1.0 INTRODUCTION AND BACKGROUND
The Town of Brewster is proposing the Long Pond Town Beach Boat Ramp and Parking
Improvements on Crowells Bog Road in Brewster, Massachusetts. The existing boat ramp
provides formal public access to this freshwater resource, and the facility is one of the most
active of the town public landings in Brewster. However, the current boat ramp at Long Pond is in
poor condition. The bituminous pavement is crumbling, and large sections of pavement are
missing, and there is a sharp drop-off at the end of the ramp due to erosion and boat prop wash.
This condition is further exacerbated during the active boating season, resulting in damage to
vehicles, trailers, and boats as well as the pond resources.

Access to both the beach area and the boat ramp is currently along a single access road. The
layout of the access drive, beach parking area, and boat ramp does not allow for easy trailer
positioning for boat launching where vehicles are forced to pull into the beach parking lot and
swing around or back down the entire access drive. Furthermore, the layout of the boat ramp
poses a safety concern as there is no separation between the boat ramp and swimming area
aside from a rope with floats that cordons off the swim area.
The purpose of the project is to improve boat access to Long Pond, improve safety for beach
goers, and improve water quality of the pond by creating separate entrance and access roads to
improve traffic circulation; updating the boat ramp and installing an adjacent floating dock;
creating a new trailer parking area; relocating the kayak and bike racks, improving pedestrian

access between the beach area and other site amenities; and constructing a stormwater
management system.
This project is consistent with the Town’s overarching plan to improve coastal landings, make
road repairs, and maintain infrastructure. The project also provides additional opportunities to
improve water quality of Long Pond by incorporating stormwater management practices to
capture and treat stormwater runoff that currently flows directly into Long Pond. This project will
advance the Town of Brewster’s goal of reducing algal blooms and associated low levels of
dissolved oxygen in Long Pond.
2.0 GENERAL SITE DESCRIPTION
Long Pond Town Beach (0 Long Pond Landing) is accessed from Crowells Bog Road in south
Brewster, MA (Attachment A, Figures 1 & 2). The Site is surrounded by residential
neighborhoods to the north, Black Pond to the southwest, Route 124 to the west, and a
cranberry bog to the northeast. Long Pond Beach is approximately 1.48 acres and includes an
access road, existing, deteriorating boat ramp, a parking lot, public beach, and site amenities
including a viewing ramp, kayak racks, picnic tables, and storage sheds. The open parking lot
and beach areas are surrounded by forested areas with a steep drop in topography between
Crowells Bog Road and the parking lot. The downgradient beach slopes gently to the pond’s
edge and there are obvious erosion channels and rivulets along the sandy surface. There are
two areas of vegetated wetlands to the east and southwest of the beach/parking lot.

Vehicles with boat trailers currently park along Crowells Bog Road, or among the open forested
area adjacent to the road.

Undeveloped upland portions of the site are indicative of a typical Cape Cod pine/oak forest
habitat. The tree canopy is primarily composed of pitch pine (Pinus rigida) and a mix of oak
species (Quercus spp.) with a patchy understory of wintergreen (Gaultheria procumbens), tree-
clubmoss (Dendrolycopodium obscurum), pipsissewa (Chimaphila maculata), bracken fern
(Pteridium aquilinum), and Canada mayflower (Maianthemum canadense). The understory is
fairly consistent throughout the site. The floor of the forested upland habitats is a relatively thick
(i.e., three to four-inch) layer consisting of oak leaf, pine needle, twig, and fibric organic matter.
The terrain has a few depressions, standing snags, fallen dead trees, and occasional boulders.
The area where the trucks park is sandy compacted and devoid of any vegetated understory.
Long Pond is the largest pond on Cape Cod, totaling 743 acres, and is classified as a Great
Pond. The shoreline of the pond is 6.4 miles in length, bounded primarily by residential
neighborhoods. Long Pond straddles the town boundary between Brewster and Harwich and is a
shared resource between the two municipalities (see Figures 1 & 2).
Long Pond has been listed as impaired in MassDEP’s 2016 Integrated List of Waters as a
Category 5 (Waters Requiring a TMDL) and is impaired due to Low dissolved oxygen (DO).

2.1 FEMA Designation
According to the FEMA Flood Insurance Rate Map (Community Panel No. 25001C0602J dated
July 16, 2014), The majority of the proposed activities are located within Zone A, areas that have
a 1% probability of flooding every year (100-year floodplain), the rest of the project is located in
Zone X, areas of minimal flood hazard (Attachment A, Figures 3 & 3A).
2.2 State-listed Rare Species Habitat
According to the most recent version of the Massachusetts Natural Heritage Atlas (15th Edition,
August 1, 2021), the project site falls within an area of Priority Habitat of Rare Species (PH 418)
(previously identified as PH 463) as designated by the Massachusetts Natural Heritage and
Endangered Species Program (NHESP). Priority Habitat mapping extends landward
approximately 100 feet from the edge of Long Pond and encompasses the bank, beach and
paved parking lot (Attachment A, Figure 4).
A MESA Information Request was filed on February 15, 2018 (NHESP No. 18-37470). According
to this request, a portion of the project site is mapped for the pondshore knotweed (Persicaria
puritanorum), which is listed as a Massachusetts Species of Special Concern. Pondshore
knotweed is a rare, trailing annual wildflower found on the upper shores of coastal plain ponds of
the Northeast. It is similar in appearance to the more common Lady’s thumb (Persicaria
maculosa), a non-native species. Persicaria puritanorum grows along the sandy, peaty or cobble
shores of the acidic, low-nutrient coastal plain ponds, flowering in mid to late summer. Ideal
habitats are acidic waters with low nutrients, pronounced water fluctuations and open, exposed
shorelines, such as coastal plain pond. Threats to this species include soil disturbance, changes
in hydrology, water quality or soil integrity. The NHESP Fact Sheet is included in Attachment B.

As a result of the Priority Habitat designation, the project will require a MESA Project Review
with NHESP, filed jointly with this Notice of Intent (NOI) application. During our site visits, HW
field biologists have not observed this species on site. Given the current activities at the project
site (swimming, fishing, and boat launching), it may be unlikely that pondshore knotweed is able
to grow along this stretch of the pond; however, NHESP will render a determination to the
presence of rare species and associated habitat for this project site.
It is anticipated that monitoring or a botanical survey may be required prior to construction to
verify the presence or absence of this species. If pondshore knotweed is found within the project
footprint, the location will be documented, and a plan will be established in conjunction with
NHESP to protect the population from harm during project activities.
2.3 Wetland Resource Areas
On June 27, 2017, HW staff delineated resource areas at Crowells Bog Road and along Long
Pond. Resource area flagging was verified and refreshed on January 28, 2022. Wetland
resource areas occurring at or near this project include the following, as defined under the
Massachusetts Wetlands Protection Act (MGL Ch 131 § 40), and its regulations and under the
Town of Brewster’s Wetlands Bylaw (Chapter 172).
• Inland Bank and Beach
• Bordering Vegetated Wetland/Freshwater Wetland;
• Land Under Waterbodies and Waterways; and
• Bordering Land Subject to Flooding.

In addition to the resource areas listed above, the Brewster Wetlands Protection Regulations
regulate the 100-foot Buffer Zone as a resource area and establishes a 50-foot no disturbance
buffer that extends from 0 to 50 feet from the boundary of the bank and freshwater wetland.
Attachment A, Figure 4 depicts the approximate limits of wetland resource areas as interpreted
by the Massachusetts Department of Environmental Protection (MassDEP) GIS mapping; the
limits of all resource areas are shown on the enclosed existing conditions within the planset
entitled, “Long Pond Town Beach Boat Ramp & Parking Improvements, Brewster,
Massachusetts,” prepared by Horsley Witten Group, Inc., and dated February 2022 (Attachment
C).
A brief description of the wetland resource areas at or adjacent to this site is provided below.
2.3.1 Bank (Naturally Occurring Banks and Beaches)
Bank is defined at 310 CMR 10.54(2)(a) as “the portion of land surface which normally abuts and
confines a water body. It occurs between a water body and a vegetated bordering wetland and
adjacent floodplain, or, in the absence of these, it occurs between a water body and an upland. A
Bank may be partially or totally vegetated, or it may be comprised of exposed soil, gravel or
stone. The upper boundary of a Bank is first observable break in the slope or the mean annual
flood level, whichever is lower. The lower boundary of a Bank is the mean annual low flow level
[310 CMR 10.54(2)(c)].”
The Brewster Wetlands Protection Bylaw defines Inland Bank similarly. The inland bank at this
Site is classified as Beach (inland), which is defined in the Area Subject to Protection under
M.G.L. c. 131 § 40 as Beach (Inland), “a naturally occurring inland beach, means an
unvegetated bank as defined in310 CMR 10.54(2).”
Bank, as defined by the mean annual flood level, to the northeast of the beach area was
delineated with blue pin flags labeled 1-5, where a slight wrack line existed. The beach itself was
not flagged due to the potential hazard pin flags pose to beachgoers. Beyond the beach to the
southwest, the Bank is defined by a distinct break in slope and delineated with blue flags labeled
6-12. The boat ramp is located between flags 9 and 10.
2.3.2 Bordering Vegetated Wetlands/Freshwater Wetlands
Bordering Vegetated Wetlands are defined under Massachusetts Wetlands Protection Act
Regulations at 310 CMR 10.55(2)(a) as, “freshwater wetlands that border on creeks, rivers,
streams, ponds and lakes. The types of freshwater wetlands are wet meadows, marshes,
swamps and bogs. Bordering Vegetated Wetlands are areas where the soils are saturated
and/or inundated such that they support a predominance of wetland indicator plants. The
boundary of Bordering Vegetated Wetland is defined at 310 CMR 10.55 (2)(c) as the line within
which 50% or more of the vegetational community consists of wetland indicator plants and
saturated or inundated conditions exist.” The Brewster Wetlands Protection Bylaw defines
Freshwater Wetlands similarly.
A narrow swath of forested Bordering Vegetated Wetland (BVW) extends perpendicularly from
the edge of the pond, just north of the beach, along the eastern side of the beach and existing

parking lot. The canopy is dominated by tupelo (Nyssa sylvatica) with occasional red maple
(Acer rubrum) and pitch pine (Pinus rigida). The shrub layer is dominated by sweet pepperbush
(Clethra alnifolia) with clumps of northern bayberry (Morella pensylvanica) and individuals of
fetterbush (Eubotrys racemosa). A small cluster of Atlantic white cedar (Chamaecyparis
thyoides) seedlings was observed adjacent to the parking lot. Groundcover is generally sparse,
consisting of seedlings from the shrub and canopy layers. Small amounts of common greenbrier
(Smilax rotundifolia) and poison ivy (Toxicodendron radicans) comprise the vine layer. HW
observed surface staining of leaves and soils exhibit evidence of hydrology (hydric spodosols).
HW delineated the BVW boundary with pink flagging stations numbered BVW 1 – BVW 10. A set
of DEP Bordering Vegetated Wetland (310 CMR 10.55) Delineation Field Data Forms were
completed to verify the wetland boundary in this location and are provided in Attachment B.
The southwestern corner of the beach and parking area is vegetated and supports a small area
of BVW located immediately along the pond edge. Here, the tree canopy consists of pitch pine,
while alder (Alnus sp.), northern bayberry, and red maple seedlings. A single large grey willow
(Salix cinerea) comprises the sapling layer. Groundcover species in this more open area, are
more diverse, and include grass-leaf goldenrod (Euthamia graminifolia), various sedges (Carex
spp.) including woolgrass (Scirpus cyperinus), clumps of soft rush (Juncus effusus), prairie
cordgrass (Spartina pectinata), black rush (Juncus gerardii) and poison ivy (Toxicodendron
radicans). The shrubs and groundcover layers are entangled with common greenbrier (Smilax
rotundifolia) and a small amount of Virginia creeper (Parthenocissus quinquefolia). HW
delineated this smaller BVW with pink flagging stations labeled BVW 100 – BVW 106.
2.3.3 Land Under Water Bodies and Waterways
Land Under Water Bodies and Waterways is defined at 310 CMR 10.56(2)(a) as “the land
beneath any creek, river, stream, pond or lake. Said land may be composed of organic muck or
peat, fine sediments, rocks or bedrock. The boundary of LUWW is the mean annual low water
level.” The Brewster Wetlands Protection Bylaw defines LUWW similarly.
The bottom of the pond along the shoreline and in near shore areas of Long Pond is generally
sandy with occasional pebbles and small rocks and/or rubble from the deteriorating asphalt boat
ramp. Transparency/water clarity of the pond is good, extending into the pond approximately 14
feet, with minimal aquatic vegetation in the area downgradient of the beach and boat ramp.
2.3.4 Bordering Land Subject to Flooding
Bordering Land Subject to Flooding (BLSF) is defined at 310 CMR 10.57(2)(a) as “an area with
low, flat topography adjacent to and inundated by flood waters rising from creeks, rivers,
streams, ponds or lakes. It extends from the banks of these waterways and water bodies; where
a bordering vegetated wetland occurs, it extends from said wetland.”
“The boundary of Bordering Land Subject to Flooding is the estimated maximum lateral extent of
flood water which will theoretically result from the statistical 100-year frequency storm. […]” (310
CMR 10.57(2)(a)(3)). The Brewster Wetlands Protection Bylaw defines Land Subject to Flooding
similarly.

BLSF along Long Pond extends landward from the pond and encompasses the beach, parking
lot, and site amenities, up to approximately the base of the steep slope to the north, as well as a
portion of the boat ramp and access road. The BLSF does not have a floodzone elevation (see
Figures 3 & 3A); however, through site survey, it was determined that the flood zone elevation
at this site is at approximately 35 feet above sea level.
2.4 Topography and Soil
The general topography of the sight slopes from northwest to southeast with the steepest grades
along the northwest border between Crowells Bog Road and the parking lot. The elevation
across the project area varies from 27 to 47 feet above mean sea level.
According to the Barnstable County Soil Survey, the soils underlying the site are classified as
Carver coarse sand, which is characterized having loose sandy glaciofluvial deposits that drain
excessively well (Attachment A, Figure 5).
3.0 PROPOSED PROJECT
3.1 General Project Description
The proposed redevelopment project includes the following components:
• Reconstruction of the existing boat ramp to improve access to Long Pond, including a
pier and floating dock to provide a separation between the boat ramp and the public
beach;
• Construction of a new access road into the site to separate beach traffic from boat ramp
traffic, improve safety for vehicles with boat trailers accessing the boat ramp, and improve
traffic circulation;
• Relocation of Site amenities (kayak and bike racks) to improve user experience;
• Regrading and resurfacing of impervious material for the parking area which is in need of
repair; and
• Installation of stormwater management facilities to capture and treat runoff which
currently flows untreated into Long Pond.
• Additionally, the Town proposes to provide formalized trailer parking between the two
access roads. While outside of resource areas and jurisdictional buffer zones this new
site amenity is tied into the larger parking improvements at the site.
Project activities will occur within approximately 41,065 SF of the 1.48-ac site and will consist
largely of redevelopment of the existing facility, particularly within jurisdictional resource areas
and buffer zones. The overall goals are to improve boat access to the pond, increase safety for
boat trailers accessing the boat launch and the public using the beach, and improve water quality
of Long Pond by reducing erosion and sedimentation and providing pretreatment of stormwater
runoff and associated pollutants prior to discharging into Long Pond.
A brief description of the proposed project elements is provided below; additional details are
provided on the project plans entitled, “Long Pond Town Beach Boat Ramp & Parking

Improvements, Brewster, Massachusetts,” prepared by Horsley Witten Group, Inc., and dated
February 2022 (see Attachment C).
• Boat Ramp. The reconstructed 14-foot-wide boat ramp will consist of precast concrete
sections along its 44-foot length extending approximately 36 feet into the pond. In addition to
the reconstructed boat ramp, the Town proposes to install a floating dock and pier parallel to
and just north of the boat ramp that will provide separation and an added measure of safety
between the boat launching activities and recreational activities at the beach. It will also
improve accessibility for people to safely board their boat.
• Parking Lot. The existing parking lot has deteriorated over time, with cracked pavement, and
crumbling curbing where ponded stormwaters have breached the curbing, allowing for
untreated stormwater runoff to flow directly into Long Pond. The reconstructed parking area
will utilize the existing footprint with a slight increase in size to accommodate new traffic
patterns and provide positive drainage for the proposed stormwater management practices.
A modest increase of two to three parking spaces will result. The number of handicap spaces
will remain at four, and the existing accessible viewing deck will remain in its current location.
The reconstructed parking lot will consist of impervious bituminous pavement, regraded to
the north and east toward the stormwater practices and away from Long Pond.
• Stormwater Facilities. The two stormwater management systems that are located within
jurisdictional areas will be sited just north and east of the parking lot and will promote
collection and treatment of stormwater from the parking lot prior to it discharging into Long
Pond, where no treatment currently exists (see Photo 5). Additional details are provided in
the Stormwater Management Report (Attachment D).

damaged removal of Pitch Pine.
Pitch Pine was removed from this area. It
was wind damaged in a heavy storms in a
previous year and removed without notifying
the Conservation Commission.. Mitigation
plants will be planted to compensate
for that loss

524 Crowell’s Bog Road

Minor changes have occurred throughout the design process for the pool project at 524 Crowells Bog
Road.
The sunshelf area and the spa have been eliminated from the pool plan. The spa will be relocated
within the footprint of the proposed pool. This results in 540 square feet less of gunite pool application.
The pool area patio has also been removed in favor of sod or turf and will be deemed permable. This
will eliminate approximately 1,072 less square feet of patio. Approximately (33) 2 x3’ steppers will be
installed within the grass or turf resulting in approximately 198 sf of hardscape in the pool area.. The
approximate net square footage of reduced patio size is 874 square feet .
There will also be an additional two trees added to the mitigation plant totals. The trees added to the
plan are Betula Nigra.
The revised plan has been submitted to the Brewster Conservation Commission by O’Reilly Engineering.

On behalf of the Village of Bay Pines and the Corcoran Jennison Management Co, we hereby request a
minor modification to the existing Order of Conditions SE 9 – 1530 to allow for the removal of 2 downed
trees and their stumps located at 123 – 127 Nickerson Lane. These two trees were uprooted during the
October storm. The stump removal will be handled by excavating equipment and is being done to allow
for the re-planting of replacement native trees and grasses to re-stabilize the affected area.

On behalf of the Village of Ocean Edge II and the Corcoran Jennison Management Co, we hereby request a minor
modification to the existing Order of Conditions SE 9 – 1701 to allow for the replacement of damaged portions of the OE
II Boardwalk. Wooden walkway decking and pier railings will be removed and replaced with composite product within
the existing footprint. No heavy equipment will be used on the dune during this project.
