Minor, AICP Planning Consultant, Town of Gulf Stream CC: Scott Morgan, Mayor, Town of Gulf Stream Greg Dunham, Town Manager, Town of Gulf Stream DATE: May 8, 2017 RE: GUNTHER VOLVO – DELRAY BEACH PROPOSED EXPANSION AND RECOMMENDED CONDITIONS On behalf of the Town of Gulf Stream, I would like to thank you and your staff for your assistance and consideration with regards to the review of the proposed expansion of the Gunther Volvo automobile dealership at 2201 North Federal Highway. The massing of the proposed parking garage and its impact on the adjacent Place Au Soleil neighborhood has been and continues to be a concern for the Town. Through the development review process, improvements to the plan, such as the relocated loading area, loudspeaker ban, and evening hour limits, have come about based on community comments. However, as currently proposed, the development plans do not adequately address important quality-of-life issues for the Town’s residents, such as light and noise pollution. The proposed expansion will further aggravate existing issues of adverse light and noise intrusion from the current dealership layout to the neighborhood. With regards to lighting, the City’s code addresses photometric levels permitted along residential property lines, but it does not address the “spotlight” effect of 25-foot high light poles from an adjacent resident’s view. In addition, the proposed landscaping plan, which was designed to help buffer the adjacent properties from such adverse impacts, incorporate many existing trees on site which are stressed, sick and stunted in its growth. As such, the existing trees do not adequately screen the current uses on the site and would not be appropriate for the expanded use. The proposed plan also does not provide sufficient landscaping height adjacent to the proposed 3-story garage in order to buffer the resulting light and noise. With this memorandum, we are recommending five conditions of approval to address these issues. The proposed conditions do not affect the proposed site plan or building architecture nor result in significant additional costs for the developer. The proposed conditions are: Lights throughout the project, including the top deck of the parking garage, shall be turned off 10 p.m. each night. Lights at the project and building exits shall be lowed to minimum security light levels by 10 p.m. Lights on the top deck of the parking garage and within 100 feet of the residential neighborhood shall use cutoff luminaires. The existing live oak trees along the site’s eastern boundary shall be replaced with new, healthy live oak trees prior to the issuance of the Certificate of Occupancy. The new live oak trees shall be 14 to 16 feet in height at planting. Trees and landscaping shall be maintained to the City’s standards found in Section 4.6.16 (I) of the Land Development Regulations. In order to help screen the noise and light from the parking garage, the submitted landscape plan shall be augmented a minimum of 12 cabbage palms directly adjacent to the northeast and eastern elevations of the garage. Each cabbage palm shall have a minimum of 20 feet of clear trunk. Louvered shutters shall be placed on the parking garage to aid in shielding light and noise sources from emanating from garage and impacting surrounding properties. We believe these conditions will help alleviate many of the adverse impacts anticipated. The Town would ask that these conditions of approval be part of the Site Plan Review and Appearance Board consideration of approval. Thank you for your time and attention to this issue.
