HomeMy Public PortalAboutORD 50_Northwest Energy Code_01011992ORDINANCE FOR THE ADOPTION OF THE NORTHWEST ENERGY CODE AND STANDARDS ORDINANCE NO. 3 () An ordinance of the City of Iona adopting the 1990 edition of the Northwest Energy Code and the 1990 edition of the Northwest Energy Code Standards regulating the use of electrical energy in all buildings or structures in the City of Iona; providing for penalties for the violation thereof, repealing Previous edition of the Model Conservation Ordinance of the City of Iona and all other ordinances and parts of the ordinances in conflict therewith. The City Council of the City of Iona do ordain as follows: Section 1. That certain documents, three (3) copies of which are on file and are open for inspection by the public in the Planning and Zoning Office of the County of Bonneville, being marked and designated as: Northwest Energy Code 1990 edition, published by the Bonneville Power Administration and Standards listed in Chapter 1 of this specified Northwest Energy Code, including the Appendix Chapters A, B, C and D. Section 2. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move convert or demolish, equip, use, occupy or maintain any building or structure or cause or permit the same to be done in violation of this code. Each violation of this ordinance or of any regulation, order or ruling promulgated hereunder shall constitute a misdemeanor and be punished by a fine of not more than three hundred ($300.00) dollars or imprisonment for not more than six months or both such fine and imprisonment, for each day a violation continues to exist it shall constitute a separate offense. 1 Section 3. That the Ordinance adopting the 1986 Edition of the Model Conservation Code of the City of Iona and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases by declared unconstitutional. Section 5. That the clerk is hereby ordered and directed to cause this ordinance to be published. Section 6. That this ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect January 1, 1992. IN THE MATTER OF BID PROPOSALS FOR A SOLID WASTE COMPACTION SYSTEM: .}M f1{{• ,r After conferring with Kurt Karst, Alderson & Karst Architects/Plannes,•Bill Manwill, bounty Engine- er, and Robert Henry, Solid Waste Supervisor, the Commissioners reviewed the three (3) bids submitted k• on December 10, 1991, for a solid waste compaction system. The low bidder's, SSI Shredding Systems, 1• proposal was not in compliance with specifications. Bonneville County will not let tht bid at this. time, however, further investigations will be made. /2 IN THE MATTER OF DAY CARE CENTERS: Commissioner/Chairman Long met with representatives of local day cafe .centers and other officials, Debbie Tullos and Gary Walters, 910 North Crimson, Margaret Winborn, Post:Register, Cathy Stumph, 645• s Crimson, Tom Loertscher, State Representative, Kay Sharon Johnson, 305 B1osSom, Dick Fowler, 647 Shoupe Avenue/Fire Department, and Connie Schuldt, 402 North Eve Drive, regardin9•proposed ordinance and regula- tions regarding day care centers. Operators suggested that they could alive with an ordnance similar. to the one being proposed by the city of Idaho Falls, Ordinance No. 1907, and that th6;: county enact; one patterned after the city's. Commissioner/Chairman Long will review the issues with thy::other Commis- ' •! sioners and seek t'le interpretation of said ordinance from the county's leeal.advisors. With all of the requirements for tax-exempt status not being met, the Commissioners denied said request!. The first halfybf tax will have to be paid as soon as possible, however, no later than December 24;,. 1991. The extra .time being granted only because the hearing could not be held at an earlier date.
