HomeMy Public PortalAbout2023-03-28 Special Meeting Minutes Special Meeting of the Mayor and Council March 28, 2023 A Special meeting of the Mayor and Council was held on March 28, 2023, at 7:00 PM in the Municipal Building. Meeting Called to Order Roll Call The following Council Members and Professional Staff responded to the roll call Councilmember Ansh, Council President Bonagura (via teleconferencing), Councilmember Cardenas, Councilmember Kelly, Councilmember Lambrix, Councilmember Sheppard, Borough Administrator Hart, Borough Attorney Smith and Borough Clerk Rulli. Mayor Kahwaty arrived at 7:15 p.m. Sunshine Law Statement: The Borough Clerk read the Sunshine Law Statement. Flat Salute Moment of Silent Appreciation to Our Veterans Time for Public Comment Motion to open the time for public comment was made by Councilmember Kelly, seconded by Councilmember Ansh. On voice vote, all in favor. Ari Donio, 501 Kings Pointe Trail, stated in regard to tomorrow's meeting there is no rush to vote and asked that the Mayor and Council negotiate. He questioned if a warehouse will affect our obligation for Affordable Housing and spoke about the impact on Police, Ambulance, and Fire services. He stated he feels the traffic study is a farce, and raised concerns about noise, air, and light pollution. He stated if Hekemian wants to sue, let him sue. Jim Vinci, 972 Lily Pond Lane, stated the settlement terms that the Borough has presented is better than the multifamily deal and he would be in favor of this deal He stated he will not pursue a course of litigation that he has been considering with a group of other residents. He stated a need to look at the whole town and a straw poll indicates this will get better reception than the last meeting. Mr. Vinci commented on the Hekemian presentation and expressed his support of this transaction. Motion to close the time for public comment was made by Councilmember Kelly, seconded by Council President Bonagura. On voice vote, all in favor. Special Meeting of the Mayor and Council Page 2 March 28, 2023 Minutes Resolution For Closed Session BE IT RESOLVED, by the Mayor and Council of the Borough of Franklin Lakes, County of Bergen and State of New Jersey that a Closed Meeting be held on Tuesday, March 28, 2023 which begins at 7:00 PM, in the Conference Room at the Municipal Building to discuss the following: • Anticipated Litigation—Proposed Cigna Development BE IT FURTHER RESOLVED that the discussion conducted in closed session shall be disclosed to the public once the matter involving the confidentiality of the above no longer requires that confidentiality, then the minutes can be made public. NOW, THEREFORE BE IT RESOLVED, that the public be excluded from this meeting. Motion to go into Closed Session was made at 7:16 PM by Council President Bonagura, seconded by Councilmember Kelly. On voice vote, all in favor. The Mayor and Council returned to open session at 8:27 PM.
