Lucas Brothers, Inc., Morganville, N,1 $ 1,079,349.00 2. S. Brothers, Inc., South River. NJ $ 1.172.992.92 3. Black Rock Enterprises, Inc., Old Bridge, NJ $ 1.354,935.00 4. Lucas Construction Group, Inc., Morganville, NJ $ 1.294.294.00 5. Berto Construction. Inc., Rahway. NJ $ 1.579.796.50 WHEREAS, Lucas Brothers. Inc., has submitted the lowest bid for said contract as evidenced by the response on file with the Borough's Purchasing Department and with the Borough Engineer: and WHEREAS, the Borough Engineer has reviewed the above bid proposals and has recommended the award of a contract to Lucas Brothers. Inc., in a total amount not to exceed $1,079,349.00, per attached award letter: and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as follows: 1. That the appropriate Borough Officials are hereby authorized to enter into a contract with Lucas Brothers, Inc., of Morganville. N.J. for the 2017 Road Improvements Program Contract as described above for the sum of $1.079.349.00 in accordance in all respects with the request for proposals and bid on same. 2. We believe that these irregularities are minor in nature and riot a mandatory cause for rejection, therefore the outcome of the bid is unaffected. Based on this information, we recommend the following actions: Award of the contract to the low bidder, Lucas Brothers, Inc. of 80 Amboy Road, Morganville, NJ 07751, within 60 calendar days, on a unit price basis in the total amount of $1,079,349 00 for base bid items 1 through 52 inclusive, and all Addition Items A through D, inclusive, as available funding permits. The award should be subject to review and approval by the Borough Attorney, including concurrence to waive the minor irregularities, the review of the bid bond and surety from the low bidder, submission of the required bonds and insurance certificates for the project, and approval by NJDOT Local Aid District III. 2. Bids and bid securities of the second and third low bidder. S. Brothers, Inc and Black Rock Enterprises. be retained and held open, pending execution of the contract agreement by Lucas Brothers, Inc. 3. Return the bid securities of the remaining bidders By copy of this letter, we are requesting the Borough Attorney prepare the necessary Resolution of Award.
