Oakland Park Blvd. Fort Lauderdale, Fl. 33334 The Town of Gulfstream Police Department-Custodian of Public Records Date: January 8, 2020 To whom it may concern, This letter shall constitute my request pursuant to chapter 119, Florida Statues (1989) to first review than obtain copies of the following public records: 1. Copies of any and all police reports and supplemental reports regarding case # 18-1964 which occurred at 1424 N. Ocean Boulevard and was reported on September 15, 2018. I agree that I will compensate you for the actual cost of duplication of any of the records that I have requested. Please note that Florida State Statue 119.07 (2)(a) of the Public Records Law provides that a person who has custody of a public record and who asserts that an exemption applies to particular public records or part of such record shall delete or excise from the record only that portion of the record with respect to which an exemption has been asserted and validly applies, and such person shall produce the remainder of such record for inspection and examination. This section further provides that if the person who has custody of a public record contends that the record or part of it is exempt from inspection, he shall state the basis of the exemption which he contends is applicable to the record, in cluding statutory citation to an exemption created or afforded by statue, and if requested, by the person seeking the right under this sub-section to inspect, examine, or copy the record, he shall state in writing and with particularity the reasons for his conclusion that the record is exempt. It is hereby requested that you state, in writing, both the statutory citation to an exemption that you claim applicable to any requested record and specific reasons for a conclusion that the record is exempt. Dear John Sinks [mail to: jsinks@mycisinvestigation.com]: The Town of Gulf Stream has received your public records request dated January 8, 2020. For GS #2762, please be advised that there is no such record of any documents related to disciplinary action for Sgt. O’Donnell or any Internal Affairs Files where he is listed as subject. You mention in your request that you would like to first review these records. Redactions will need to be made before you can review these records. The Town estimates that to prepare these records for your review will require approximately two hours of administrative support at $47.70 per hour, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d). If the costs of reviewing these documents exceeds your deposit, the Town will provide you with an initial production of responsive records for your review and an estimate for the production of any additional responsive records. If the costs of production are less than the deposit, the Town will provide you with access to the responsive records and a refund. (Two hours @ $47.70) = Deposit Due: $95.40 in cash or check. Upon receipt of your deposit, the Town will use its very best efforts to further respond to your public records request in a reasonable amount of time. Due to the nature of these records to be reviewed, you will also be assessed a fee of $47.70 per hour for supervisory assistance per Fla. Stat. § 119.07(4)(d). Records may be reviewed between the hours of 9:00 AM and 4:00 PM, Monday through Friday at Town Hall, 100 Sea Road, Gulf Stream, FL. If we do not hear back from you within 30 days of this letter, we will consider this request closed. OCEAN BLVD., HER BODYGUARD JOHN SCHRICK AND MS. WERHAHN'S NANNY, JAQUELINE LIMA. MS. WERHAHN STATED SHE IS PRESENTLY DIVORCING HER HUSBAND, RICHARD VIENS. THEY HAVE TWO CHILDREN TOGETHER WHO ARE PRESENTLY LIVING WITH HER AT 1330 N. OCEAN BLVD. THE CHILDREN ARE DIETRICH VIENS, 6/19/2013 AND HIS SISTER ADELINE VIENS, 11/5/2014. SHE STATED SHE LEFT HER HUSBAND SEVERAL MONTHS AGO WHEN ALLEGATIONS OF CHILD PORNOGRAPHY POSSESSION BY HER HUSBAND SURFACED. IN ADDITION MS. WERHAHN SAID HER HUSBAND CONFESSED TO INAPPROPRIATE BEHAVIOR WITH A MINOR YEARS AGO IN ANOTHER STATE. THE CHILD PORNOGRAPHY CASE IS PRESENTLY BEING INVESTIGATED BY THE PALM BEACH COUNTY SHERIFF'S OFFICE, DETECTIVE SHARISKA MONROY. THE PBSO CASE # 18-250059. MS. WERHAHN SAID SHE WAS OUT OF THE COUNTRY FOR TWO MONTHS AFTER SHE LEFT WITH THE CHILDREN. UPON HER RETURN MR. VIEN REQUESTED TO SEE THE CHILDREN. THERE WAS NO CUSTODY ORDER ISSUED OR REQUESTED BY EITHER PARTY INITIALLY. MS WERHAHN TOLD HER HUSBAND THAT VISITATIONS WITH THE CHILDREN WOULD BE CHAPERONED BY HER AND HER BODYGUARD, JOHN SCHRICK. ON 9/3/2018 AT 1400 HOURS, ACCORDING TO MS. WERHAHN, SHE AND HER CHILDREN ALONG WITH MR. SCHRICK AND THE NANNY, JACQUELINE LIMA, WENT TO 1424 N. OCEAN, HER HUSBAND'S RESIDENCE. THEY WENT FOR A LABOR DAY DINNER AT THE REQUEST OF HER HUSBAND. PRIOR TO HER DEPARTURE FROM 1424 N. OCEAN IN JUNE OF THIS YEAR. MS. WERHAHN HAD SECURITY CAMERAS INSTALLED IN THE HOUSE. HER HUSBAND WAS UNAWARE OF THE CAMERAS BEING PRESENT. MS. WERHAHN SAID WAS IN THE FAMILY ROOM WATCHING A MOVIE WITH HER FATHER. RICHARD VIEN WAS SEATED ON THE COUCH WEARING A PULLOVER SHIRT AND WHITE SHORTS. MS. WERHAN SAID ADELINE WAS SITTING ON HER FATHER'S CHEST AND ALSO LAID HER HEAD IN HIS LAP. MS. WERHAHN SAID SHE WAS LOOKING AT THE FEED FROM THE SECURITY CAMERA FROM THE KITCHEN AREA AND SAW WHAT SHE BELIEVED WAS HER HUSBAND'S ERECT PENIS. RICHARD VIEN'S ERECT PENIS WAS BULGING FROM THE FRONT OF HIS SHORTS THROUGH THE MATERIAL. MS. WERHAHN TOLD HER HUSBAND TO FIX DINNER AS SHE AND THE CHILDREN NEEDED TO LEAVE. MS. WERHAHN SAID THEY ATE AND THEN LEFT THE HOUSE. MS. WERHAHN HAD STILL SHOTS TIME STAMPED FROM 4:49 PM TO 5:16 PM ON 9/3/2018, WHICH SHE BROUGHT INTO THE STATION WITH HER TODAY. I REVIEWED THE FOUR PHOTOS ALONG WITH SERGEANT PASSEGIATTA. IT APPEARS THAT MR. VIENS HAS A BULGE IN HIS PANTS OR THE MATERIAL IS BUNCHED UP AROUND THE ZIPPER. THE COPY OF THE PHOTOS IS SLIGHTLY GRAINY AND WERE NOT CONCLUSIVE AS TO THE STATE OF MR. VIEN'S PENIS.THE FOUR PHOTOS SHOW ADELINE VIENS STANDING ON HER FATHER BUT THERE WAS NO PICTURE OF ADLEINE VIENS LAYING IN HER FATHER'S LAP. THE STILL SHOTS WERE TAKEN AND HAVE BEEN ATTACHED TO THIS REPORT. MS. WERHAHN, MR. SCHRICK AND JACUELINE LIMA PREPARED WRITTEN STATEMENTS PERTAINING TO THE INCIDENT ON 9/3/2018, AT 1424 N. OCEAN. THE STATEMENTS ARE ATTACHED TO THIS REPORT. IN THE STATEMENT WRITTEN BY THE NANNY, JACQUELINE LIMA, SHE OUTLINES SEXUAL BEHAVIOR SHE HAS WITNESSED BY ADELINE VIENS WHO IS ONLY THREE YEARS OF AGE. MS. LIMA SAID SHE NEVER SAID ANYTHING TO MS. WERHAHN UNTIL RECENTLY BECAUSE SHE THOUGHT IT WAS EUROPEAN BEHAVIOR. MS. WERHAHN SAID SHE WANTED THIS INCIDENT DOCUMENTED AS SHE IS TRYING TO GET A RESTRAINING ORDER AGAINST HER HUSBAND. VIENS SHORTS IN THE CROTCH AREA. DETECTIVE MONROY AND I AGREE THERE IS NO INTENT SHOWN OR INTENTIONAL INAPPROPRIATE ACTIONS DISPLAYED IN THESE PHOTOS BY MR. VIENS. WERHAHN, THE 73 ADDITIONAL AND THE VIDEO CONTAIN THE SAME INTERACTIONS BETWEEN MR. VEINS AND THEIR WHICH TAKES PLACE ON THE COUCH IN THE LIVING ROOM. THE PHOTOGRAPHS, MAY SHOW AN INAPPROPRIATE SITTING POSITION BY MR. VEINS AS HIS ARE JUMPING AROUND ON HIS LAP, THEY DO NOT SHOW A CRIMINAL INTENT THAT WOULD LEAD TO PROBABLE CAUSE FOR CRIMINAL CHARGES. MR. VEIN AT NO TIME COMMITS ANY ACTS OF SEXUAL MISCONDUCT. I FURTHER ON THIS DATE REACHED OUT TO PBSO SGT. MIKE SCAFANI OF THE SPECIAL INVESTIGATIONS DIVISION, SPECIAL VICTIMS UNIT / ALTERNATIVE INTERVENTION SERVICES UNIT. I EXPLAINED THE CASE COMPLAINANT TO SGT. SCAFANI AND EXPLAINED THE PHOTOGRAPHS IN DETAIL. SGT. SCAFANI AGREED WITH ME THAT THERE WOULD BE NO EVIDENCE FOR PROBABLE CAUSE NEEDED TO FILE CRIMINAL CHARGES AGAINST MR. VEIN WITH THE PHOTOGRAPHS / EVIDENCE SUPPLIED. I ALSO SPOKE WITH SGT. L'ETOILE OF THE COMPUTER CRIMES UNIT. SGT. L'ETOILE ADVISED THERE WAS NO EVIDENCE OF ANY SUSPICIOUS ACTIVITY INVOLVING CHILD PORNOGRAPHY ON ANY OF THE COMPUTER COMPONENTS THEY HAD REVIEWED.
