RESOLUTION NO. 95-31
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE
VACATING THE TEN FOOT PUBLIC UTILITY EASEMENT BETWEEN
LOTS 399 AND 400 OF PROSSER LAKEVIEW ESTATES, SUBDIVISION UNIT 4
WHEREAS, the Town of Truckee has received a request to vacate and abandon the ten (10)
foot public utility easement located along the property line between Lots 399 and 400 of Prosser
Lakeview Estates Subdivision Unit 4 (APN 16-440-09 and 10); and
WHEREAS,said easement has not been used for the purpose for which it was dedicated or
acquired for five (5) consecutive years immediately preceding this proposed vacation; and
WHEREAS, the Director of Public Works and the Community Development Directove have
reviewed the proposed vacation and find the easement no longer necessary for public purposes; and
WHEREAS,Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code, Section
8335, et seq., provides a procedure for summary vacation of easements.
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TRUCKEE,
1. Summarily vacates and abandons the ten (I0) foot public utility easement located
along the property line between Lots 399 and 400 of Prosser Lakeview Estates Subdivision Unit 3
as shown on Exhibit "A";
2. Declares that from and after the date that this resolution is recorded, the subject
easement no longer constitutes a public easement; and
3. Instructs the Town Clerk to record this Resolution of Vacation of Public Easement,
pursuant to Section 8336 of the Streets and Highways Code.

The foregoing Resolution was introduced at a Regular Meeting of the Town Council of the Town
of Truckee, held on the 7th day of September, 1995, by Council Member Carpenter who moved its
adoption, which motion being duly seconded by Council Member McCormack, was upon roll call
carried and the Resolution adopted by the following vote:

Council Members Carpenter, Drake, McCormack & Mayor Cross
NOES: None
ABSENT: Council Member Eagan
