THE CITY OF DELRAY BEACH AND THE TOWN OF GULF STREAM
THIS AMENDMENT NO. 2 to the Interlocal Agreement with the Town of Gulf
Stream is made this 4-6 day of 2019, by and between the CITY OF
DELRAY BEACH, a Florida municipal corporation (the "City"), and the TOWN OF GULF
STREAM, ("Town").
WITNESSETH:
WHEREAS, the City and the Town entered into an Interlocal Agreement for Fire -
Rescue Services on July 14, 2009 for a term of ten years commencing on October 1, 2009 and
expiring on September 30, 2019 with the option to renew for additional five (5) year terms upon
the mutual agreement of the parties in writing; and
WHEREAS, the parties mutually desire to exercise their option to renew the Agreement
for an additional five years.
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency
of which is hereby acknowledged, the parties hereby agree as follows:
Incorporation of Recitals. The parties hereby represent that the above recitals
are hereby incorporated as if fully set forth herein.
2. Revision. Paragraph 19 of the Agreement is amended to read as follows:
19. The term of this Agreement shall be for ten (10) five 5 years beginning
October 1, 2-A89 2019 and extending through midnight on September 30,
24W 2024 with option to renew for additional periods of five (5) years
each upon the mutual agreement of both parties hereto in writing.
3. Full Force and Effect. All other terms and conditions of the Interlocal
Agreement Service Agreement between the City of Delray Beach and the Town of Gulf Stream
and Amendment No. 1 not expressly modified by this Amendment No. 2 thereto remain in full
force and effect.
4. Effective Date of Amendment No. 2 to the Agreement. This Amendment shall
not be effective until it is approved by the City Commission and signed by both of the parties
with the effective date being October 1, 2019.
