Members present: Mayor, Thomas Anderson; Councilmembers, Nancy Laurent, Thomas Crosby, William Reiser, Sarah Lutz; Clerk, Donna Roehl; planning and Zoning Administrator, Robert Derus; police Chief, Charles Hoover; public Works Director, Ron Duran; Engineer, Lyle Swanson; Attorney, Richard Schieffer; Minutes of December 19th: Thomas Crosby asked that the following changes be made in Item 11, Page 141: Thomas Crosby stated that the city seldon dictates architectual standards but if zoning code could be amended to include special situations then special zoning problems might be solved. Motion....determination of the following: Building permit application including location of main house together with proposed landscaping,....remainder of motion. Motion by Crosby, seconded by Reiser to accept minutes of the December l9th, as corrected'. Motion declared carried 1. PUBLIC WORKS DEPARTMENT Northwestern Bell Telephone Co. Motion by Laurent, seconded by Lutz to adopt Resolution 79-1 allowing Northwestern Bell Telephone Co. to bury cable on Hamel Rd. west of Hunter Dr. Motion declared carried Holasek Ditch Allen Holasek appeared to present a bill for $100 incurred when he had a ditch cleaned abutting his property on Hunter Dr.,He stated that he had asked Ron Duran in the spring of 1978 to clean the ditch because their field was being flooded. Ron Duran stated that when they did clean d itches they would do that ditch. When fall arrived the ditch was riot cleaned so they contracted to have the work done themselves. Letter from Ron Duran stated that the Holaseks had not contacted him for permission to work on road righ-of-way and after consultation with the city attorney would recommend the council deny any payment of the bill. Crosby asked Richard Schieffer on what basis recommendation for non-payment was made. Richard Schieffer stated that this would be an unauthorized expenditure of city funds as permission had not been obtained from city council. Crosby stated that in two instances; sewer cleaning and sewer stub location; both had been discussed with council before work was done. Emil Jubert asked if city could have done the work cheaper or would it cost more to do the work in the spring of 179. Allen Holasek asked why he wasn't told to ask Council to have the work done. He added that he had lost crops in 2 years and would lose again. Crosby stated that he understood the situation but Council would be setting a precedent by paying. Motion by Crosby, seconded by Lutz to deny request for reimbursement of ditch digging ex- pense of $100. Motion declared carried Hackamore Rd. Emil Jubert asked if road beyond Fidel Eckes could be closed as road is impassable to keep open in the winter and cars are getting stuck. Motion by Laurent, seconded by Reiser to close Arrowhead Dr. temporarily between Chippewa and Hackamore to be reconsidered by Council if landowners register complaints. Motion declared carried 2. POLICE DEPARTMENT Loretto Contract Motion by Reiser, seconded by Crosby to enter into polcing contract with the City of Loretto at $8856 per year or $738.00 per month, for 1979. Motion declared carried Police Chief Hoover stated that Loretto would like to know by September of each year what the charges for the following year will be. 3. ESCALLE-HANSON Jim Lane, representing George Hanson, appeared to request a variance from the plattingl 4 5 ordinance to allow Mr. Hanson to purchase the old village hall site of 3.25 acres and add to his 1.4 acre homestead site. Mr. Hanson also owns 61 additional acres. Crosby stated that he wished to disqualify himself from the discussion because he represents the sellers, Escalle and Madawick. Laurent stated that the 3.25 acres should be combined with the 61 acre site. Jim Lane stated that he was not in a posistion to respond for his client fi that was the direction of Council; that to plat would be an expensive procedure and a larger parcel would be created by combining the 2 smaller parcels. Richard Schieffer stated that even though combining the two smaller parcels a substandard size lot would be created. Motion by Laurent to grant a variance from the platting code to George Hanson to allow the consolidation of a 3.25 acre parcel to the larger parcel. No second to the motion. Motion by Reiser, seconded by Lutz to allow combination of 1.4 acre site to 3.25 acre site for the following reasons: Road divides property, city hall site used by village from 1893- 1974, at no rent; dwelling unit is constructed on the 1.4 acre site, which is a substandard lot. Motion carried Abstaining, Thomas Crosby 4. BURGESS-GOBEL Lyle Swanson reported that Mr. Gobel would provide the city with a certified check to gurantee completion of any additional work that may be required on Wichita Tr., if the city would re- lease the bonds being held. Engineer stated that $1000 would be a sufficent amount to request. Motion by Reiser, seconded by Crosby to release the 2 bonds being held and secure a certified check for $2000 according to terms of the development agreement being held by the city. Motion declared carried 5. APPOINTMENTS Newspaper Discussion as to which newspaper to declare the official newspaper for 1979. Thomas Anderson stated that he would want to supply minutes to newspapers before being off- icially approved by Council. Thomas Crosby stated that if it were understood that minutes were not approved they could be supplied. Motion by Reiser, seconded by Laurent to appoint the crow River News as official newspaper for 1979. Motion declared carried Crosby stated that in determining official newspaper in the future consideration should be given to newspaper providing the best coverage in Medina and to publish important items in the Suns News that affect the various areas of the city. Bank Depository Motion by Laurent, seconded by Reiser to declare the Farmers State Bank of Hamel as official depository for 1979. Motion declared carried Acting Mayor Motion by Crosby, seconded by Lutz to declare William Reiser as Acting Mayor for 1979 due to senority on the council. Motion declared carried Commissioners Discussion of councilmembers as commissioners of various city department. It was noted that the Mayor is automatically the head of all departments. Crosby stated that he would volunteer as public safety commissioner particularly to work with the fire departments on contracts. 146 Lutz stated that he would volunteer as commissioner of Health and Welfare and Parks. Laurent stated that she would act as commissioner of roads. Reiser volunteer as commissioner of water and sewer department. Motion by Laurent, seconded by Reiser to accept slate of commissioners as listed above. Motion declared carried 6. PLANNING COMMISSION Sarah Lutz stated that Ron Fortin has requested appointment to planning Commission to fill Tom Anderson's posistion. Thomas Crosby stated that Joe Bizzano is interested in being a member of the commission. Motion by Crosby, seconded by Reiser to table appointment of new member until January 16th and to seek additional interested citizens. Motion declared carried 7. WOODLAKE SANITARY LANDFILL Motion by Reiser, seconded by Lutz to grant a license to Woodlake Sanitary Landfill for 1979 at a fee of $750. Motion declared carried 8. CIGARETTE LICENSES Motion by Lutz, seconded by Reiser to approve cigarette licenses for 1979 to the following: Donald Mayer Inc., Tom Pettit, Rolling Green Country Club, Medina Recreations, Hamel K.O. Service, Robert Klein ( Hill Liquor). Motion declared carried Clerk asked that police officers notify those businesses not submitting applications to submit them for the January 16th meeting. 9. ASSESSOR'S CONTRACT Discussion of the prepared contract. Council asked that transportation clause be incl- uded as well as request that assessor attend 5 meetings during 1979. Motion by Laurent, seconded by Crosby to accept assessors contract with a November 30th expiration date and request that attorney make corrections as suggested above. Motion declared carried 10. ANIMAL WASTE ORDINANCE Discussion of the prepared animal waste ordinance including the fact that dairy farms are not a problem when considering storage of animal waste. Motion by Crosby, secondedty Laurent to adopt Ordinance 176, regarding animal waste storage. Motion declared carried 11. SPRINGER LAND DIVISION Discussion of the "hold Harmless' clause to be attached to the development contract. Crosby asked why successors were not included and should wives be asked to sign. Richard Schieffer stated that he would rewrite using language from the original agreement and bind successors and present at the January 16th meeting. 12. ELM CREEK WATERSHED DISTRICT Motion by Crosby, seconded by Reiser to appoint Robert Derus as alternate delegate to the Elm Creek Watershed District. Motion declared carried 13. NORTHWEST LEAGUE OF MUNICIPALITIES Motion by Crosby, seconded by Reiser to appoint Thomas Anderson as delegate to the North- west League of Municipalities. Motion declared carried Motion by Lutz, seconded by Reiser to appoint Laurent as alternate delegate to the League. Motion declared carried 14. BUILDING INSPECTOR Robert Derus presented information as to building inspection costs for 1978. IH17 15. COMMITTEES Council discussed Mayor Anderson's proposal regarding establishing committees to study var- .ous phases and city departments. Several suggestions for additions and deletions were discussed. Donna Roehl was asked to have local newspapers request interested citizens to work on the various committees and finalize at the January 16th meeting. 16. BUDGET Thomas Anderson presented a preliminary budget he had prepared and explained his suggested figures. Members discussed memberships in various organizations: Northwest eague of Municipalities, Metropolitan League of Municipalities, Northwest Suburban Chamber of Commerce. Crosby stated that salaries should follow the 7% guidelines plus fringe benefits. Council spent time working on various department budgets. Work to be continued at the January 16th meeting 17. BILLS Motion by Reiser, seconded by Crosby to pay the bills: Order checks #7824-7875 in the amount of $101,923.64 and Payroll checks # 5206-5231 in the amount of $7117.82. Motion declared carried 18. HYDRANTS Ron Duran asked that water customers be notified as to hydrant flushing schedule. Donna Roehl reported that she would include a notification as to parking regulations on city streets during winter months. 19. ALTERATION ON CITY RIGHT OF WAY Aotion by Laurent, seconded by Crosby to authorize the attorney to prepare an ordinance to regulate alteration on city right of way.
