RESOLUTION NO. 11-2022
A RESOLUTION AUTHORIZING THE GRANT OF
A PERMANENT EASEMENT AND TWO TEMPORARY EASEMENT AREAS
WHEREAS, The Board of Public Works and Safety (hereinafter "Board") is the disposing agent
for property owned and to be acquired or transferred by the City of Richmond,
Indiana (hereinafter"City"), pursuant to the provisions of Indiana Code (IC) 36-1-11,
et seq. and IC 5-22-22, et seq., and the Board has custody, maintenance, and
improvement powers of public ways in accordance with IC 36-9-6, et seq.; and
WHEREAS, The Indiana Gas Company, Inc. is an Indiana corporation doing business as
CenterPoint Energy Indiana North (hereinafter "CenterPoint") and is a domestic for-
profit company which provides natural gas utility services for the citizens of the City
of Richmond, Indiana; and
WHEREAS, In response to the Indiana Department of Transportation's (hereinafter "INDOT")
U.S. 27 bridge replacement project being conducted over Fort Wayne Avenue,
CenterPoint is being required to relocate the existing gas pipeline which is in conflict
with the INDOT project.
WHEREAS, The City is the owner of a right-of-way parcel which has the common address of 600
North 10th Street ("hereinafter "property" or "parcel"), which is adjacent to a portion
of Fort Wayne Avenue and is adjacent to an Indiana state right-of-way area that
supports the U.S. 27 bridge; and
WHEREAS, CenterPoint is seeking one permanent easement consisting of approximately 0.097
acres and is seeking two temporary easements consisting of 0.207 acres (for
Temporary Easement No. 1) and 0.048 acres (for Temporary Easement No. 2)for the
property to enable the removal of one tree and two (2) bushes and to ultimately allow
the installation of a bore rig under the east side of U.S. 27 to enable location or
relocation of the gas pipeline tie-in to an existing 12" gas line under the pavement of
Fort Wayne Street within the permanent easement area in accordance with the
attached Exhibit A; and
WHEREAS, The City wishes to grant CenterPoint the permanent easement for the purposes
outlined in Exhibit A and to grant the temporary easements which will revert back to
the City upon completion of the pipeline tie-in project.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of Richmond,
Indiana,that said Board hereby approves of the grants of the easement areas as the same are outlined
or contained in the documentation prepared by the Indiana Gas Company, Inc. an Indiana corporation

doing business as CenterPoint Energy Indiana North, an Indiana Domestic For-Profit Corporation as
designated in Exhibit A to this Resolution.
NOW, THEREFORE, BE IT ALSO RESOLVED by the Board of Public Works and Safety that
David M. Snow as the Mayor of the City of Richmond, Indiana, shall be authorized to execute the
Pipeline Easement document as previously examined by the Richmond Law Depai tucent and the
Richmond Engineering Division, and the Mayor shall also be authorized to execute any additional
easement payment schedules or other documents as necessary in connection with the proposed
pipeline easement.

Dear Mayor Snow,
CenterPoint Energy is undertaking a project to relocate an existing 12"steel natural gas
line in Richmond, IN. This project is in response to INDOT's US 27 bridge replacement over
Fort Wayne Ave. INDOT is requiring CenterPoint to relocate the existing gas line that is in
conflict with the bridge replacement.
CenterPoint would like to purchase a .097 AC permanent gas easement from the City of
Richmond as outlined on the included exhibits as well as a.255 AC temporary easement(on the
north&south side of the proposed permanent easement). Permanent easement is continuous and
will run with the title of the land. Temporary easement is required for working room during
construction and will revert to the City upon completion of the project.
CenterPoint plans to set up a bore rig on the east side of US 27 and bore under the
roadway approximately in line with the power poles. They are asking the City to allow removal
of one tree and two bushes. The tree requires removal so CenterPoint can tie-in to the existing
12"gas line under the pavement of Fort Wayne Street and the two bushes are to be removed to
get bore equipment in place. I have included for your review the following documents:

PIPELINE EASEMENT
THIS INDENTURE WITNESSETH, THAT THE City of Richmond of Wayne County, hereinafter
collectively and individually called "Grantor", for and in consideration of the sum of One Dollar ($1.00), and
other valuable consideration, the receipt of which is hereby acknowledged, hereby GRANTS and
CONVEYS to Indiana Gas Company, Inc., an Indiana corporation doing business as CenterPoint.Energy
Indiana North, its successors, assigns and lessees, hereinafter collectively referred to as "Grantee", an
easement with the right, from time to time, to install, construct, inspect, maintain, operate, repair, alter,
relocate, enlarge, rebuild and remove pipelines, including but not limited to, drips, valves, anodes, pits,
pipeline markers, cathodic equipment, test leads, meters, protective facilities, and all other appurtenances
thereto, whether above or below the surface, convenient or necessary for the transportation and distribution
of gas or other substances which can be transported through pipelines (the "Facilities"), in, under, over,
across, upon, and through the land of Grantor situated in
Wayne Township, Wayne County, Indiana and being part of the Northeast and Southeast
Quarters of Section 32, Township 14 N, Range 1 W, and being a parcel conveyed to
Grantor in Deed Record 107, Page 467, in the Wayne County Recorder's Office, Richmond,
Indiana.

Said easement granted herein shall be an irregular tract of land as described In Exhibit "A"
and shown on the attached drawing, made a part hereof, and marked Exhibit"B".
In addition to said easement, the Grantor also hereby grants to Grantee a temporary
easement for initial construction purposes upon, over and across an additional tract of land
shown on Exhibit"B" attached hereto. The temporary easement includes the right to trim,cut
down, remove or otherwise control any trees, bushes, branches, roots, undergrowth,
overhanging branches or other obstructions in the temporary easement.
The Grantee will have the right to ingress and egress over the land of Grantor to and from said
easement in the exercise of the rights herein granted, together with reasonable working space for the
purposes of constructing, installing, operating, maintaining, replacing, inspecting, and removing said

Facilities. In the exercise of such rights the Grantee will, whenever practicable to do so, use existing
highways, roadways or other access routes.
The Permanent Easement is made subject to the following terms and conditions:
1) Improvements: Grantor shall not erect or maintain any buildings, structures, property, or any
other type of improvement or obstruction, either of a permanent or temporary nature, above or
below ground within the easement without Grantee's prior written consent. Grantee shall not be
responsible to Grantor for damages to or removal of buildings, structures, property, or any other
type of improvements or obstructions encroaching into the easement.
2) Changes in grade or excavation: No excavating or grading shall be done within the easement
which would either (A) reduce the coverage of soil over said pipelines or (B) increase the
coverage more than two (2)feet without the prior written consent of Grantee which consent will
not be unreasonably withheld, (C) impair the Grantee's ability to maintain the facilities or (D)
create a hazard. The "811" Utility Protection Service and Grantee must be called at least 48
hours before anyone excavates in the easement.
3) Trees, Bushes, Branches, and Roots: Grantor further grants to Grantee the right to trim, cut
down, remove or otherwise control any trees, bushes, branches, roots, overhanging branches,
and vegetation growing upon said easement which according to Grantee's standards or in the
sole discretion of Grantee may now or at any time interfere with the construction, use,
maintenance, surveillance, access or efficient, safe and proper operation of its Facilities. Grantee
shall not be responsible to Grantor for damages to, or removal of, trees or other plant life, with
the exception of growing non-timber crops, in the easement.
4) Depth and Location: Grantee's gas pipelines shall be installed at an initial depth of at least 36
inches below the surface of the ground. The Facilities are to be located in the easement.
5) Fences: Grantor further reserves the right to construct and maintain agricultural "farm field type"
fence(s) crossing (but not parallel and within) said easement; provided, however, that said
fence(s) will be constructed or maintained so as to not interfere with, limit access or endanger
the Facilities of Grantee, nor will any fence post be located within five (5) feet of the pipelines
constructed within said easement. Residential fence(s) may be allowed in the easement,
provided Grantee's prior written consent for such fence(s) is obtained, which consent may in the
sole discretion of Grantee be granted or denied.

In addition, both the Temporary Easement and Permanent Easement are made subject to the following
terms and conditions:
1) Reimbursement and Restoration: Grantee shall reimburse Grantor for any damage or loss to
growing crops, soil, tile, gates and fences that may be caused by Grantee or its contractors while
accessing or working in the easement. Any such damages shall be promptly paid or otherwise
restored as nearly as can be to its original condition by Grantee, provided written notice thereof
is given to Grantee at its Evansville office located at CenterPoint Energy Plaza, 211 NW
Riverside Dr„ Evansville, Indiana 47708, or such place as Grantee may designate, within ninety
(90) days after the occurrence of such damage.
2) Grantor's Rights: Subject to the rights herein granted to Grantee, Grantor reserves the right to
use and enjoy the land included within said easement for purposes which are not inconsistent
with the safe operation of Grantee's Facilities (including Grantee's access thereto) and which will
not interfere with the rights and privileges granted to Grantee by the easement.
3) Indemnification: Grantee agrees to indemnify and hold harmless Grantor from and
against any and all damages, claims, costs and expenses suffered, sustained or incurred
solely during and as a result of Grantee's construction, installation and repair activity in
the easement strip.
Grantor covenants that Grantor is the true and lawful owner of the property herein described and has full
power and authority to grant this easement.The undersigned person(s)executing this instrument on behalf of the
Grantor represent and certify that they are duly elected officers of the Grantor and have been fully empowered to
execute and deliver this instrument and that all necessary corporate action for the granting of such easement has
been taken and done.
