The Board of Public Works and Safety of the City of Richmond, Indiana, met in the office of said Board , Friday September 4, 1936 at 9 :00 o' clock A.M. Messrs. I/ Joseph M. Waltermann, Simeon Hodgin and William Kelley, Tr. being present the following proceedings were had, to-wit : The minutes of the preceeding meeting were approved as read. The Clerk reported receipts at the Municipal Base- ball park for Sunday September 4, 1936 as follows : General Admission Cities Share $47 . 00 Concession Cities Share 1.88. Permission to cut the curb at 328 North 4th Street was granted to the Ideal Welding Co. and at 213 North 3rd Street to Louck & Hill Co. City Attorney Kelley advised the Board that vacation proceeding for the streets and alley adjacent to the Wayne Works would have to be filed in Circuit Court. The Board awarded the contract for a draft control to the Breithaupt E ectric Co . for their bid price of 1.37 . 50 installed. A representative of the Parlameter Company was before the Board explaining the proposition offered by his company. The Board decided that they would not consider these meters . The Mayor reported that the traction company had arranged to load and unload passengers in front of Quigleys Drug;-Store at Fourth and Main and it was thought this would work out better since there was no double track at this location, he also reported that the Great Eastern Bus Company had agreed that there busses would only be parked on South •8th Street long enough to load and unload passengers. Byrum Robbins who was representing Mrs. Harry Landis was before the Board and stated that Mr. Landis was willing to accept the check in settlement for the damages done to his car in the accident which occured on Sheridan Street if he was not asked to sign a release covering personal injuries, and stated that although Mr. Landis was injured it was not possiblo at this time to determine the extent of such injuries, The Clerk reported that he had rented the Municipal Ball Park to DeHart Hubbard of Cincinnati, Ohio , for the afternoon of Friday September 11, 1936. 275 City Purchasing Agent Ray Stevens was authorized to secure bids on weather stripping the windows on the second floor. RESOLUTION NO. 8 WHEREAS, the City of Richmond , Indiana , by and through its Board of Public Works and Safety, under date of April 1, 1935, entered into a contract with Max Irmscher & Sons, Inc . of Fort Wayne, Indiana, for the construction of Division I of the Sewage Treatment Works for the City of Richmond ; and WHEREAS, said contract is subject to the provisions of a contract, dated August 16, 1934, entered into between the City of Richmond and the United States of America, by and through the Federal Emergency Administra tion of Public Works, whereby the Ooverment has agreed to grant aid to the City of Richmond in financing said project under the condition that the work shall be carried out under the regulations of the Federal Emergency Administration of Public Works ; and WHEREAS, the work under said contract is now 100% complete, except for minor items of adjustment furnished by manufacurers to the Contractor and covered by the Contractor' s guaranteed maintenance and except due to the unavailability of sewage gas, the gas engine blower unit under this contract has not been subject to final test ; and WHEREAS, as provided for by Resolution adopted by this Board on the 26th day of June , 1936, there is to remain in the retained percentage Twenty One Thousand Three Hundred Seventy Three Dollars and Forty One Cents ($21,375.41) , which retained percentage is to be paid under the provisions of aid contract ; and WHEREAS, it is the opinion of the Board that the City of Richmond is amply protected as to the gas engine blower unit , which is completely installed and ready for testing, by the above retained percentage. NO THEREFORE BE IT RESOLVED: Section . That the Board' s Consulting Engineer is hereby instructed to certify on the usual estimate prepared by the Contractor that the work under said contract is 100% complete, with the exception of the testing of said gas engine, upon the approval of the Public Works Administration Section 1. That this Board approves payment to the Contractor of the total amount due under his contract except the Twenty One Thousand Three Hundred Dollars and Forty One Cents ( 21,373.41) . 276 Section 3. That the Public "forks i,dministration is hereby requested to approve the modification in the terms of payment as herein set out .
