I write you this letter in connection with the caption. Needless to say, I am concerned and disturbed. Quite frankly, I am disturbed because I do not feel that the Town of Gulf Stream is protecting its residents any longer. I am assuming that this was a policy decision which did not emanate from your office. With regard to the three signs in the right-of-way of A-1-A in front of the old Spence Property, as you know, those signs were illegally planted. Nonetheless, I note (as late as this morning) that they continue to exist. Quite frankly, I believe those signs cause a diminution in value to my property and the property of others; and if the Town is not going to take immediate action, be assured I and/or other nearby property owners will. In that connection, I urge you to handle the matter, as I have no appetite for suing the Town of Gulf Stream. Moving on to the other three signs which are on the property between the old Spence Property to the east and the waterway to the west; and between my home to the north and the former Wheeler home to the south, those signs are in violation of the Town Code (specifically, Sec. 66-447) because, inter alia, the signs are more than 4’ above the finished grade of the ground. Thrasher, Town Manager October 26, 2012 Page 2 ________________________________________________________________ In addition, with regard to those same signs, I point you to Paragraph 9 of the Agreement Re: Proposed “Harbor View Estates” Development (the “HVE Agreement”) and to the following language which is recited, in relevant part: “The respective owners of Lot 1, 2 and 3 of the Replat may not do anything within the portions of their respective Lots lying westerly of the Private Road…”. In addition, I point you to the Declaration and Establishment of Conditions, Restrictions, Limitations, Reservations and Easements Upon Hidden Harbour Estates, a Subdivision; and, more particularly Paragraph 15 thereof which reads as follows: “SIGNS. No sign of any kind shall be displayed to the public view on any lot, without the prior approval of the Subdivision Control Committee as to the size, content and location of such sign.” As I see things, we have six signs which have been erected, none of which comply with the requirements under the law; and as to those same six signs, none of them comply with the requirements of the underlying documents which control the subdivision known as the Hidden Harbour Estates and the HVE Agreement made between the Laudani crowd and certain of the neighbors in the area.
