PROPOSED REVISION TO SB 3 (KELLEY) RELATED TO RCTC RESTRUCTURING WRCOG and CVAG representatives met on January 5, 1998 to discuss CVAG's concerns with SB 3 (Kelley). The Executive Directors of CVAG, RCTC and WRCOG were asked to draft proposed revisions that would be responsive to CVAG's concerns. The attached memo reflects the revisions developed by the Executive Directors, and is proposed for approval by the Legislative Committee. 4. ADJOURNMENT AGENDA ITEM #3 RIVERSIDE COUNTY TRANSPORTATION COMMISSION DATE: January 14, 1998 TO: Legislative Committee FROM: Jack Reagan, Executive Director SUBJECT: Proposed Revision to SB 3 (Kelley) Related to RCTC Restructuring I was invited, as a technical resource, to a January 5th meeting of WRCOG and CVAG representatives. WRCOG representatives had requested the meeting to hear CVAG concerns regarding SB 3 which led to CVAG's subsequent proposal to seek its designation as a separate transportation commission. After lengthy give and take discussion, CVAG representatives indicated that they would support SB 3 providing it is amended to codify equitable distribution of funds which would be administered by the expanded Riverside County Transportation Commission. Wes McDaniel, Interim Executive Director of WRCOG; Patricia (Corky) Larson, Executive Director of CVAG; and I were asked to draft proposed revisions to SB 3 which would be responsive to CVAG's concerns. Attached is the language which we developed. It is recognized that the language may be modified by RCTC Counsel and/or Legislative Counsel to make appropriate reference to California Government Code source citations. This language reflects the proposed content of possible amendments; the form may change somewhat. I believe the Committee should find this proposed revision to SB 3 acceptable. It reflects existing Commission policy and/or practice, including the proposed formula distribution of Regional Choice funds as approved by RCTC during its December 10, 1997 meeting. EXECUTIVE DIRECTOR'S RECOMMENDATION: That the Committee approve the attached proposed revision to SB 3 and request Senator Kelley to make author's amendments. Attachment PROPOSED AMENDMENTS TO SB 3 The Commission shall program funds allocated to it by the State in an equitable and proportionate manner. For this purpose, the county shall be considered to consist of three subareas: the Western County, the Coachella Valley, and the Palo Verde Valley. In executing this provision, the Commission shall use the following criteria for allocation of respective funds: (a) For Transportation Development Act funds, including Local Transportation Funds and State Transit Assistance Funds, allocations shall be based upon proportionate population; (b) For federal local assistance funds, allocations shall be based upon proportionate population, providing the respective areas are eligible for such funds; (c) For Regional Choice funds, allocations shall be based upon a formula weighting population 75% and center line highway miles 25%, but for purposes of the 1998 State Transportation Improvement Program the Riverside County Transportation Commission shall compute respective shares as if such formula existed retroactive to the 1988 State Transportation Improvement Program. The Riverside County Transportation Commission may approve allocations varying from the above referenced formula subject to the mutual agreement of agencies representing the affected subareas. Any subsequent revision to statewide funding which may make any of the above inconsistent shall result in revisions to the allocation to the respective three subareas to be consistent with such revision.
