CITY OF RICHMOND, INDIANA,
FRIDAY MARCH 26, 1937.
The Board of Public Works and Safety of the City of
Richmond, Indiana, met in the office of said Board,
Friday March 26, 1937, at 9:00 o°clock A. M. Messrs.

Joseph M. Waltermann, Simeon Hodgin and William Kelley,
Jr. being present the following proceedings were had,
to-wit:
The minutes of the preceeding meeting were approved
as read.
Complaint was again made as to turning on and off of
the street lights, and that they were turned on before
dark and allowed to burn too long in the morning. This
complaint was to be taken up with Mr. Hess.
A communication was received from the Richmond
Property Corporation, stating that they were going to.
build several houses in the Peacock Addition on West
Main Street, and requesting the installation of utility -
services. The Board looked favorably on this request
and decided that if and when these houses were built,
utility service would be ordered installed.
This being the time and place fixed for a public
hearing and protest against the proposed contract
granting to the Wayne Works the right to use part of
North "F" Street and part of North Seventeenth Street
for the construction and use of a railroad side track,
the Board now takes up the consideration of such matter.
Proof of publication and posting of notices is presented
to the Board, showing that a full and complete text of
said contract, with the time and place of such hearing,
had been published in the Palladium on March 9 and 16,
1937, and in the Item on March 10 and 1:7th, 1937, both
of the same being daily newspapers of general circulation
in said City of Richmond, and that the same had. been
posted in ten public places in said City on March 10,
1937, which p °6of of publication and proof of p fisting
are attached to and made a part of the proceedings.
It is also shown that said Wayne Works had paid all costs
of publication and posting.
No taxpayer appearing and no protest being made
against said contract or the granting thereof, the Board
now on motion duly made and seconded, adopts the following
resolution:
" BE IT RESOLVED, That this Board finally enter into
and execute the contract with the Wayne Works, as appears
in the minutes of said Board held March 8, 1937, whereby
said Wayne Works shall have the right to construct and
use a railroad side track in and over parts of North "F"

and North 17th Streets in said City, and said contract
upon being executed shall be submitted to the Common
Council of said City for approval ."
I/ The contract was thereupon executed by the Board and
said Wayne Works, and a copy thereof placed on file
with the glerk of said City, and the Clerk was instructed
to present the same to Council for consideration.
This being the day fixed by the Board for receiving
and hearing remonstrances, (after notices given and served)
from persons with regard to the amount of awards or
assessments made under Resolutions Nos. 253-1.937, vacation
proceedings, and Resolution No. 25-I--1937, alley opening
proceedings, and no person now appearing and no protest
being made. The Board sustains and confirms said awards
and assessments, and makes the same final. The Clerk is
instructed to deliver said assessment roll to the
Department of Finance of said City as provided by law.
Mr. Hess of the Light Plant was before the Board in
regards to the claim of S873.69 which the plant had
against McKechnie-Peirce and which City Controller
George Coons had paid said plant and deducted the
said amount from the unpaid balance due McKechnie-
Peirce from the City of Richmond. After some discusion
it was decided to let McKechnie-Peirce sue the City
for this amount and in the event that said suit was
won by McKechnie-Peirce, the Light Plant would return
the amount of $873.69 to the Civil City.
Only one bid was received for the privilege of
operating an ice house on the Market House lot , this
being from the Wayne Ice Co. who offered $70.00. The
Board decided that due to the nuisance created and
the complaints received over this privilege, that they
would reject this bid and order the ice house removed �--
from the lot.

Claims to the amount of $10,984,52 were allowed,
after which the Board adjourned.
