HomeMy Public PortalAboutZoning Board of Appeals -- 2020-11-10 Minutes TOWN OF BREWSTER ZONING BOARD OF APPEALS MEETING MINUTES _ Monday, November 1011, 2020 at 7PM ;. Virtual Meeting Brian Harrison , Chairman , convened the Brewster Zoning Board of Appeals via remote participation with members : Arthur Stewart, Jeff Carter, Patricia Eggers, Jeannie Kampas, and Bruce MacGregor . Absent : Susan McShane . A quorum was determined . Also present : Benjamin Zehnder (Attorney representing Applicant ), Bob Bacchiochi ( Applicant ) , Ryan Bennett (Town Planner) and Ellen Murphy ( Department Assistant) . The Chair read the Recording or Taping Notification : This meeting will be conducted by remote participation pursuant to Governor Baker's March 2020 orders suspending certain Open Meeting Law provisions and imposing limits on public gatherings . No in - person meeting attendance will be permitted . If the Town is unable to live broadcast this meeting, a record of the proceedings will be provided on the Town website as soon as possible . The Town has established specific email addresses for each board and committee so the public can submit comments either before or during the meeting . To submit public comment or questions to the Zoning Board of Appeals, please email : zbameeting@brewster-ma .gov . • Review and Approval of October 13 , 2020 minutes The October 13 , 2020 meeting minutes were not available for review and approval . • Continued Applications Review of #19 -37, Applicant : 19 Muskrat Lane LLC . Brian Harrison stated the Applicant is seeking an Appeal of the Building Commissioner' s decision that a boat storage shed , kayak rack and roll out boardwalk are not permissible uses on the property in the RM zoning district under MGL 40A § 8 & 15 and Brewster Zoning Bylaw § 179 6- D (4) . He then introduced Attorney Benjamin Zehnder who is representing the Applicant . Attorney Zehnder requested the Board grant a 60 day continuance . He outlined the current work to date and informed the Committee that Coastal Engineering performed the sitework on the delineations of the wetlands and is in the process of obtaining an application from the Conservation Committee . He stated the reason why the application has not been withdrawn is once withdrawn he will lose the right to continue the appeal and therefore requesting the Board grant a 60 day continuance . There was no discussion on the request . A motion was made and second to grant the 60 day continuance , a roll call was taken by Brian Harrison , the vote was unanimous . It was determined that j the February 9 , 2021 meeting would not have a quorum and therefore the motion was amended to continue the review of application # 19 -37 on March 9, 2021 . A roll call was taken and the vote was unanimous . • Continued Applications Review of #2044, Applicant : Bob Bacchiochi i Brian Harrison stated the Applicant is seeking a Special Permit, pursuant to section 179 . 42 . 2 of the Brewster zoning bylaws, to construct and 867 square foot Accessory Dwelling Unit ( ADU ) on the second floor of an existing garage on property located at 585 Slough Road in the Residential Rural ( RL) zoning district . He { reached out to the Board to ensure members are familiar the case . Bob Bacchiochi stated he has reduced the square footage to 679 as requested and referred to the updated floorplan submitted to the Board . Brian Harrison asked if neighbors were notified . Bob Bacchiochi stated he was not aware that he needed to reach out to the neighbors but will reach out if necessary . Brian Harrison opened for discussion . Arthur Stewart asked if there was any comments from neighbors . Brian Harrison read an email sent by a neighbor to the Board . The Board determined that the neighbor did not indicate in the email whether he was for or against the request . Brian Harrison stated that the neighbors living directly across the property expressed they were in favor of the request . Brian Harrison read the 13 items under section 179 . 51 . 5 of the Brewster zoning bylaws to the Board for discussion . A motion was made by Arthur Stewart to approval #2044 . A roll call was taken and the vote was unanimous . Page 1 of 2 I I • New Applications : There were no new applications . • Matters Not Reasonably Anticipated by the Chair : Ellen Murphy was introduced by Ryan Bennett as the new Department Assistant . The next meeting of the Brewster Zoning Board of Appeals is scheduled for December 8th, 2020 . A motion was made to adjourn the meeting . Vote : &0-0 .
