HomeMy Public PortalAbout01/04/00 CCM1 MEDINA CITY COUNCIL MEETING MINUTES OF JANUARY 4, 2000 The City Council of Medina, Minnesota met in regular session on January 4th, 2000 at 7:30 p.m. in the City Hall Chambers. Mayor John Ferris presided. Members present: Ferris, Zietlow, Hamilton, Smith, and Johnson Members absent: None. Also present: Police Chief Ed Belland, Attorney Ron Batty, Public Works Director Jim Dillman, City Engineer Glenn Cook, Planning & Zoning Administrator Loren Kohnen, and City Clerk - Treasurer Paul Robinson. 1. Changes to the Agenda A. Approval of gambling license for Church of St. Anne. B. Move public hearing for vacation of a portion of Cedar Avenue to February 1, 2000 City Council Meeting. C. Executive Session - Holiday Lighting Moved by Carolyn Smith, seconded by John Hamilton, to approve the agenda as amended. Motion passed unanimously. 2. Approval of the Minutes from the December 7, 1999 Regular Council Meeting Minutes. • Page 3, 5th paragraph, change "nineteen" to "seventeen". • Page 3, last paragraph, change "area" to "are". • Page 5, 3rd paragraph, change "possible" to "possibly". • Page 7, 8th paragraph, remove "been". Moved by Carolyn Smith, seconded by Phil Zietlow, to approve the minutes. Motion passed unanimously. 3. Comments from Residents in Attendance on Items Not on the Agenda There were none. 4. Park Commission Comments Jim Dillman said the skating rinks at Medina Morningside and Hamel Legion Park are in good shape. 5. Planning Commission Comments Loren Kohnen said there will be a regular meeting next week. First meeting in three months. 6. Consent Agenda A. Designation of Official Depositories. B. Resolution 00-01 Designating Institutions for Investment. C. Designation of Official Newspaper. D. Approval of Gambling License for Minnesota Motorcycle Riders Assoc. Moved by Carolyn Smith, seconded by Phil Zietlow, to approve the consent agenda. Motion passed unanimously. Medina City Council Meeting Minutes January 4, 2000 2 7. 2000 Appointments Jim Johnson said there was one organization/committee missing from the appointment list. He said earlier this year the City added a representative to the Healthy Communities Committee. Phil Zietlow was designated as the representative to this organization and Jim Johnson as the alternate. Moved by Carolyn Smith, seconded by Jim Johnson, to approve the 2000 appointments as amended. Motion passed unanimously. 8. Addition of Administrator to City Clerk -Treasurer's Title John Ferris said as a part of the departmen t head reviews and salary discussions the Council agreed to add Administrator to the Clerk -Treasurer's title. He said this will not change anything else. Phil Zietlow said the functional relationships between the department heads will stay the same. Moved by Jim Johnson, seconded by Carolyn Smith, to approve adding Administrator to the City Clerk -Treasurer's title. Motion passed unanimously. 8. Support for Hennepin Conservation District's (HCD) Application for a DNR Grant Paul Robinson said that the HCD was applying for a grant to acquire a conservation easement over a portion of Camp Iduhapi's property. Moved by Carolyn Smith, seconded by John Hamilton, to support the HCD grant proposal. Motion passed unanimously. 9. Approval of Gambling License for Church of St. Anne Moved by Jim Johnson, seconded by Carolyn Smith, to approve gambling license for Church of St. Anne. Motion passed unanimously. 10. Postpone Public Hearing Vacating Portions of Cedar Avenue Moved by John Hamilton, seconded by Jim Johnson, to postpone the public hearing to February 1, 2000. Motion passed unanimously. 14. Approval of the Bills Moved by Jim Johnson, seconded by Carolyn Smith, to approve the bills, order check #20541- 20587 for $74, 707.86 , and payroll check # 16391-16430 for $17, 813.93 . Motion passed unanimously. 15. Executive Session Moved by Jim Johnson, seconded by Phil Zietlow, to close the meeting and go into executive session to discuss litigation issues concerning Holiday Station. Motion passed unanimously. Moved by Carolyn Smith, seconded by Phil Zietlow, to reconvene the regular session at 8:30 p.m. Motion passed unanimously. 25. Adjournment Moved by John Hamilton, seconded by John Ferris, to adjourn the meeting at 8:30 p.m. Motion passed unanimously. Mayor John Ferris presided. Members present: Ferris, Hamilton, Johnson, Smith (7:33 p.m.), and Zietlow Members absent: None. Also present: Police Chief Ed Belland, Attorney Ron Batty, Public Works Director Jim Dillman, City Engineer Tom Kellog, Planning & Zoning Administrator Loren Kohnen, and City Clerk - Treasurer Paul Robinson. 1. Changes to the Agenda A. Long Lake Fire Department Presentation was Added. Moved by John Hamilton, seconded by Phil Zietlow, to approve the agenda as amended. Motion passed unanimously. 2. Approval of the Minutes from the December 21, 1999 Regular Council Meeting Minutes • Add to the minutes a list of those who donated. Moved by Carolyn Smith, seconded by Phil Zietlow, to approve the minutes as amended. Motion passed unanimously. 3. Approval of the Minutes from the January 4, 2000 Regular Council Meeting Minutes Moved by Jim Johnson, seconded by Carolyn Smith, to approve the minutes. Motion passed unanimously. 4. Consent Agenda A. Approval of Gambling License for Turn In Poachers Organization. B. Authorization to Advertise for Road Material Bids. Moved by Jim Johnson, seconded by Phil Zietlow, to approve the consent agenda. Motion passed unanimously. 5. Presentation from Long Lake Fire Department Long Lake Fire Department Chief Steve Persian handed out copies of their 1999 year end report and said he wanted to briefly introduce the officers for 2000 and thank the City of Medina for supporting them. He introduced Assistant Captain(not in attendance) - Tim Justice, Lieutenant - Mike Thompson, Safety Officer - Tony Roe, Training Officer - Rick Fredericksen, Lieutenant - Mark Warden. 6. Comments from Residents in Attendance on Items Not on the Agenda Neil Johnson, 435 Ridgeview Circle, wanted to know what the City was doing about recycling. He was concerned that the City may not be active enough in promoting their recycling efforts. He was working on a class project on environmental issues and was concerned about the amount of waste that we are sending to our landfills and what we will do in the future. Carolyn Smith said that she has a lot of information about recycling and would be glad to share some with him. She said that the City does provide residents with a recycling schedule and Medina City Council Meeting Minutes January 18, 2000 6 stickers to the place on their calendars. However, she thought that it would be appropriate to send these stickers to all residents rather than having them pick up the stickers at City Hall. There was some additional discussion about the City's recycling efforts and about additional environmental issues. Jim Johnson said he was concerned about MTB8, an additive in gasoline which is considered a carcinogen and has been found in the public water supply. 7. Park Commission Comments Jim Dillman said there was good use of the Hamel Legion Park over the weekend during the Uptown Hamel Party. John Ferris said that people really appreciated the park and the skating rink. Jim Dillman said he has heard a number of positive comments about the light and the bench. Jim Dillman said that he looked into the cost of fixing our existing bleachers. He said it looks like it will be more cost effective to buy new bleachers rather than fixing existing ones. He said he would bring this issue to the Park Commission and the City Council at a later date. 8. Request to Extend Haug Plat Filing Date Ron Batty said he outlined several options in his memo, basically, the Haugs would like a six month extension for filing their plat. He said they had some problems receiving all of the necessary signatures and since it is now 2000, they would be required to pay their entire 2000 tax bill when the plat is filed. Therefore, they would like to file this plat in six months. Batty said if the Council approves this extension request, he would also like the title updated. Moved by Carolyn Smith, seconded by Jim Johnson, to approve a six month extension for filing of the Haug Plat with the condition that the title work be updated. Motion passed unanimously. 9. Rezoning Request from Rural Residential to Agricultural Preserve. Loren Kohnen said the City received a rezoning request from Wallace Marx at 2842 Parkview Drive to rezone his property from Rural Residential to Agricultural Preserve. He said this piece of property is 42 acres in size and meets all of the necessary criteria for Agricultural Preserve. After some discussion, the consensus of the City Council was to recommend approval. Ron Batty said that the City Council needs to direct staff to prepare an ordinance for rezoning and also direct staff to publish an official map designating this property as agricultural preserve. Moved by Jim Johnson, seconded by John Hamilton, to direct staff to prepare a rezoning ordinance for approval at the February 15, 2000 City Council meeting. Motion passed unanimously. Moved by John Hamilton, seconded by Phil Zietlow, to direct staff to publish an official map designating this property as Agricultural Preserve for approval at the February 15, 2000 City Council meeting. Motion passed unanimously. Medina City Council Meeting Minutes January 18, 2000 7 10. Drug Policy Ron Batty said he and other members of his firm reviewed the drug policy and made the necessary changes to bring this ordinance into compliance with current State law and practices. He said that none of the changes were substantive. However, he would be glad to go through the changes and make copies for the City Council Members to review. Moved by Carolyn Smith, seconded by Jim Johnson to approve the drug policy. Motion passed unanimously. 11. Approve Board of Review Date Moved by John Hamilton, seconded by Phil Zietlow, to approve April 12, 2000 at 7:00 p.m. for the Board of Review Hearing. Motion passed unanimously. 12. Move City Council Meeting Dates Moved by Carolyn Smith, seconded by Jim Johnson, to reschedule the Tuesday, March 7, 2000 City Council Meeting for Monday, March 6, 2000 and the Tuesday, November 7, 2000 for Wednesday, November 8, 2000. Motion Passed Unanimously. 13. Approval of the Bills Moved by Jim Johnson, seconded by Phil Zietlow, to approve the bills, order check #20588- 20652 for $ 76,362.30, and payroll check #16431-16445 for $16,405.66. Motion passed unanimously. 14. Executive Session Moved by Jim Johnson, seconded by Phil Zietlow, to close the meeting and go into executive session to discuss litigation issues concerning Holiday Station. Motion passed unanimously. Moved by John Ferris, seconded by Phil Zietlow, to reconvene the regular session at 9:29 p.m. Motion passed unanimously. 15.
