CITY OF RICHMOND, XNDIANA,
FRIDAY, JANUARY 20, 1939.
The Board of Public Works and Safety of the. City of Richmond,
Indiana, met in the office of the said Board Friday, January 20, , :
1939 , at 9 :00 o ' clock A.M.' Messrs. John R. Britten, Simeon W.
Hodgin and Henry U. Johnson II being present , the following pro-
ceedings were had, to-wit : -
The minutes of the preceeding meeting were approved as read
before the Common �Council.
Several citizens were present from the West Side in regard to
the Johns-Manville plant and the fumes coming from it. Mr. Britten
asked if there were any who wished to talk before the Board they
might do so. Mr. H. 0. Nichloson, a world war veteran who was
gassed, ..stated that it was very distressing to him in his condition
to try to: ,sleep with the windows open any at this time- of the year
from the terrible odor. Mr. Howard Hammer said that the thing the
residents over there were anxious to know, was that this might be
remedied before the time came to have the windows and doors open
because of warm weather. City Attorney Johnson stated that the City
' can do nothing in the matter unless a civil suit was brought against
the Company. Fire Chief Williams said he had talked to plant offic-
ials and they assured him that there was nothing harmful to the
health from these fumes and that they are working as fast as Possible
to clear this up. City Engineer Hodgin said that he had talked to
officials of the Company and they were very anxious to eliminate
this unpleasant odor and thought that they would have it under control
with sixty days.
Miss Lena Hiatt representing the Corporation of Spring Grove
appeared befo ra• they Board in regard to a .possible agreement with
the City of Richmond by Spring Grove for fire protection. She
said that they had tried to get this done under former administra-
tions but it had been decided against them. Mr. Atwood Jenkins
spoke on the subject also. Both he and Miss Hiatt stated that the
insurance rates had advanced for the Corporation since the City had
refused to make an agreement for protection. This had been taken
up with Mr. Sellers, manager of the Indiana inspection bureau and
Mr. Uoldsmith, manager of the National Board of Fire Undeawriters
and they said. that if the City would make such an agreement with
Spring Grove Corporation that it would be recognized as a factor in
lowering the rates again. They also said} it was not necessary that
the contract 'be binding in that it would °interfere with the protect-
ion of the- City in any way. Miss Hiatt said that they pay $260 for
hydrant rental per year. City Attorney Johnson said that if Mr.
Sellers assures the City that such an agreement would not in any
way affect the insurance rate for the City of Richmond or weaken the
' fire protection of the City, he thought it was well to make such an
agreement. In the discussion it came out that there is no agreement
with Earlham College or Reid Hospital other than a gentlemen's agree-
ment. The prevailing rate to these outside institutions and commun-
- - ities is 50 Mall the first hour for two trucks and 425 etteh ;per. ha,ur or
fraction ,of an hour after that. After -a motion' by Mr. Hodgin and
seconded by Mr. Johnson, the Board agreed to have an agreement suit-
' able to' both parties presented at the next Board meeting. Mr. Johnson
was instructed to prepare same.
The Indemnity Insurance Company of North America presented the
following acknowledgment to be signed in regard to the Lewis Edward
Reed case.
WHEREAS, the Indemnity Insurance Company of North America,
Under Policy No. 0LT302065 in force January 29 , 1938, did insure
the City of Richmond, Indiana , against public liability up to
the sum of Five Thousand Dollars (: 5000. 00) for any one -acci-
dent, and
WHEREAS, Lewis Edward Reed, a minor, was injured at the bear
cage by a bear owned and confined by the City of Richmond, in
Clen Miller Park owned by the City, resulting from the alleged
negligence of the City in maintaining said bear cage, and
WHEREAS, suit was brought on behalf of said minor by Wayne
Reed his next friend , against the City of Richmond , Indiana,
to recover damages for said injuries, being cause No . 29374
in the Wayhe Circuit Court of Wayne County, Indiana, and judg-
ment was therein rendered in favor of said minor and against
the defendant City of Richmond for the sum of Fourteen Thou-
_sand Dollars (514,000.00) , same being record in Civil Order
Book 92, page 543, in the office of the Clerk of said Court.
NOW,THEREFORE, in consideration of the payment of the sum of
Five Thousand Dollars ($5000.00) by said insurance company on
said judgment, said City does hereby acknowledge satisfaction
of all liability of said insurance company under said policy
of insurance arising out of said accident and said judgment in
favor of said minor.

The Board agreed to accept the settlement and signed the paper.
Mr. Johnson stated that the insurance on the residence in
Clen Hiller Park that is to be torn down has been cancelled.
A request was made for a light to be installed at llth and
_ S. W. A St. This was turned over to Mr. Hodgin and Mr. Beck of
the Light Plant.
In accordance with Mr. Britten's plan to have the City's insur-
ance pro-rated to responsible local insurance agencies, the follow-
ing resolution was approved by the Board. -
Resolved that the Board of Public Works and Safety in orderI/
to more equitably distribute the insurance business of the
City of Richmond, Indiana, Within its province and the benefits
to be derived therefrom, adopts the schedule to be adhered to
during the year of 1939, or until modified.
The Board further resolves that they shall recognize a committee
consisting of Don Bell, Atwood Jenkins and Robert Huff, known
as .•the Public Relations Committee of the Richmond Fire and Casu-
alty Insurance Association for the following purposes, viz :
1. As an agency to carry out the distribution of the above
designated commissions.

2. To analyze the assumption of risk and protection now
afforded..
3. To make recommendations as to forms, coverages, etc.
4. To facilitate handling of insurance claims and to act
as insurance counsellors without any expense whatever
to the city. •
5. This plan shall in no way effect the insurance now in
force with the Citizens Mutual Fire Insurance Company
of Richmond, Indiana.
tJr., R. Cutte_r deposited the 1000 bond as required under the agree-
• • ment by the Association. It was agreed that all insurance policies
and official bonds now in effect be turned over to this committee.
Mr. Britten invited the Board to be present at the next meeting
of Common Council, Monday, February 6th.
Mr. Snyder of the Fire Department was called_ before the Board
in regard` to a judgment against him for $187., 00 from the court of
S. K. Morgan, Mr. Britten read the 'Ordinance to Require Employees
of the City to Pay Their Just Debts' and required him to have the
claims against him on file in the Controller 's office picked up by
February 1st. Mr. Britten emphasized the fact that this applies to
all. City employees. .
Representatives of the Dual Automatic-)Parking Meter Co. were
present and demonstrated their street parking meters. • These meters
were $56.50 complete and are 53" high. They suggested installing
• these for six months and if at the end of that time the City does .
not wish to keep them they will remove them and put the sidewalks
in as good shape as they formerly were. During this trial period
the City would receive 25¢ on each dollar collected by the meters
and if the City should decide to keep them the full amount collected
by the meters would apply on the purchase price. Mr. Johnson read
a letter in regard to the installation of such meters from the
Chamber of Commerce of Oklahoma City to the City of Muncie, Indiana.
Mr. Hodgin suggested that the Board go .to Anderson and Muncie and
see these meters in operation and find out more about them.
After the Board approved invoices amounting to $7,304. 18 it
adjourned.
