A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, REVISING
SERVICE FEES FOR THE COLLECTION OF SOLID WASTE
AND THE PROVIDING OF RECYCLING SERVICES;
AMENDING FEES PROVIDED BY RESOLUTION NO. 2005-3;
REPEALING RESOLUTION NO. 2005-3; AND PROVIDING
FOR EFFECTIVE DATE.
WHEREAS, the Village provides for solid waste collection and recycling services to be
provided to residential customers within the Village; and
WHEREAS, pursuant to Village Code Section 2-61, the Village Council is authorized to
impose fees for the collection of solid waste and for the providing of recycling services (the "Fees");
and
WHEREAS, pursuant to Resolution No. 2005-3, as adopted by the Village Council on
February 8, 2005, the Village Council established the applicable annual Fee and has consistently
maintained the rate of the Fee since adoption; and
WHEREAS, the Village Council finds that it is now necessary to increase the Fees as
provided herein; and
WHEREAS, a public hearing was held on March 24, 2009 prior to the setting of the revised
Fees.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That each of the above stated recitals is hereby adopted
and confirmed.
Section 2. Revised Service Fee. That effective as of October 1, 2008, an annual Fee in
the amount of $ 495.00 per household is hereby set as the regular service charge for the collection
of solid waste and for the providing of recycling services to residential customers within the Village.
Section 3. Repeal. That Resolution 2005-3, which established the prior Fee schedule,
is hereby repealed, except that the Fees provided by Resolution 2005-3 shall continue to apply to all
unpaid Fees for services which were provided pursuant to Resolution 2005-3.
Section 4. Implementation. That the Village Manager is hereby authorized to take
any action which is necessary to implement and enforce this Resolution.
Section 5. Effective Date. That this resolution shall be effective immediately upon
adoption and shall be applied as provided herein.
