A JOINT RESOLUTION OF THE LYNWOOD HOUSING AUTHORITY AND THE
CITY COUNCIL OF THE CITY OF LYNWOOD AS SUCCESSOR AGENCY TO
THE LYNWOOD REDEVELOPMENT AGENCY APPROVING THE TRANSFER
OF THE PROPERTY LOCATED AT 3303 MAGNOLIA AVENUE, LYNWOOD,
CA TO THE LYNWOOD HOUSING AUTHORITY, THE ACEPTANCE OF THE
3303 MAGNOLIA AVENUE PROPERTY BY THE LYNWOOD HOUSING
AUTHORITY, APPROVAL OF THE DISPOSITION AND DEVELOPMENT
AGREEMENT BETWEEN THE LYNWOOD HOUSING AUTHORITY AND
PARTNERSHIP HOUSING, INC. AND CORRESPONDING APPROVAL OF
THE TRANSFER OF THE 3303 MAGNOLIA AVENUE PROPERTY TO
PARTNERSHIP HOUSING, INC.
WHEREAS, the City of Lynwood as Successor Agency to the Lynwood
Redevelopment Agency has received final approval from the California
Department of Finance to transfer the housing asset identified as 3303 Magnolia
Avenue, Lynwood, CA from the Lynwood Redevelopment Agency; and
WHEREAS, in accordance with the Health & Safety Code § 34176, the
City Council of the City of Lynwood as Successor, Agency to the Lynwood
Redevelopment Agency is authorized � to transfer the 3303 Magnolia Avenue,
Lynwood, CA property to the Lynwood Housing Authority; and
WHEREAS, on June 20, 2012, the Lynwood City Council approved a
HOME Reservation Agreement for the reservation of $770,263 in HOME
Investment Partnerships Program funds ( "HOME Funds ") received from the
United States Department of Housing and Urban Development ( "HUD ") to be
used by Habitat for Humanity for an eligible housing project; and
WHEREAS, the City of Lynwood has received a submission from
Partnership Housing, Inc., the development arm of Habitat for Humanity,
providing for the development of the 3303 Magnolia Avenue, Lynwood, CA
property with four (4) units of affordable owner - occupied residential housing to be
restricted for a minimum period of 45 years; and
WHEREAS, Health and Safety Code Section 34315.7(b) requires that the
3303 Magnolia Avenue property can be sold for no less than its acquisition cost;
and
WHEREAS, Health and Safety Code Section 34312.3(b) provides that the
Lynwood Housing Authority may directly assist in the development of 3303
Magnolia Avenue with the proceeds of the sale, provided that the resultant
housing is for persons of low income; and
WHEREAS, Health and Safety Code Section 34312.3(b) allows the
Authority to convey surplus land it acquired from another public agency to a non-
profit developer for the development of single family homes where the
development will provide for home ownership for persons and families of low and
moderate income; and
WHEREAS, on June 17th, 2014 the City of Lynwood Housing Authority
( "Authority ") and the City Council of the City of Lynwood as Successor Agency to
the Lynwood Redevelopment Agency conducted and concluded a duly noticed
joint public hearing concerning the transfer of the 3303 Magnolia Avenue
property in accordance with applicable law; and
WHEREAS, the Authority has prepared a Disposition and Development
Agreement ( "DDA ") which effectuates the conditions of the transfer and
development of the 3303 Magnolia Avenue property; and
WHEREAS, all legal prerequisites to the adoption of this Resolution have
occurred.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD
AS SUCCESSOR AGENCY TO THE LYNWOOD REDEVELOPMENT
AGENCY, AND THE LYNWOOD HOUSING AUTHORITY DO HEREBY
RESOLVE AS FOLLOWS:
Section 1. The above recitals are all true and correct and are hereby
adopted as findings.
Section 2. That the City Council of the City of Lynwood as Successor
Agency to the Lynwood Redevelopment Agency approves the transfer of the
property located at 3303 Magnolia Avenue to the Lynwood Housing Authority and
authorizes the Executive Director to execute documentation in a form to be
finalized and amended as necessary by Authority Counsel to effectuate the
transfer.
Section 3. That the City of Lynwood Housing Authority accepts the
3303 Magnolia Avenue property from the City Council of the City of Lynwood as
Successor Agency to the Lynwood Redevelopment Agency, and authorizes the
City Clerk to execute a Certificate of Acceptance on behalf of the City of
Lynwood Housing Authority.
Section 4. That the City of Lynwood Housing Authority approves the
Disposition and Development Agreement by and between the Lynwood Housing
Authority and Partnership Housing, Inc. in a form to be finalized and amended as
necessary by Authority Counsel, and authorizes its Executive Director to execute
all required documentation to effectuate implementation thereof; and
Section 5. That the City- of Lynwood Housing Authority, in conjunction
with the provisions of the Disposition and Development Agreement by and
between the Lynwood Housing Authority and Partnership Housing, Inc.,
approves the sale of the 3303 Magnolia Avenue site to. Partnership Housing, Inc.
at a cost of $65,078.
Section 6. That the City of Lynwood Housing Authority, in conjunction
with the provisions of the Disposition and Development Agreement by and
between the Lynwood Housing Authority and Partnership Housing, Inc.,
approves the reinvestment of $65,078 in sales proceeds received from the sale
of the 3303 Magnolia Avenue'site to Partnership Housing, Inc. for the production
of affordable housing for low and moderate income households.
Section 7. The Authority Secretary and City Clerk shall certify to the
passage and adoption hereof.
Section 8. This Resolution shall become effective immediately upon
adoption.
