The following described portion of Third Street and Alley located in the City of Iona, Idaho, are not used or needed for public purposes: 3rd Street between Blocks 1 and 2, the West 280.85 feet of the alley in Block 1 and the East 396.00 feet of the alley in Block 2, all in Denning Addition to the Village of Iona, Bonneville County, Idaho. Section 2. The above -described portion of Third Street and Alley are hereby vacated in favor of the adjoining land owners with one-half to revert to the adjoining owners on each side of such street and alley. Section 3. This ordinance shall be in full force and effect from and after its passage, signature and publication in the manner provided by law. ATTEST: CA; Iona Ci 9352h 4-6-0T Mayor, City of Iona, Idaho EXHIBIT "A" PETITION TO VACATE STREET AND ALLEY WITHIN THE BOUNDARIES OF THE CITY OF IONA COMES NOW the Petitioner, Joint School District No. 93, and hereby petitions that the City of Iona vacate for the benefit of the adjoining landowners the street and alley described as follows: 3rd Street between Blocks 1 and 2, the West 280.85 feet of the alley in Block 1 and the East 396.00 feet of the alley in Block 2, all in Denning Addition to the Village of Iona, Bonneville County, Idaho. This petition is made on the grounds that such street and alley have never been improved or used by the public and petitioner anticipates using such vacated alley and street for an elementary school site and adjoining playground. That such usage shall be for the general benefit of the citizens of the City of Iona and the patrons of Petitioner. That the parties affected by this petition are the adjoining landowners to such street and alley who are the petitioner, Joint School District No. 93 and Martha Ann Scorsby Griffin, David Owen Scorsby, James Elbert Scorsby, Jesse Gaye Scorsby Brinkman, Alvin Lynn Scorsby and Juneve Scorsby Anderson. Petitioner requests that the City of Iona follow all appropriate procedures for the vacation of such street and alley and adopt and approve this petition by adopting an ordinance in the form of Exhibit "A" attached hereto. If the ordinance is passed, the City will need to execute a Quitclaim Deed in favor of the School District so that ownership of the property can be placed as a matter of record.
