Office Of the Board of Works
City of Richmond, Indiana,
Friday September 11, 1936.
The Board of Public Works and Safety of the City of
Richmond, Indiana, met in the office of said Board ,
Frdiay September 11, 1936, at 9 :00 o ' clock A.M. Messrs.
Joseph M. Waltermann, Simeon Hodgin and William Kelley,
Try' being present, the following proceedings were had, to-wit :
The minutes of the preceeding meeting were approved as
read in Council.
Lyman Lybolt of the Richond High School was before the
Board seeeking permission for the High School teams to
play football at the Municipal Baseball Park, Mr. Hodgin
recommended that insomuch as the School City was realy
a part of the City, that they be allowed the use of this
park free of charge, a discussion then arose as to how
v we could charge one group for the use of the park (where
admission was charged) and not charge the other and it
was finally decided that the orginal ruling should stand
and that the High School would have to pay $10. 00 per
day for the use of the park.
The Ladies Auxilarreof the Knights of St .John were
granted permission to have a ,parade on Sunday September
27 , 1936, also permission to rope off North A Street
during a part of the afternoon on said date for the
purpose of holding the their drill teams contest..
The Richmond Community Orchestra was granted the use
of the stage on Roosevelt Hill for the date of Sunday
October 4, 1936, but their request for the use of the
sound equipment was denied, account of the fact that
the fund which was used for recreation on Roosevelt Hill
—was exhausted, and the Clerk was instructed to notify
them that they would have to arrange to take care of
the expense of installing the sound equipment if they
desired to ude the same.
Superintendent of Streets Burkhardt was instructed
to cooperate with Superintendent of Schools Bate in
/ regards to the painting of the necessary yellow lines
on the streets near all schools so that our children
might be better protected.
A petition for a water main extension on South 0
Street from 6th to 2nd Streets was received and referred
r- to the City Engineer and the Water Works to determine
if the required income could be received.
Permission to cut the curb on South L Street on lots
7399 & 342 was granted Sam Jaffe.
The Mayor stated that there was to be a meeting of
Mayors from all over the United States, held in Cleveland

Ohio , sometime during the month of October for the
purpose of considering the gas rates charge in the
various communities , and he stated that it was his
intention to attend this meeting in the interest of
the City of Richmond.
The Board authorized the payment of the contract
4„- price of i500. 00 for band concerts for the year 1936,

to Yr. Fred Deiderich of the American Legion Band.
The following Resolution was received and adopted
on the recommendation of Mr. Hodgin:
Resolution No . 9 - 1936.
•1HERZAS, the City of Richmond on the ist day of April
1935, entered into a contract with Max Irinsch.er & Sons,
Inc. Ft . Wayne, Indiana, for the construction of Division
I of the Sewage Treatment Works for the City of Richmond ; and
WHEREAS, the contract provided for liquidated damages
to be deducted from the contract price for the services
of the Consulting Engineer for inspection of the work in
excess of the contract Aeriod; and
WHEREAS, the contract for engineering services between
Charles Ti. Hurd, and the City of Richmond, dated ,August
28, 1934, Provide that the city of Richmond shall pay
the Consulting Engineer at the rate of 15. 00 per day
for each inspector and assistant engineer on the work in
excess of said contract period ; and
WHEREA.2, said Charles F. Hurd, as evidenced by a letter
addressed to the Board of Public Works and Safety under
date of August 26, 1936, has waived payment by the City
to the Consulting Engineer of any amount which may have
accrued on account of any such overtime inspection ; and
WHEREAS, said Contractor has prosecuted said work diligently
and has complied with the requests of this Board as to the
use and occupancy of the main treatment units of the
Sewage Treatment Plant before its final completion and
acceptance by this Board; and
WHEREAS, the Contractor has suffered on account of delays
due to weather conditions and other conditions beyond his
control and has been further delayed in the completion
of the work due to Change Orders issued by this Board ;

NOW THEREFORE BE IT RESOLVED:
Section 1. That this Board hereby waives any and all
liquidated damages from said Max Irmscher & Sons. Inc.
Contractor for Division I of the Sewage Treatment Works
for the City of Richmond, as Provided under Section 11
of said contract, on account of any additional time in
excess of the contract period required for the completion
of the work to and including September 5, 1936.
Section 2. That the Board having received the approval
of State Director PWA, hereby extends the time for the
completion of thw ork under said contract with Max Irmscher
& Sons . Inc. to and including September 5, 1936.
The Clerk was instructed to have liability insurance
for the Municipal Baseball Park furnished by the Peltz
Agency. He was also instructed to write to some of the
other ball teams and determine what protection they had
V for property damage.
Mr. Will Reller, representing the Wayne Works was
before the Board relative to the vacating of certian streets
✓ and alleys adjacent to the said Wayne Works, and agreed
that the Wayne Works would furnish bond to protect the
City against all damages due to said vacation proceedings,
should the proposed resolution be adopted.
The Board acting on this assurance then unanimously
,/adopted Declaratory Resolution No . 252 - 1936, and
instructed the Clerk to prepare the proper advertisement
and the hearing date was set as October 9 , 1936.
Superintendent of Streets Burkhardt renrted that one
the horses used at the park had died and wanted permission
to hire one horse, when needed for the balance of the year,
since it was his intention to do away with the use of all
horses next year. The Board granted this permission.
Ross Harrington was before the Board with a release
to be signed between the City of Richmond and the Indemnity
Insurance Co . of Philadelphie, Pa. The Board did not sign
this release since it was made out for the payment of

the release so as to show the proper amount which the
City would actualy receive, with the assurance that this
would clean LID all claims connected with the firework case
in glen . iller Park.
The Clerk received and opened the following bids for
weatherstripping the windows in the City Building :

All these bide were referred to the City Engineer
Building Inspector and City Purchasing Agent for
decision.
Claims to the amount of 22,881.00 were allowed
after which the 73oard adjourned.
