AWARDING BID FOR
WATERFRONT PARK AMENITIES IMPROVEMENT CONTRACT
WHEREAS, the Borough has publicly advertised for the receipt of bids for the
Waterfront Park Amenities Improvement Project; and
WHEREAS, the Borough has solicited and received two (2) bid proposals for the
Waterfront Park Amenities Improvement Project as follows:
Total Bid
1. TC Landscape Construction Group, Inc.. Toms River, NJ $ 93.500.00
2. Zenith Construction Services. Inc.. Orange, NJ $ 178.300.00
WHEREAS. TC Landscape Construction Group, Inc.. has submitted the lowest bid for
said contract as evidenced by the response on file with the Borough's Purchasing
Department and with the Borough Engineer; and
WHEREAS, the Borough Engineer has reviewed the above bid proposals and has
recommended the award of a contract to TC Landscape Construction Group. Inc.. in a
total amount not to exceed $93,500.00, per attached award letter; and
WHEREAS, the Chief Financial Officer has certified that funds are or will be available
for said purpose.
NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of
Carteret as follows:
1. That the appropriate Borough Officials are hereby authorized to
enter into a contract with TC Landscape Construction Group. Inc..
of Toms River. N.J. for the Waterfront Park Amenities
Improvement Project Contract as described above for the sum of
$93,500.00 in accordance in all respects with the request for
proposals and bid on same.
2. That a copy of this Resolution shall be forwarded to the Borough's
Purchasing Department. CME Associates and Borough Director of
Engineering.

3. That the aforementioned award of bid is contingent upon formal
approval from the New Jersey Department of Labor. Division of
Wage and Hour Compliance.

Enclosed herewith please find a summary of bids received on September 13, 2017, for the above
referenced project. A total of two (2) bids were submitted, ranging from an apparent low bid of
$93 by TC Landscape Construction Group, Inc. to a high bid of $178,300.00 by Zenith
Construction Services, Inc. The Engineer's Estimate for the base bid was $116,150.00. Please find
enclosed a complete Summary of Bids for the Council's review.

It should be noted that there were irregularities present in several of the bids submitted, including
that of low bidder, TC Landscape Construction Group, whose bid was not submitted intact and was
missing insurance experience information. We believe that these irregularities are minor in nature
and not a mandatory cause for rejection; therefore, the outcome of the bid is unaffected.
As a matter of procedure, our office. has contacted TC Landscape Construction Group to discuss
their bid. The representative we spoke to indicated they are comfortable with the bid as submitted
and there is no objection to completing the project based on the bid prices submitted and the
contract time.
Based on this information, we recommend the following actions:
1. Award of the contract to the low bidder, TC Landscape Construction Group, Inc., 729 Marie
Street, Toms River, NJ 08753 within 60 calendar days, on a unit price basis in the total amount
of $93,500.00 for bid items 1 through 7 inclusive, as available funding permits. The award
should be subject to review and approval by the Borough Attorney, including concurrence to
waive the minor irregularities, the review of the bid bond and surety from the low bidder, and
submission of the required bonds and insurance certificates for the project.
