SUSPECT AREAS SEWER SEPARATI'ON AND IMPROVEMENTS CONTRACT
WHEREAS, on 3uly 19, 2001, the Governing Body of the Borough of Carteret
passed Resolution No. 01-241 awarding a contract to Star of the Sea Concrete
Corp. in the amount of $399,950.00 for the Carteret Suspect Areas Sewer
Separation and Improvements Contract; and
WHEREAS, the Borough's Consulting Engineer for the project, T & M Associates,
has advised the Governing Body that a modification to said contract is required
as a result of conditions which were unforeseen at the time of the award of said
contract, and has further advised the Governing Body that said modification is
reasonable and reflective of the actual work performed and quantities utilized in
the performance of said contract; and
WHEREAS, due to the above referenced unforeseen field conditions, T & M
Associates has recommended that the contract with Star of the Sea Concrete
Corp. be modified in accordance with Change Order #3, (see attached letter and
Change Order); and
WHEREAS, the Governing Body has reviewed Change Order # 3 which results
in a net reduction of $110.00 to the contract.
NOW, THEREFORE, BE 1-r RESOLVED by the Mayor and Borough Council of
the Borough of Carteret, County of Middlesex, State of New ]ersey as follows:
(1) Contract Change Order #3, attached hereto and made a part hereof,
resulting in a net reduction of $1:10.00 in the contract price; and the
payment of the revised contract price for the Suspect Area Sewer
Separation and Improvement Contract, including said Change Order, in
the total amount of $455,875.63 is hereby approved.
(2) That the appropriate Borough officials are hereby authorized and
directed to execute Change Order #3.
