Oakland Park Blvd. Fort Lauderdale, Fl. 33334 The Town of Gulfstream Police Department-Custodian of Public Records Date: January 8, 2020 To whom it may concern, This letter shall constitute my request pursuant to chapter 119, Florida Statues (1989) to first review than obtain copies of the following public records: 1. Copies of any and all police reports and supplemental reports regarding case # 19-2455 which occurred at 1330 N. Ocean Boulevard and was reported on December 24, 2019. I agree that I will compensate you for the actual cost of duplication of any of the records that I have requested. Please note that Florida State Statue 119.07 (2)(a) of the Public Records Law provides that a person who has custody of a public record and who asserts that an exemption applies to particular public records or part of such record shall delete or excise from the record only that portion of the record with respect to which an exemption has been asserted and validly applies, and such person shall produce the remainder of such record for inspection and examination. This section further provides that if the person who has custody of a public record contends that the record or part of it is exempt from inspection, he shall state the basis of the exemption which he contends is applicable to the record, inc luding statutory citation to an exemption created or afforded by statue, and if requested, by the person seeking the right under this sub-section to inspect, examine, or copy the record, he shall state in writing and with particularity the reasons for his conclusion that the record is exempt. It is hereby requested that you state, in writing, both the statutory citation to an exemption that you claim applicable to any requested record and specific reasons for a conclusion that the record is exempt. For GS #2762, please be advised that there is no such record of any documents related to disciplinary action for Sgt. O’Donnell or any Internal Affairs Files where he is listed as subject. You mention in your request that you would like to first review these records. Redactions will need to be made before you can review these records. The Town estimates that to prepare these records for your review will require approximately two hours of administrative support at $47.70 per hour, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d). If the costs of reviewing these documents exceeds your deposit, the Town will provide you with an initial production of responsive records for your review and an estimate for the production of any additional responsive records. If the costs of production are less than the deposit, the Town will provide you with access to the responsive records and a refund. (Two hours @ $47.70) = Deposit Due: $95.40 in cash or check. Upon receipt of your deposit, the Town will use its very best efforts to further respond to your public records request in a reasonable amount of time. Due to the nature of these records to be reviewed, you will also be assessed a fee of $47.70 per hour for supervisory assistance per Fla. Stat. § 119.07(4)(d). Records may be reviewed between the hours of 9:00 AM and 4:00 PM, Monday through Friday at Town Hall, 100 Sea Road, Gulf Stream, FL. If we do not hear back from you within 30 days of this letter, we will consider this request closed. OCEAN BLVD. MS. WERHAHN ADVISED ME SOMEONE HAD WRITTEN " MURDER " ON HER SISTER'S (GERALDINE WERHAHN) BEDROOM WINDOW. I RESPONDED TO 1330 N. OCEAN BLVD. AND MET WITH GERALDINE WERHAHN. MS WERHAHN EXPLAINED AS SHE LOOKED OUT THE GLASS FRENCH DOORS IN HER BEDROOM THIS MORNING AT 0900 HOURS, SHE OBSERVED SOMETHING WRITTEN ON THE GLASS. SHE LOOKED CLOSER AND OBSERVED SOMEONE HAD PRINTED " MURDER " ON ONE DOOR, AND "REDRUM ", MURDER SPELLED BACKWARDS, ON THE OTHER DOOR. THE LETTERS WHICH WERE 6 INCHES IN HEIGHT AND WRITTEN IN SOME TYPE OF FLUID. UNKNOWN IF IT IS BODILY FLUID OR PLANT BASED. MS. WERHAHN SAID SHE DID NOT NOTICE ANYTHING ON THE GLASS DOORS AT 2000 HOURS ON THE 23RD. GERALDINE WERHAHN SAID SHE WENT TO BED AT 2200 HOURS ON THE 23RD, AND WAS AWAKENED BY HER DOG BARKING AT 2300 HOURS. SHE LOOKED OUTSIDE AND DID NOT SEE ANYTHING. SHE WENT BACK TO SLEEP AND WOKE UP AROUND 0800 HOURS THIS DATE. WHILE GOING BACK AND FORTH BETWEEN THE rage z of L complaint Number: 19-24JJ LIVING ROOM AND HER BEDROOM SHE NOTICED THE LETTERS ON THE GLASS. GERALDINE HAD HER SISTER , PATRICIA COME IN AND LOOK AT THE LETTERS AND THEY DECIDED TO CALL THE POLICE. SERGEANT PASSEGGIATA ARRIVED AT THE RESIDENCE AND EXAMINED THE SCENE. THE SERGEANT REQUESTED CRIME SCENE FROM DELRAY BEACH POLICE DEPARTMENT, TO COLLECT A FLUID SAMPLE AND LATENTS. CRIME SCENE INVESTIGATOR, AMY THOMPSON. INVESTIGATOR THOMPSON COLLECTED LATENTS FROM THE EXTERIOR OF THE DOOR AND SWABBED THE FLUID FOR DNA. THOMPSON ALSO COLLECTED SALIVA SWABS FROM PATRICIA AND GERALDINE WERHAHN. PATRICIA WERHAHN SAID SHE HAS SECURITY CAMERAS ON THE BACK AND FRONT OF HER HOUSE, BUT THE FOOTAGE COULD NOT BE REVIEWED AT PRESENT BECAUSE THE INTERNET WAS DOWN. A TECH WAS REQUESTED FROM THE SECURITY COMPANY TO RESPOND SO FOOTAGE CAN BE REVIEWED. GERALDINE WERHAHN ADVISED ME SHE DOES NOT HAVE ANY KNOWN ENEMIES OR ANY EX BOYFRIENDS. SHE HAS NO IDEA WHO WOULD HAVE DONE THIS. I WALKED THE PERIMETER OF THE HOUSE AND DID NOT FIND ANY FOOTPRINTS OR ANY OTHER EVIDENCE. LATER THIS DATE I MET WITH ROB WICHA, OF SOUND SPECIALISTS TO REVIEW SECURITY CAMERA FOOTAGE. THE NIGHT OF THE 21ST, 22ND AND 23RD WERE REVIEWED WITH NOTHING FOUND. THE CAMERA VIEW WHICH COVERS THE BEDROOM FRENCH DOORS IS PARTIALLY BLOCKED BY A DRAIN PIPE, CUTTING ALL ILLUMINATION IN THE VICINITY OF THE DOOR. NIGHT SHIFT UNITS WILL BE ADVISED TO CONDUCT EXTRA PATROLS AT THE RESIDENCE. NO OTHER INFORMATION AT THIS TIME.
