The Board of Public works and Safety or the City of icnmond, Indiana, met in the orrice or said Poard, T:uesday- April le, 193y at 9 :00 o ' clock A. M. This was the postponed meeting of April 14, 1939 . Messrs. John R. Britten, Simeon W. Hodgin and Henry U. Johnson II being present the following proceedinrs were had, to-wit ; • The minutes of the preceeding meeting were approved as read. Mr. Don Bell one of the Insurance Committee was present in the interest of the insurance carried by the City. The Board made the following record in regard to that part of the meeting given over to the action on Declaratory Resolution r'11-1939. "The Board met this 18th day of April, 1939 , with all members p r.e san t. The Board, on April 7 , 1939, having heard Alferd J. Birck and other remonstrators against the vacation of a part of a public alley, running south fromrain Street, between Sixth and Seventh Streets, in said City, as shown in Declaratory Resolution No. 11, 1939, and said Board having taken said matter under advisement, now finds , as follows : 1. That it is the unanimous opinion of the Police Chief, Fire Chief, Street Commissioner, and City Engineer of said City of Rich- mond, that it will be in the public interest to close the portion of the alley described in said resolution heretofore adopted by the Board. 2. That due to heavy traffic on Main Street. and the narrowness of said alley at its intersection with said Main Street, a hazardous condition exists at such point. The continued use of said alley, at such point, will lead to congestion and danger, both to vehicular and pedes- • trian traf ic. 3. That the closing of said alley will minimize the risk of fire to buildings adjoining it and in the vicinity. . 4. That the portion of the alley beinp closed is too narrow to be used by the fire department and is not required for use in fight- ing fires in such locality. The availability of other hydrants and . alleys in said locality make possible adequate fire protection. 5. That the part of the alley being closed is not used by the Police Department for its police .cars in policing said territory, nor is it used by the Street Department for its trucks in collecting trash, paper, ashes, and the like. 6. That the closing of said portion of said alley will not leave the property of any person without means of ingress and egress. 7 . That the closing of said portion of said alley will not affect . the growth of said City nor affect accessibility to any church, school, or public building. . - 8. That the closing of said alley will relieve the City of its maintenance and ,policing and will create taxable income. 9: . That itis difficult for automobiles to turn at the intersection of the'.alley leading west from South Seventh Street at its point of intersection with the alley being partially closed , and for such season it will be in the public interest to widen the alley at such point of intersection, and for that purpose to condemn and appropriate a portion of- land owned by Robert L. Hudson, and formerly occupied by the ('rand Hotel. 30 10. That said remonstrators have failed to show that it will not be of public utility to vacate said alley, or that said Reso- lution should be rescinded. After full consideration the Board overrules said remonstrances and finds that it would be in the public interest to confirm its said Declaratory Resolution in so far as said vacation of said por- tion of said alley is concerned, and that it likewise is in the public interest to change and widen said alley at the place described. To provide for said change and widening, said Resolution is modified as hereinafter set out. It is, therefore, ordered, adjudged and decreed by the Board of Public Works and Safety of the City of Richmond , Indiana, that a. por- tion of the alley running south from the south line of ?,Fain Street between South Sixth and South Seventh Streets , a distance of ei.hty (80 ) feet, in the City of Richmond, County of Wayne, and State of Indiana, which alley proposed to be vacated is more Particularly . described, as follows, to-wit : Commencing at the northeast corner of Lot Number One Hundred Five ( 105 ) in John Smith 's Addition to the original plat of Richmond; thence south a distance of Eighty (80) Feet along the east line of land owned by Stuart J. Beebe and Myra Beebe ; thence east a dis- tance of Ten and Fifty-five Hundredths 10 55) Feet to the west line of Lot Mum- ber One Hundred Fifty (150 ) in John Smith's Addition to the City of Richmond , Indiana ; thence north along the west line of land owned by Robert L. Hudson to the northwest corner of said Lot Humber One Hundred Fifty ( 150) in John Smith 's Addition, and to the south line of Main Street ; thence west a distance of Ten and Fifty-five Hundredths (10. 55 ) Feet to the place of beginning, all as shown by a plat of such proposed vacation now on file in the office of the Department of Public Works of said City, be and theesame is finally -vacated and closed. BE IT FURTHER ORDERED, That said alley, beginning a.t a point. • in its east line a distance of One Hundred and Fifty-eight ( 158) Feet south from the south line of Main Street, be changed and widened, and for such purpose the following parcel of land is app- ropriated : A triangular part of Lot Number One Hundred Fifty (150 ) in John Smith ' s Addition to said City of RiChmond now owned by Robert L. Hudson, described as follows : Beginning at a Point in the - west line of said lot a distance of Ten `(-10 ) Feet north from the southwest corner of said lot ; thence south on the west line of said lot a distance of Tenn(10) Feet to said Southwest corner of said lot ; thence east on the south line of said lo.t a dist-nce of Ten (l0•) Feet ; thence in a northwesterly direction a distance of Fourteen (14 ) Feet and One and Two-thirds (1 2/3 ) inches to the point of beginning. 31 The land thus appropriated shall be opened and laid out as an alley, and hereafter shall remain oven as such for the use of the public. Dr. Raleigh Miller, 213 North 19th street was appointed dog catcher for a period of three months beginning April 18th and ending July 18, 1939. City Attorney Johnson was instructed to prepare a contract covering same. Mr. Paul Minor, 216 South 23rd St. appeared in the interest of citizens in his neighborhood who were expected to tar into the new sanitary sewer. Mr. James Q,uigley's contract for the concession in Clen Miller Park was cancelled,on account of non-payment of rent. Mr. Bob Endsley was given the contract for the concessions in Clen Mi ller Park including the concessions at Clear Creek Park. A request for a light to be installed at the alley between North E and the Railroad on 16th street was apnroved. Bids were Presented on steel for the White �j3Jater Boulevard Bridge as follows : Joslyn Mfg. Co . , Ft. Wayne , Ind. - $422 .00 W. J. Holliday & Co. , Indianapolis - ?435. 00 by freight - '$42. 0 0 by truck On Holliday bid, if rail steel was used , deduct $16. 00 from either above prices. Sam &affe Co . , Inc . - Richmond - Billejt Steel - 425.85 TT Tt Tt tt - Rail steel Reinf. bars .410. 35 Above price includes delivered to the job. Upon motion by Mr. Johnson, seconded by IT. Hodgin, the contract was awarded Mr. Jaffee on the Billet Steel at $425.85. After allowing bills in the amount of V3: 1440 56 the Board ajourned. 411f- yor Attest City Clerk
