Riley, Commissioner Date: February 9, 2022 Subject: Update on DESE Mask Requirement After consulting with medical experts and state health officials, the Commissioner will not renew the state mask requirement after it expires on February 28, 2022. Effective Monday, February 28, the DESE mask requirement will be lifted statewide. The Commonwealth's high vaccination rates and widespread availability of COVID-19 testing for school personnel and students support this decision. Masking continues to be required on all school buses, per federal order. DESE and DPH strongly recommend students and staff continue to follow the DESE-DPH Protocols for Responding to COVID-19 Scenarios. As always, any individual who wishes to continue to mask, including those who face higher risk from COVID-19, should be supported in that choice. DESE and DPH strongly recommend unvaccinated individuals should continue to wear masks in school settings. The Commissioner will continue to monitor public health data, consult with medical experts and state health officials, and issue further guidance and/or requirements as needed. More than 40 schools have already received approval from DESE to remove the mask requirement. With the removal of the statewide mask requirement, additional schools no longer need to apply. DESE continues to recommend that districts and schools adopt a layered approach to mitigate the spread of COVID-19 in school settings. DESE and DPH continue to strongly urge all eligible individuals to receive the COVID-19 vaccine and booster and continue to support schools with vaccination clinics. FINAL DRAFT BREWSTER BOARD OF HEALTH NITROGEN LOADING REGULATION FEBRUARY 7, 2022 Authority: In accordance with Massachusetts General Laws, Chapter 111, Sections 31 and 127A, the Brewster Board of Health hereby adopts the following regulation to specify the process for developing nitrogen loading calculations far use by the Board and for compliance with other Town zoning articles and regulations including the Water Quality Protection District Bylaw, (Chapter 179 Sections 53-62). II. Purpose: To protect public health through the protection of water resources in the Town of Brewster, including, but not limited to public drinking water supplies, coastal estuaries and freshwater ponds, the Board of Health has adopted this regulation to create a standardized method to estimate the nitrogen loading impacts to water quality from new, altered, or expanded land uses. The regulation specifies how nitrogen loading analyses are to be conducted for the Board and for use under other town zoning articles and associated regulations, including the Water Quality Protection District Bylaw. This regulation includes requirements for the specific nitrogen loading factors used in the nitrogen loading calculations and specific spreadsheets that must be used to document the results of an analysis. III Review of Nitrogen Loading Projections. A. For any project required to meet the performance standards in the Town's Water Quality Protection Bylaw (the Bylaw), or any other applicable law, the following procedures shall be used to determine whether the project will meet the maximum 5 ppm nitrogen loading standard. B. The project applicant shall request review of the project nitrogen loading calculations on a form provided by the Board of Health. C. The review will commence upon receipt of a completed application, including payment of any applicable fee. IV. Required Inputs for Nitrogen Loading Calculations: A. Table 1 attached to this regulation contains the nitrogen loading input parameters that must be used for any such project. These input values are based on standard inputs used by the Cape Cod Commission (Cape Cod Commission Technical Nitrogen Loading Technical Bulletin 91-001, April 1992) with some additional requirements specified by the Board of Health. Any changes to these input values must be approved by the Health Agent or their designee. The Health Agent or the applicant can refer a proposed change to the Board for its review and approval. B, If a use is proposed far a property for which a nitrogen loading value is not provided in Table 1, the applicant must request approval far an appropriate nitrogen loading rate and/or -1- N:�Health\BQH regs\Nitrogen Loading Regulation 2022\Final Documents\1101-1 Nitrogen Loading Regulation FINAL02.07.22.docx recharge rate from the Health Agent or their designee. The Health Agent or their designee can refer the request for approval to the Board of Health. V. Site Plan: A. A site plan must be provided with the calculations to document the information used in the nitrogen loading analysis, This includes: - the existing or proposed lot area - the areas of driveways - impervious patios and roof areas - and undisturbed natural areas - existing and proposed lawn areas Lawn Area Definition: The lawn area used in the calculations should reflect the fawn area shown on the site plan. A lawn is defined as a ground covered with grass or other vegetation that is mowed more than twice per year. A minimum lawn area of 1,000 square foot must be included for all projects subject to the Bylaw. B. Septic System: The site plan also needs to document the location and size of the existing or proposed septic system serving the property. If an innovative alternative septic system is proposed to reduce the concentration of nitrogen in septic system effluent, the applicant must provide documentation that the system has been approved for pilot, provisional or general use by the Massachusetts Department of Environmental Protection (DEP) as required by Title 5 (310 CMR 15.00). This documentation must include the nitrogen concentration in the treated effluent approved by DEP. If an applicant has reason to request a nitrogen concentration in treated effluent from an alternative treatment system that is different from that approved by DEP, they need to receive approval for the proposed concentration from the Health Agent or their designee. V4. Wastewater Flow: A. Consistent with the procedures used by the Cape Cod Commission, the wastewater flow used to calculate the nitrogen 'input from onsite septic systems on residential properties will be based on an average of: The Title 5 design flow for the system based on the number of bedrooms in the house (310 CMR 75:203) and The average flow based on the occupancy rate provided in the most recent U.S Census data for Brewster. B. According to the 2020 Census, the average occupancy rate for Brewster is 2.3 people per house. Therefore, until adjusted based on future, updated census data, using a septic system flow rate of 55 gallons per day per person, a total of 126.5 gallons per day must be used to calculate the average occupancy nitrogen load. Together, the Title 5 design flow volume and the average occupancy volume will be averaged to calculate the wastewater flow. -2- N:\Health\BOH regs\Nitrogen Loading Regulation 2022\Final Documents\BOH Nitrogen Loading Regulation FINAL02.07.22.docx C. This calculation shall be used solely for purposes of determining the average Nitrogen Load for the property and shall not affect the design flow of the system as required by Title 5 and/or applicable regulations of the Board of Health. VII. Use of Brewster Board of Health Spreadsheet for Nitrogen Loading Calculations: Nitrogen loading calculations developed for use under this regulation must be developed and documented on one of the nitrogen loading calculation spreadsheets attached to this regulation and available electronically from the Health Department. The applicant should use one spreadsheet based on the type of project they propose: either a residential, commercial/industrial, or mixed-use project. The mixed-use spreadsheet should only be used for a project that combines a commercial/industrial use with a residential use on the same property. The use of the required spreadsheet ensures calculations are be done in a consistent manner that can be reviewed and approved by the Board or its designee. The outcome of the calculation is a prediction of the average nitrogen concentration entering groundwater from a property which can be used to confirm it will meet the performance standards for water quality protection established by the Board of Health or included in other Town zoning articles or regulations, including the Water Quality Protection District Bylaw. VIII. Confirmation of Nitrogen Load: A. Upon receipt of a completed Nitrogen Loading pian, the Health Agent shall review the plan for completeness and confirm the accuracy of the calculation. Any plan that is incomplete or that is not in full compliance with this regulation will be rejected. B. The Health Agent will either confirm or deny the Nitrogen Loading projection submitted by Che applicant. If the projection is denied, the Health Agent shall state the reasons for denial and the applicant will have an opportunity to resubmit the plan. C. The Health Agent or the applicant may refer the plan to the Board of Health for its review of the Health Agent's determination. D. Approval of the plan shall not constitute an approval of the project or any component thereof. IX. Variances: Variances from this regulation, if referred by the Health Agent or requested by the applicant, may be granted by the Board of Health after a hearing at which the applicant establishes the following: A. The enforcement thereof would do manifest injustice; B. Submittal of documentation and up-to-date data that supports the requested variance; C. The person requesting a variance has established that a level of environmental protection that is at least equivalent to that provided under this regulation can be achieved without strict application of the provision of regulation from which a variance is sought. X. Instructions This rworkboo k contains three sheets, each calculating an estimate of nitrogen loading far different types of properties in Brewster. Navigate to the sheet ("Residential", or "Commercial I Industrial", or "Mixed Use") which best describes your property and complete the highlighted cells to calculate. The calculation includes two sections - Section 1 calculates the nitrogen loading from runoff on the property and Section 2 calculates the nitrogen loading from wastewater. Nitrogen from bath runoff and wastewater are combined to calculate the total average nitrogren load from any property. To complete section 1 (Runoff), input the areas (in square feet) of the property and of the various ground covers (roof, impervious material, iarwn) on the property. To complete section 2 (Wastewater), first indicate if you have an innovative/advanced septic system by completing that field with either "Yes" or "N❑". Assistant Director Tammi Mason Senior Department Assistant On January 19, 2022, the Board of Health will be meeting to discuss and vote on a new nitrogen loading regulation designed to provide and clarify the procedures for developing nitrogen loading calculations. This regulation will apply to all regulations in Brewster that use these calculations. The purpose of this regulation and a summary of nitrogen loading calculation process is described below. Purpose for the Regulation This regulation was developed to clarify the process that applicants must use to calculate the nitrogen load from their property when it is required by the Board of Health or by another Town Board. The Water Quality Protection District Bylaw (Article 197) is one ordinance that requires these calculations and Other bylaws, or regulations may be adopted in the future. The Water Quality Protection Bylaw was updated at the November 15, 2021 Town Meeting, primarily to update the stormwater requirements in this bylaw to be compatible with the Stormwater Bylaw also passed at that Town Meeting. The updates to the Water Quality Protection Bylaw included provisions that the nitrogen loading calculations required under that ordinance must follow the procedures developed in a new Board of Health regulation. This proposed regulation provides those procedures. How the Regulation Works The regulation provides specific details on the inputs that must be used for nitrogen loading calculations. Loading rates that must be used for all the main sources of nitrogen from a residential or commercial property are provided, including wastewater, lawn fertilizers, road and roof runoff, and inputs from natural lands. The specific loading values are provided in Table 1 of the regulation and can only be altered with prior approval of the Health Agent or their designee. The regulation also requires the use of a specific spreadsheet to develop the calculations, so the same process is used for each project reviewed by the Board of Health or other Town Board. Separate spreadsheets have been created for residential land uses and for commercial/industrial uses. In addition, a mixed-use development spreadsheet was created for properties where there is a combination of commercial and residential uses. Each of these spreadsheets includes the opportunity to add an additional source of nitrogen under an "other" category. This is provided for nitrogen loads associated with a parcel that are not one of the main nitrogen inputs on the spreadsheet. If an applicant needs to incorporate an additional source of nitrogen in this "other" category, approval from the Health Agent or their designee on the specific loading rate and/or recharge rate is required. Authority: In accordance with Massachusetts General Laws, Chapter 111, Sections 31 and 127A, the Brewster Board of Health hereby adopts the following regulation to specify the process for developing nitrogen loading calculations for use by the Board and for compliance with other Town zoning articles and regulations including the Water Quality Protection District Bylaw, (Chapter 179 Sections 53-62). ;4 Purpose: To protect public health through the protection of water resources in the Town of Brewster, including, but not limited to public drinking water supplies, coastal estuaries and freshwater ponds, the Board of Health has adopted this regulation to create a standardized meth ad to estimate the nitrogen loading impacts to water quality from new, altered, or expanded land uses. The regulation specifies how nitrogen loading analyses are to be conducted for the Board and for use under other town zoning articles and associated regulations, including the Water Quality Protection District Bylaw. This regulation includes requirements for the specific nitrogen loading factors used in the nitrogen loading calculations and specific spreadsheets that must be used to document the results of an analysis. III Review of Nitrogen Loading Proiections. A. For any project required to meet the performance standards in the Town's Water Quality Protection Bylaw (the Bylaw), or any other applicable law, the following procedures shall be used to determine whether the project will meet the maximum 5 ppm nitrogen loading standard. B. IV. Required Inputs for Nitrogen Loading Calculations. A. Table 1 attached to this regulation contains the nitrogen loading input parameters that must be used for any such project.-;}rn„on iaadino Ea1c„1,+;.,n co ndYroted , n d e F the re u1ati0R These input values are based on standard inputs used by the Cape Cod Commission (Cape Cod Commission Technical Nitrogen Loading Technical Bulletin 91-001, April 1992) with some additional requirements specified by the Board of Health. Any changes to these input values must be approved by the Health Agent or their designee. The Health Agent or the applicant can refer a proposed change to the Board for its review and approval. B. If a use is proposed for a property for which a nitrogen loading value is not provided in Table 1, the applicant must request approval for an appropriate nitrogen loading rate and/or recharge rate from the Health Agent or their designee. The Health Agent or their designee can refer the request for approval to the Board of Health. Version 02.07.22 "V. Site Plan; A. A site plan must be provided with the calculations to document the information used in the nitrogen loading analysis. This includes: - the existing or proposed lot area - the areas of driveways impervious patios and roof areas - and undisturbed natural areas - existing and proposed lawn areas Lawn Area Definition: The lawn area used in the calculations should reflect the lawn area shown on the site plan. A lawn is defined as a ground covered with grass or other vegetation that is mowed more than twice per year. A minimum lawn area of 1,000 square foot must be included +r -for all projects subject to the Bylaw. If an innovative alternative septic system is proposed to reduce the concentration of nitrogen in septic system effluent, the applicant must provide documentation that the system has been approved for pilot, provisional or general use by the Massachusetts Department of Environmental Protection (DEP) as required by Title 5 (3 10 CMR 15.00). This documentation must include the nitrogen concentration in the treated effluent approved by DEP. If an applicant has reason to request a nitrogen concentration in treated effluent from an alternative treatment system that is different from that approved by DEP, they need to receive approval for the proposed concentration from the Health Agent or their designee. 4V4 Vl Wastewater Flow; A. Consistent with the procedures used by the Cape Cod Commission, the wastewater flow used to calculate the nitrogen input from onsite septic systems on residential properties will be based on an average of: The Title 5 design flow for the system based on the number of bedrooms in the house (310 CMR 15:203) and The average flow based on the occupancy rate provided in the most recent U.S Census data for Brewster. B. According to the 2020 Census, the average occupancy rate for Brewster is 2.3 people per house. Therefore, until adjusted based on future, updated census data, using a septic system flow rate of 55 gallons per day per person, a total of 125.5 gallons per day must be used to calculate the average occupancy nitrogen load. Together, the Title 5 design flow volume and the average occupancy volume will be averaged to calculate the wastewater flow. &.C.This calculation shall be used sole!y for purposes of determining the averse Nitrogen Load for the property and shall not affect the design flow of the system as required by Title 5 and/or applicable regulations of the Board of Health. Version 02.07.22 V VII Use of Brewster Board of Health Spreadsheet for Nitrogen Loading Calculations: Nitrogen loading calculations developed for use under this regulation must be developed and documented on one of the nitrogen loading calculation spreadsheets attached to this regulation and available electronically from the Health Department. The applicant should use one spreadsheet based on the type of project they propose: either a residential, com mercial/industria 1, a mixed-use project. The mixed-use spreadsheet should only be used for a project that combines a commercial industrial use with a residential use on the same property. The use of the required spreadsheet ensures calculations are be done in a consistent manner that can be reviewed and approved by the Board or its Hea Ith Agent 0 F their designee. The outcome of the calculation is a prediction of the average nitrogen concentration entering groundwater from a property which can be used to confirm it will meet the performance standards for water quality protection established by the Board of Health or included in other Town zoning articles or regulations, including the Water Quality Protection District Bylaw. %q, VIII Confirmation of Nitrogen Load A. The Board is comprised of five elected members who serve three- year terms. Meetings of the Board of Health are open to the public and are held on the first and third Wednesday evenings of each month. These meetings have been held by remote participation or as hybrid in-person and remote, based on local pandemic conditions. On two joint occasions with the Select Board, the Board of Health implemented mandatory indoor mask requirements for all municipal buildings (excluding Freeman's Grill). On another occasion, the Board supported the School Committee's decision to temporarily convert to remote learning (a few weeks before the normal spring break) because of the high COVID case rates existing at that time. The Board also_ voted to require the use of face masks at the November Special Town Meeting. After holdinga final public. hearing, the Board of Health adopted a new regulation designed to protect .people under the age of 21 years, and Which aligns with the Massachusetts regulation designed to do the same. This regulation extended the previous ban on flavored vape products to include a ban on flavored cigarettes, cigars, chew tobacco, spit tobacco, bidis and loose tobacco. With expert assistance from Mark Nelson; Horsley & Witten, the Board drafted a new regulation, held a public hearing, and submitted the draft to Town Counsel for review. This draft regulation was a necessary response to a vote at the 2021 Town Meeting, and provides a transparent and consistent method for calculating nitrogen loading in Brewster. Hopefully, it will be adopted in early 2022. The Board approved waiving a $770 septic system permit fee which allowed this amount of the MassWorks Grant funds to be spent on Phase 1 Affordable Housing infrastructure work, and aligned with the Select Board's Fee Waiver Policy. Covid update Mrs. van Hone stated that the most recent data shows that we are in another surge. Last week we had 17 new cases and it is around the same for this week. It is widespread throughout the community and there is considerably more activity in middle and high school. She stated that she is not seeing as much transmission through the schools, it is mostly positive parents who then spread it to the family. We will probably continue to see an increase in numbers throughout the holiday season. Boosters are important. Pfizer boosters for ages 5-12 were just approved. BOH 11/17/21 Minutes Page 2 The Barnstable County Department of Health & Environment has been holding vaccination clinics every Thursday at their building which is off Route 6A at the courthouse complex in the Harbor View room from 10:OOAM — 2:00PM. You can register online at the Barnstable County website or walk in, All 3 vaccinations are available. Most larger pharmacies are also offering the vaccine Vaccination rates are still the same as it has been the last few months. People should still be vigilant, wear a mask and get vaccinated if possible. Dr. Pearson stated that we are not seeing a major spike in hospitalizations according to the data that she has read. Mrs, von Hone stated that this was correct, and it is one of the positives of the vaccines. Dr. Pearson stated that it doesn't seem like we are closing the gap between those who have gotten a single dose and those that are fully vaccinated in the 2 upper age groups and asked if these numbers are corrected for mortality. Mrs, von Hone did not have an answer for that. Dr. Pearson asked if there was a program in place in the nursing homes to administer boosters. Mrs. von Hone stated that major pharmacies are still offering those services and the VNA has been involved in giving the boosters at some of the nursing homes and for employees who need 1" and 2"d shots. As for the long-term care facilities, routine testing is still being done and that's how the positive cases are being identified. 5. Continued discussion on potential partnerships/liaisons with community groups Ms. Holeman stated that this was put on the agenda because of a discussion that came from Mrs. Graczewski, who is not in attendance tonight so she would like to put this off until she is here. 6. Discussion on continued inclusion of informational items Mrs, von Hone stated that she brought this up to the Board to see if they still wanted to continue receiving the amount of information they receive in their packets, specifically the monthly reports on the SWWTF's and IIA systems Dr. Pearson stated that she wasn't sure what her role was with regards to these reports. Mrs, von Hone stated that there is not much the Board can really do as these are permitted by DEP. The SWWTF engineers come before the Board every February and give an annual report. Dr. Pearson believes that the IIA reports that come in are valuable. She spoke about attending the Poison Control meeting once a month and asked if anyone would be interested in hearing about it or receiving information under this section of the meeting. Ms. Holeman stated that we should keep the IIA reports on agenda until we have the presentation about how to understand the reports and then maybe reassess, Mrs. van Hone stated that anything a Board member may want to put in "informational items" can email her, and she will include it on the agenda. 7. Johari Window (Penny Holeman) Ms. Holeman stated that using this helps a person to understand issues and explained to the Board what it meant. Covid update Mrs. von Hone stated that the Town is still in a pre -holiday surge that started before Thanksgiving. There was a drop in total positive cases this week. She is still tallying up numbers but expects them to go up. Since the beginning of the pandemic, the Town has had just under 800 total residents test positive. The number of school age children getting positive results is increasing but it is mostly being contracted outside the school setting. Winter sports season is upon us, and the schools are trying to come up with protocols. Vaccination rates are up in the younger kids. Barnstable County Department of Health & Environment is still holding their vaccination clinics every Thursday from 1O:OAM — 2:OOPM at the County complex in the Harbor View roam. Residents can register online at the County website or walk into the clinic. All 3 vaccines are available. The County Health Department is going to be helping the Town with a booster clinic for employees next week and they are also continuing to vaccinate homebound residents. BOH 12/1/21 Minutes Page 2 Dr. Peterson stated that the latest MMWR Report came out today and the U.S. has had its first Omnicom case (in California). She also noted that the ICU bed occupancy at CCH is at 68% capacity, with 1 1n 3 of those admitted being vaccinated. Ms. Holeman spoke about the gap with residents who have gotten their 1St dose but not the 2nd dose. After the last BOH meeting, she spoke with Mrs. von Hone about it and talked about how the Town can help the seniors get their appointments for their 2"d dose, She also stated that she attended the Board meeting at the COA and talked about this with them. They could possible reach out to those seniors to get them help with the vaccine. Denis Rego, COA Director was unable to attend that meeting so they will wait until she gets back to see how they can help. 5. Presentation of the draft BOH Nitrogen Loading Regulations — Mark Nelson, Horsley & Witten Mr. Nelson has prepared a draft BOH regulation. He noted that the Bylaw that was approved at the November Town Meeting still must be approved by the Attorney General before this Board can approve the proposed regulation. Mr. Nelson shared a slide show about the purpose of the proposed regulation, the draft regulation overview and the nitrogen loading calculation process. Right now, if a property is within the Drinking Water Protection Area or the Pleasant Bay Watershed, there is a nitrogen loading standard in the bylaw that must be met. Residents would have to show that all the sources of nitrogen on the property don't exceed a 5 mg per liter concentration in groundwater averaged out on the property. The regulation had some calculation input parameters and a process to do that, but over time the staff has learned that everyone that's applying those standards in the bylaw had done it a little differently. There are benefits to streamlining this process and setting up a data base so that everyone is doing the calculations the same way. This is why it should be a BOH regulations. The regulation would apply to any nitrogen loading calculations that's done for other purposed in the Town. The nitrogen inputs would be based primarily on the Cape Cod Commissions Nitrogen Loading Technical Bulletin and would require use of specific nitrogen loading inputs for wastewater, lawn fertilizer and stormwater runoff. Mr. Nelson showed the Board a table summary which shows nitrogen loading input and recharge rate for roofs, driveways, impervious areas, and lawns. The minimum lawn size of 1,000sf is to be used with these calculations. Lawn area is defined as ground covered with grass or other vegetation that is mowed at least twice a year. He showed the Summary an Wastewater Residential Use and Non -Residential Use. He stated that he had spoken with Mrs. von Hone about what other loading sources should be included in the calculations. He shared the Nitrogen Loading Calculations spreadsheet and explained how it would work. Dr. Pearson questioned the defacto credit for I/A systems and asked if there were other ways for credit. Mr. Nelson stated that wastewater is going to be the biggest source and they need to look at long term issues when thinking about this. Mr. Nelson stated that revisions to the data base need to be done and he would work on those in hopes of getting this back to the Board for the January 5, 2022, meeting. 6. Discuss and ratification of Emergency Condemnation Order -- 23 Woodview Drive Mrs. von Hone gave the Board some history on this. On 11/22 the Fire Department and Police Department responded to a call at the unit and a report & pictures of the situation in the house was given to the Health Department. It is a serious hoarding issue. Based on the condition of the home and in consultation with Town Council, an emergency condemnation order was issued. Elder Services is the lead agency on this case, but the Town is working closely with them BOH 1211121 Minutes Page 3 Dr. Pearson asked about when the unit is entered again to check the status, if there is a list, they work with to uncondemn it. Mrs. von Hone stated that its mostly items from the Housing Code that would be checked. The Health Department has not actually entered the unit. (CEC) has been retained by the Town of Brewster, for the property located at 3057 Main Street Brewster, MA, to prepare the 2021 annual report of the property relative to the Groundwater Discharge Permit Dumber 977-0 in accordance with 314 CMR 5.00. The property comprises approximately 54.9 acres of land located in Brewster, MA north of Main Street, also known as Route 6A, opposite Millstone Road (see the Locus Map, Figure 1A) and is bordered on the north by Cape Cod Bay. The area is predominately residential. The accompanying site sketch plan, SKC-1, shows the location of the property and the immediate surrounding area. Cape Cod Sea Camps is a seasonal summer camp for children. However, the camp did not operate this past summer due to COVID-19 pandemic, The Town of Brewster purchased the property on November 23'd, 2021„ During 2021, there was minimal activity at the camp and the water usage reflects the lack of campers and day campers at the site. The water usage was higher this year than last year when the camp also was not open, leading the Facilities Manager to suspect there is a water leak. The summer camp was established in 1938. Currently, there are 92 buildings Onsite, including residential cabins, kitchen and dining halls, function and meeting halls, recreational buildings, shower rooms and bathroom facilities, staff housing, administrative offices, and storage sheds. There are 29 Title 5 septic systems servicing various buildings to collect sanitary waste and discharge wastewater to the ground through subsurface leaching structures and a laundromat with a single pass sand filter, Some of the Title 5 systems serve several buildings, while some buildings do not have water fixtures and, therefore, do not generate wastewater and so are not connected to a septic system. The enclosed plan shows the location of each building and the location of the Title 5 septic systems serving these buildings, Presently the town does not have an action plan for the property so no septic systems were inspected. Due to the Covid-19 related State of Emergency that was in effect from March 10, 2020 until June 15, 2021, the groundwater discharge permit is valid until September 5, 2024 and will be due for renewal in March 2024. Typically, the camp is open from April 28th through October 20th for a total of 147 days. The facility's permitted water usage is 2,965,929 gallons per year. The facility's water actual usage for 2021 was 357,000 gallons, Water for the playing field irrigation system is provided by an onsite well. Using a 35 nng/L Cope Cod Seo Camps January, 2022 concentration for total nitrogen in sewage effluent, we calculated that 107 pounds of nitrogen were discharged in 2021, 759 pounds below the permitted limit of 866 pounds. The onsite laundromat which was not operated in 2021 has a single pass sand filter for treatment of laundry waste. The quarterly mnnitoring sample reports show that surfactants were non-detectable in all wells. Annual VOC testing performed in August showed that V❑C's were not detected in the wells, There will be quarterly sampling of the monitor wells starting in February 2021 and the annual report for 2022 will be completed in January 2023. This article ignored another crucial benefit: reducing nitrogen (in the form of nitrate) from groundwater to protect human health. Current research indicates that we need to focus on human health as much as the health of our ponds and estuaries. Technologies like NitROE will be critical in reducing the threat posed by nitrates and other contaminants. While nitrate in groundwater is a known human health hazard, it is likely to be significantly more hazardous than current environmental regulations would lead us to believe, The current federal Environmental Protection Agency standard (i.e., limit) for nitrate is 10 mg/L, based on the possibility of it ca us i ng 'b I ue-ba by syndrome.' This standard was established based on research from the early 1960s, with the understanding that infants are the primary potential victims of nitrate contamination. Since then, and especially in recent years, there has been substantial research indicating that nitrates at lower concentrations can cause cancer and other ailments in all humans. For example, the Environmental Working Group recently noted that the nitrate limit of 10 mg/L should be lowered to protect against cancer. The courts have begun to recognize the threat posed by nitrates on health, too. Mountaire, among the nation's largest poultry companies, recently settled with p la 1 ntiffsfo r $65 million far contaminating an aqui€er in Delaware with nitrates. Clearly, the threat of nitrates to humans extends well beyond 'blue -baby syndrome.' Here on Cape Cod, our local leaders ignore the threat posed by nitrates to human health at concentrations below 10 mg/L. The debate is real. And for areas of the Cape where centralized sewers are not feasible, we need to get ahead of the nitrate problem that we face. We cannot afford to wait. Systems like NitROE should be required wherever sewers are not feasible, and not just in areas that directly impact ponds and tidal inlets. Kevin Kuechier lives in Truro.
