II/ The Board of Public Works & Safety of the City of Richmond,
Indiana, met in the office of said Board, Friday, August 14, 1936
at 9:00 A. M. Messrs. Joseph M. Waltermann, . Simeon W. Hodgin, and
William H. Kelly, Jr. , being present the following proceedings
were had to wit:
The minutes of the proceeding were approved as read in
Council.
The City Clerk was instructed to notify Trustees of
Earlham Cemetery to remove the monument on City lot in said
cemetery.
The request of Mrs. Lillian Shofer, South 6th street for
yellow curb was granted, the curb around the driveway only to
be painted.
The Board authorized the use of political banners across
streets, said permission would be granted to recognized parties
only.
The Clerk reported receipts of $288.00 from admissions to
' Baseball Park, Sunday August 10th. The city' s share of 15% being
43.60, and on the concessions 30% of 815.55 being $4.66. These
amounts were turned over to the Controller.
A petition for a light at Southwest 17th & B street, also
light at Southwest 17th between A & B was referred to City
Engineer Hodgin.
Street & Park Commissioner Albert Burkhardt was authorized
to attend the meeting of Park Commissioners at Indianapolis.
The petition of 'the Knowels Tool Company to cut curb on
South 7th was approved.
The following new P W A resolution was received and
approved by the Board, the city will not be at any expense
by adopting the same:
RESOLUTION OF THE BOARD OF PUBLIC
WORKS AND SAYETY OF THE CITY OF
RICHMOND, INDIANA
WHEREAS, the City of Richmond on the 1st day of April 1935,
entered into a contract with the McKechnie-Pierce Company of
Toledo, Ohio, for the construction of Division II of the Sewage
Treatment Works for the City of Richmond; and
WHEREAS, said contract provides for liquidated damages
to be deducted from the contract price for the service of the
Consulting Engineer for the inspection of the work in excess
of the construction period; andI/
W. ±REAS, the contract for engineering service between
Charles H. Hurd, Consulting Engineer, and the City of
Richmond, Indiana, dated August 28, 1934, provides that
the City df Richmond shall pay the Consulting Engineer at
the rate of $15.00 perday for each inspector and assistant
engineer on the work in excess of said construction period;
and
WHEREAS, said Charles H. Hurd, as evidenced by a letter
addressed to the Board of Public Works and Safety under date
of July 15, 1936, has waived payment by the City to the
Consulting Engineer of any amounts which may have accrued on
account of any such overtime inspection; and
WHEREAS, said Contractor has prosecuted said diligently
and has complied with the requests of this Board as to the
manner and methods of construction and connecting up the
work, and the City has not suffered damage on account of
delays in its completion;
NOW THEREFORE, BE IT RESOLVED:
Sectionl. That this Board hereby waives any andaall
liquidated damages from said McKechnie-Pierce Company,
Contractor for Division II of the Sewage Treatment Works
for the City of Richmond, as provided in Section 11 of
said contract, on account of any additional time, in
excess of the contract period, required for the completion
of the work to June 29, 1936.
Section 2. That the City Clerk is hereby instructed
to transmit a copy of this Resolution to the McKechnie-
Pierce Company, Contractor, and to the State Director of
P W A, as notice of this action by the poard.
Mr. John. Clements of the Wayne Works appeared before
the Board regarding the expansion program of hj!s company.
He stated there is no truth to the rumors that the company I/
will be sold. It is their plan to put building one block
east of plant, and a block nor th of plant, close North
16th from F to G, close G street from 16th to 17th, and
use 17th north of F street for switch. The Pennsylvania
Railroad agreed to install switch if agreeable to Common
Council and Board of Works . The matter was referred to
City Planning Commission with the Board? s recommendation
that request be granted.

Ross Harrington, attorney on compensation on
insurance in city parks appeared before the Board.
It was agreed insurance company would make compromise
proposition of 50% of $4,000.00. City to add to present
policy to cover baseball park. The Board authorized Mr.
11/ Harrington to effect some settlement for $2,000.00 up
and report back to the Board.
City Engineer Hodgin reported that the hospital
would furnish the material, and W P A the labor for
the construction of a sanitary sewer from hospital
to city intercepting sewer. The Board authorized
connection be made subject to the State Board of
Health approval. Mr. Hodgin will take up the matter
of Spring Grove connecting with city sewer with the
State Board of Health and report back to the Board.
