provided for pursuant to Resolution No. 01-233 is hereby
increased for an additional $5000.00, for a revised maximum
cost not to exceed $10,000.00.
3. This award is made as a professional services contract
pursuant to N.3.S.A 40A:11-5(1)(a).
