MODEL CONSERVATION STANDARDS
EQUIVALENT CODE
ORDINANCE NO. 3‘, ,916.
Whereas, it has been determined that failure to adopt an energy code could
cause financial hardship on all the residents of the City of Iona and,
Whereas, an energy code would benefit future home buyers to have a better
and more efficient home and,
Whereas, failure to adopt an energy code posses a potential health hazard
to individuals living in homes with more air tight construction practices
being used.
Now therefore, be it ordained by the City Council of the City of Iona as
follows:
An ordinance of the of City of Iona, State of Idaho adopting the July 1986
edition of the Model Conservation Equivalent Code, the Model Conservation
Standards Equivalent Code Technical Appendix and Conversion Standards Appendix
L without modification, regulating the erection, construction, enlargement,
alteration, repair, moving, conversion, occupancy, equipment and maintenance
of all buildings or structures in the of City of Iona providing for the
issuance of permits therefore; providing for penalties for the violation
thereof.
Section 1. That certain documents, three (3) copies of which are on file
and are open for inspection of the public in the office of the of City of
Iona, being marked and designated as:
A. Model Conservation Standards Equivalent Code Amendments to the Model
Energy Code, July 1986 Edition, published by the Northwest Power
Planning Council.
B. Model Conservation Standards Equivalent Code Technical Appendix.
C. Conversion Standards Appendix L.
Section 2. ADMINISTRATION. The Model Conservation Equivalent Code will
be administered in accordance with Chapters 1, 2, and 3 of the current adopted
Edition of the Uniform Building Code. It is the intention of the City of
Iona that the cost of enforcement of the provisions of, and monetary incentives
for early adoption of this code, shall be provided by the Bonneville Power
Administration. It is acknowledged that these incentives will decrease and
eventually be removed. If this occurs, this ordinance will still remain
in effect. Enforcement cost from that point on will be born by the City
of Iona, State of Idaho.

Section 3. That if any section, subsection, sentence, clause or phrase of
this ordinance is, for any reason, held to be invalid or unconstitutional,
such decision shall not affect the validity or constitutionality of the
remaining portions of this ordinance. The City of Iona hereby declares that
it would have passed this ordinance, and each section, subsection, clause
or phrase hereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses and phrases be declared unconstitutional.
Section 4. PENALTIES. Each violation of this ordinance or of any regulation,
order or ruling promulgated hereunder shall constitute a misdemeanor and
be punished by a fine of not more than $300.00 or imprisonment for not more
than six months in jail or both such fine and imprisonment, for each day
a violation continues to exist it shall constitute a separate offense.
Section 5. That the WOW City Clerk is hereby ordered and directed to cause
this ordinance to be published.
Section 6. That this ordinance and the rules, regulations, provisions,
requirements, orders, and matter established and adopted hereby shall take
effect and be in full force and effect January 1, 1987.
