Councihnan Presents the following Ordinance Seconded by Councilman _
AN ORDINANCE AMENDING CHAPTER 160 "LAND
DEVELOPMENT" OF THE CODE OF THE BOROUGH OF
CARTERET.
BE, IT, ORDAINED by the Mayor and Council of the Borough of Carteret that chapter 160
of the Code of the Borough of Carteret is amended as follows:
1) Section 160-26 is deleted in its entirety and replaced with the following:
"160-26 Expiration of Variances.
A. Any variance from the terms of this Chapter hereafter granted by the Board of
adjustments or Planning Board permitting either a specified use of any premises, a
specified structure on any premises, or any setback, buffer or other relief, shall
expire by limitation unless such construction alteration or improvement shall have
actually commenced on each and every structure and improvement permitted by said
variance, or unless such permitted use has actually been commenced within nine (9)
months of the date of adoption of the resolution of the Board of Adjustment, or the
Planning Board, as the case may be; except, however, that the running of the period
of limitation herein provided shall be tolled from the date of filing an appeal from the
decision of the Board of Adjustment of the Planning Board as the case may be, to the
governing body, or a court of competent jurisdiction, until the termination in any
manner of such appeal or proceeding.
B. The Board of Adjustment, or the Planning Board as the case may be, may exercise its
power to extend the time for commencement set forth in 160-26(A) upon the
showing of good cause after a hearing held upon notice to all parties who would have
been entitled to notice of the original application, and publication in an official
newspaper designated by the Borough.
2) Section 160-46 is amended by deleting the existing sub-section B. and adding the
following additional subsections:
B. Fence Fees

1) Residential Zones - $30.00
2) Commercial Zones -$45.00
3) Industrial Zones- $75.00
C. Shed Fee. Sheds in all zones 100 square feet or less and height of 10 feet or less -
$30.00
D. Concrete Fees. Please refer to chapter 222. "Streets and Sidewalks."
E. Minimum Fee. The minimum fee under Section A of this Chapter shall be $5.00
BE, IT FURTHER ORDAINED, the Carteret Planning Board has considered and
recommended the modifications included in this ordinances.
BE, IT, FURTHER RESOLVED that a copy of this ordinance be forwarded to the
Middlesex County Planning and be advertised as prescribed by law.
