HomeMy Public PortalAbout01-27-1939 lU OFFICE OF THE BOARD OF WORKS AND SAFETY CITY OF RICHMOND , INDIANA, Friday, January 27 , 1939. The Board of Public Works and Safety of the City of Richmond , Indiana met in the office of said Board, Friday, January 27 , 1939 at 9 :00 A.M. Messrs. John R. Britten Simeon Hodgin and Henry U. Johnson II being present the following proceedings were had , to-wit: The minutes of the preceeding meeting were approved as read. ' I/ Mr. Evans , representative of the Fyr-Fyter Company of Dayton, Ohio was present and tried to interest the Board in some small extinguishers for use in garages . This was referred to Fire Chief Williams. Mr . Don Bell ,and Mr. A. L. Jenkins members of. the Public Relations Committee of the Richmond Fire & Casualty Insurance Association were present with some data on the City' s insurance policies and recommend- ed that the present policy on public liability covering all the parks and public activities of the City be increaded to $50 ,000.00 and $100 ,000.00. Af te:r careful consideration by the Board concerning. the small increase in premium for larger amounts they decided to increase the liability limits to $100 ,000.00 and $200 ,000 .00. After motion by Mr. Hodgin, seconded by Mr. Johnson, it was approved by the Board. On instruction from the Board this Committee on Insurance was to make further reports on all policies carried by the City. A letter was read stating that the premium on Earl Freeman' s' bond was tto high and a refund would be made soon. The City Controller was instructed Ito accept such a refund . Carl J. Kutter appeared in person and by his attorney, Cliff M. Haworth, and waived the reading of the following charges against him, to-wit: • TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND WAYNE COUNTY, INDIANA: Comes now Ellis H. Duckett and charges and alleges that Carl J. Kutter , City Inspector of Weights and Measures of the City of Richmond , Wayne County , Indiana, had been and is guilty of the following derelictions in his said office , towit: 1 . That said Carl J. Kutter has been and is guilty of neglect of his official duties. 2. That said Carl J. Kutter has been guilty of neglect of orders concerning his office. 3. That said Carl T. Kutter has been guilty of conduct ifl j urious to public peace and welfare. 4. That said Carl J. Kutter is guilty ,of con- duct unbecoming a public officer . And this complainant further says that he believes said charges are true to the best of his information and belief. Wherefore he prays the said Board to dis- miss said Carl J. Kutter from his said office of Inspector of Weights and Measures of said City of Richmond , Wayne County , In- diana. 11 Signed Ellis H. Lucas Rohe Notary Public My commission expires Jan. 13 , 1943. and his said attorney filed with the Board of Public Works his denial of said charges and thereupon made his formal demand for a public hearing in the words following: TO THE B CARD 'OF PUBLIC WORKS AND SAFETY OF 7HE CITY OF RICHMOND , WAYNE COUNTY, INDIANA: Comes now Carl J. Kutter and shows to your Honor- able Board that he has been charged in an affidavit, that. he has been guilty, as City Inspector of Weights and Measures of the City of Richmond , Wayne County, Indiana, of the following derelictions in his said office , to-wit: 1. That said Carl J. Kutter has been and is guilty of neglect of his official duties. 2 . That said Carl J. Kutter has been guilty of neglect of orders concerning his office . 3. That said Carl J. Kutter has been guilty of conduct injurious to public peace and welfare. 4. That said Carl J. Kutter is guilty of conduct unbecoming a public officer. Affiant now denies each and every allegation as above set out and says that he is not guilty of any of said charges , and that he demands of your Honorable Board that he be given a hearing on said charges and that a trial of same be , had. - Carl J. Kutter • Subscribed and sworn to before me this 26th day of January 1939 . Clifford M. Haworth Notary Public. My commission expires Jan. 8, 1943. which hearing was granted by said Board to be held in the Council Chamber of the City of Richmond on Friday morning , February 10 , 1939 . Bids were presented by Wa-llar _Mo-to3s Inc . , County Motors , B & W Sales and Chenoweth Motor Co. on three new cars for the Police Department. Hr . Britten ordered the Clerk to open and read same . On motion by Mr . Johnson , seconded by Mr . Hodgin, a committee was appointed to consider the bids and report at the next Board meeting. Members of the Committee named were Mr. Hodgin of the Board of, Works , Mr . Duckett , Chief of Police and Mr. Harding of the Police Board. 12 Mr. Clarence Brown and Ivir. Ben Hill of the Reid Hospital Board appeared before the Board in regard to the. arrangement with the City about the current used by the Hospital . After much discussion , it was pointed out that this was a matter for Common Council and the Utility Committee to consider. Mr. ,Brown was instructed to present the matter to Council at its next meeting. Mr. Burkhardt, street commissioner presented a .requisition to the Board for a new truck to replace one 1928 Model A Ford truck, engine #A65-659 . The Clerk was instructed to advertise1/. for bids and instruct the Tudge of the Circuit Court to appoint the required appraisers. After the Board approved invoices amounting to $25 ,622.25 it was adjourned. e yor ' Attest: t , i y Clerk.
