The Board of Public Works and Safety of the City of Richmond , Indiana , met in Special Session in the office of said Board , Monday March 8, 1937 , at 8 :00 11/ o ' clock P. M. All members of the Board were present. The Wayne Works being represented by Yale Shively, its president , and Will W. Reller, its attorney, requested that the City grant it the right to use part of N girth "F" Street and part of North 17th Street for a railroad switch and siding. A form of contract for this purpose was presented and the same was discussed. Thereupon on motion made and sceonded, the following resolution was unanimously adopted by the Board. RE TT RESOLVED That it is the desire and the intent of the Board of Pubic Works and Safety of the City of Richmond, Indiana, to enter into the following contract with the Wayne Works, an Indiana corporation, operating a factory in said City, to-wit : CONTRACT THIS CONTRACT Made by and between the City of Richmond, Indiana, hereinafter designated as City, and the Wayne Works , an Indiana corporation, here- inafter designated as Grantee, WITNESSETH: Said City hereby grants tosaid Grantee and its assigns the right to build, maintain, and use a railroad switch, with a branch therefrom, for indust- rial purposes in, along, and over North "F" Street and North Seventeenth Street in said City, as follows : The center line of the main sidetrack to be constructed and used shall commence at a point in the south line of North "F" Street approximately Two Hundred Fifty Five (255) Feet east of the east line of North Sixteenth Street, thence by a curve to the left a distance of approximately One 'Hundred Sixty (160 ) Feet to a paint in the center line of North Seventeenth Street ; thence north along the center line of North Seventeeith Street approximately Two Hundred Forty (240) Feet to the north line of North "0" Street. The location of the private sidetrack branching therefrom is to be as follows : Beginning at a switch Point in said main sidetrack approximately One . • Hundred Thirty ( 130.) Feet north of the center line of said North "F" Street ; thence northwestwardly along North Seventeenth Street a distance o.f appr- oximately Two Hundred Thirty (230 ) Feet to a point in the north line of North "G" Street. • Al'l in accordance with a plat attached hereto ' and marked "Exhibit A" . {.. . Said tracks shall be of standard gauge and shall be laid and maintained by said Grantee to conform to . the established grade of said street , and said Grantee or its assigns, shall keep and maintaih said streets occupied by said tracks, and for eighteen ( 18) inches on the outside of each rail thereof, in ' proper and safe • condition at its expense. • • In the event that said tracks shall be removed • from said streets, whether the same be done voluntar- ily or by authority of said City, then and in either • of said evenets said Grantee shall immediately there- after, at its own expense, place sais streets as occupied by said tracks in a proper and safe condition for public travel. • Said Grantee.-agrees to save said City harmless froi4 any liability arising during construction of • said tracks by reason of the of the maintenance of • the same or that portion of the streets occupied bTr them. In the event that the City shall determine to permanently improve either of said streets at the place occupied by said tracks , then said Grantee shal bear the cost of improving such portion of said street or streets as is occupied by said track or tracks and eighteen inches (18) on the outside of each rail thereof. The Clerk, at the expense of said Wayne Works , shall cause the complete text of said contract to be pub- lished in the Palladium and the Item, two daily news- papers of general circulation, published in said • . City of Richmond , together with the time of said hearing. Said notice shall be published in each paper twice, one week apart, and the last Publication to be at least one week before said hearing, and said contract and notice shall be posted in 10 public places in said City.
