CITY OF RICHMOND, INDIANA, ,
TUESDAY JANUARY 3, 1939
The Board of Public Works and Safety of the. City, of
Richmond, Indiana, met in special session, in the office
of said Board, Tuesday January 3, 1939 at 7 :10 o ' clock P.M.
Messrs. John R. Britten, Simeon W. Hodgin and Henry U.
Johnson I:I being present , the following proceedings were had,
to-wit :
Th'e reading of the minutes of the preceeding meeting was
dispensed with.
Mr. Johnson presented the following resolution for consid-
eration of the Board:
January 3, 1939
RESOLUTION No. 1-19391 SPECIAL SESSION
WHEREAS, the City of Richmond , Indiana, has been made a
Party defendant to ..an action numbered 29360 in the Wayne
Circuit Court of 'Wayne County, Indiana, entitled Robert L. Hudson,
Stuart J. Beebe and Myra Beebe vs. the . City of Richmond, Indiana,
said action being to vacate a portion of a certain north, and
south alley located between 6th and 7th Streets and Vain end
South A Streets in said City of Richmond, end
"JHEREAS, the former ?Board of Public Works and Safety of said
City has heretofore instructed the then City Attorney to take a
change of venue on behalf' of said City in said action, which
affidavit for said change of venue has . been filed, but upon
which the court has not yet taken any action, and ,
HEREAS, the present Board of Public Works and Safety has
consulted and advised with the Street Commissioner, Fi.rr° ,Chief,
Chief of Police and City Civil Engineer to determine whether
or not it is to the best interestsof said City of Richmond to
vacate said alley, and ,
?WHEREAS, it is the unanimous opinion of said department
heads .so consulted and advised with that tit is to the best
interests of said City that said alley be vacated and that said
City should do and perform everything necessary to expedite said
action and proceeding as a party defendent thereto,
NOW, THEREFORE, BE IT RESOLVED by the Board of Public " Works
and Safety of the City of Richmond, Indiana, in special session,
that the City Attorney be instructed to withdraw said affidavit for
a change of venue before action is taken thereon, and submit
said issue for trial and hearing before said Wayne Circuit Court
of Wayne County, Indiana.
After due con ideration and discussion it was moved by
Mr. Hodgin, with ,.--,--. nd by Ins. Johnson, th- - he resolution
