A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AUTHORIZING
THE VILLAGE TO JOIN WITH THE CITY OF WESTON
AND OTHER FLORIDA MUNICIPALITIES IN A LEGAL
CHALLENGE TO SENATE BILL 360; PROVIDING FOR
IMPLEMENTATION; PROVIDING FOR EFFECTIVE DATE.
WHEREAS, on June 1, 2009, Governor Charlie Crist signed into law Senate Bill 360 known
as the Community Renewal Act (the "Act"); and
WHEREAS, the Act, among other things, eliminates the Development of Regional Impact
Review process within Miami -Dade County and other areas throughout the state; and
WHEREAS, the Village Council finds that the Act will have a negative impact upon the
community; and
WHEREAS, the City of Weston has authorized its legal counsel to initial legal proceedings
for the purpose of overturning the enactment of the Act; and
WHEREAS, the Village Council wishes to join with the City of Weston in its legal
challenge,
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That each of the recitals stated above is hereby adopted
and confirmed.
Section 2. Legal Challenge. That the Village agrees to join with the City of Weston and
other Florida municipalities in the legal challenge to the Act.
Section 3. Implementation. That the Village Attorney and Village Manager are hereby
authorized to take any and all steps necessary to implement this resolution including the payment
of up to $2,500.00 in legal fees in support of the challenge.
Section 4. Effective Date. That this Resolution shall be effective immediately upon
adoption hereof.
