HomeMy Public PortalAbout2014.073 (05-06-14)RESOLUTION NO. 2014.073 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO SOLICIT PROPOSALS FOR THE LEASE OF UNUSED ACRE -FEET OF WATER PUMPING RIGHTS TO BE DETERMINED BY THE DIRECTOR OF PUBLIC WORKS /CITY ENGINEER; TO NEGOTIATE WATER RIGHT LEASE AGREEMENT(S); AND TO AUTHORIZE THE MAYOR TO EXECUTE LEASE AGREEMENT(S) WHEREAS, the City operates several wells that tap the underlying aquifers and supplements the delivery of water to customers by importing water from Metropolitan Water District; WHEREAS, the City has 5,337 acre -feet per year of total allowable pumping allocations; and WHEREAS, in FY10 City Council approved to lease 700 acre -feet per year of pumping rights from the City of Bell Gardens; and WHEREAS, taking into account the 30% carryover in water pumping rights, staff anticipates ending FY 14 with 300 -500 acre -feet of unused pumping rights, an amount subject to change, that can be made available for leasing to a qualified water purveyor. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the City Council authorize the City Manager or her designee to solicit proposals by way of an informal request for proposal process to lease up to 589 acre -feet of unused pumping rights. Section 2. That the City Council authorize the City Manager or her designee to change the amount of acre -feet to lease as 'determined by the Director of Public Works /City Engineer to ensure there is sufficient pumping rights for the City to end FY14 or maximize the amount of available unused acre -feet to lease. Section 3. That the City Council authorize the City Manager or her designee to negotiate an agreement with one or more water purveyors or other lessees based on informal solicitation, and if there are no responsible bidders or bids that are acceptable to the City, to authorize the City Manager or her designee to negotiate with an interested water purveyor or other lessees. Section 4. That the City Council authorize the Mayor to execute a Water Right -Lease Agreement in a form approved by the City Attorney. Section 5.
