The size of the proposed parking lot and the overall disturbance of land exceeds 40,000 square feet. Based on this new information, the Board will need to open the public hearing and vote to refer this application to the Cape Cod Commission as a Mandatory Referral. A follow-up motion will also need to be taken to continue the hearing to a date and time certain. The Chair, Paul Wallace, will open the public hearing and then ask Town Counsel, Jonathan Silverstein to speak to the matter. The Chair will then allow the applicant to speak briefly, but they cannot speak to the merits of the case. There will be no public input on this application at this evening's meeting, as this is a Mandatory Referral. Below please find the reference to the Barnstable County Ordinance, along with recommended motions. Barnstable County Ordinance 90-12, Chapter A: the Enabling Regulations Governing Review of Developments of Regional Impact, Section 3: Developments Presumed to be developments of Regional Impact (DRI Review Thresholds): Upon the effective date of this ordinance, the following standards and criteria ("thresholds") shall set forth the types and classes of development presented to be Development of Regional Impact (DRIB) .... Any development that meets or exceeds the thresholds adopted below shall be referred to the Commission as a DRI. (e) Any of the following proposed developments: commercial, service, retail, wholesale business, industrial, private office, private health, private recreational or private educational which exceeds these criteria: (iii) For Outdoor Uses, new construction or development that has a Total Project Area greater than 40,000 square feet. Recommended Motion for the Referral: Move to refer the Special Permit and Site Plan review Application #2022-01, for Ocean Edge Resort LLC, for property located at 2851 Main Street and 0 Main Street to the Cape Cod Commission as a Mandatory Referral pursuant to Barnstable County Ordinance 90-12, Chapter A, Section 3(e)(iii) and to authorize the to sign. Recommended Motion for Continuance of the Public Hearing: Move to continue the public hearing for the Special Permit and Site Plan Review Application #2022-01, for Ocean Edge Resort LLC, for property located at 2851 Main Street and 0 Main Street to Wednesday, April 27, 2022, at 7:00 pm. Should the Planning Board have any questions about the DRI process either Town Counsel or I will be available to address them.
