HomeMy Public PortalAboutResolution No. 23-046 - Interim City Manager to take necessary steps to process application with Miami-Dade County for AnnexationSponsored by: Mayor Taylor RESOLUTION NO. 23-046 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, DIRECTING THE INTERIM CITY MANAGER TO TAKE ALL NECESSARY STEPS TO PROCESS AND SUBMIT AN APPLICATION TO THE MIAMI-DADE COUNTY BOARD OF COUNTY COMMISSIONERS FOR ANNEXATION OF AREAS "A" AND "B", ATTACHED HERETO, INTO THE MUNICIPAL BOUNDARIES OF THE CITY OF OPA-LOCKA; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Opa-Locka ("City") was established in 1926 as a City with 4.2 square miles; and WHEREAS, the City is looking to expand its boundaries into additional areas of Miami -Dade County; and WHEREAS, the City Commission of the City of Opa-locka desires to authorize the initiation of municipal boundary change procedures, pursuant applicable provisions of the Miami -Dade Charter and existing Ordinances; and WHEREAS, the City Commission of the City of Opa-Locka hereby directs the Interim City Manager to pursue possible annexation options for the City, including Areas identified as "Annexation Area A", an area bounded by NW 47th Avenue to the East, and NW 135th Street to the North, and the Gratigny Expressway to the Southwest, forming a triangular area; and the area identified as "Annexation Area B", an area bounded by NW 127th Street to the North, NW 107th Street to the South, NW 27th Avenue to the East, and NW 37th Avenue to the West, and to identify other unincorporated portions of Miami - Dade County that border the City of Opa-locka for potential future annexation with Commission approval (See Attached Composite Exhibits); and WHEREAS, reasons for annexation include acquisition of industrial and commercial properties, increased tax revenues, and expansion of the City borders; and WHEREAS, the Interim City Manager shall take all necessary steps to submit an annexation application to the Miami -Dade County Board of County Commissioners; and WHEREAS, the City Commission finds that it is the best interest of the City to authorize the Interim City Manager to take all necessary steps to complete and submit an application to Miami -Dade County for Annexation. Resolution No. 23-046 APPROVED AS TO FORM AND LEGAL SUFFICIENCY: NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: SECTION 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. SECTION 2. AUTHORIZATION The City Commission of the City of Opa-Locka, authorizing and directing the Interim City Manager to take all necessary steps to process, complete and submit an application to the Miami -Dade County Board of County Commissioners for Annexation of Areas "A" and "B", attached hereto. SECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors, which do not affect the intent of this Resolution may be authorized by the Interim City Manager, following review by the City Attorney, without need of public hearing, by filing a corrected copy of same with the City Clerk. SECTION 4. EFFECTIVE DATE This Resolution shall take effect upon the adoption and is subject to the approval of the Governor or Governor's Designee. Staff Summary: History- In 1926, the City of Opa-locka was established of 4.2 square miles. The city is looking to expand its boundaries. Current Activity- The Interim City Manager shall take the necessary steps to submit an annexation application to be presented to Miami Dade County Commissioners. The reason for the annexation acquisition of the industrial and commercial properties is to increase tax revenue and expand city boundaries. Financial Impact -- A budget of $50,000 will be established to cover consultant fees, application fees, ancillary studies and other costs which may arise. Since this is a one-time event, the utilization of Fund Balance is appropriate. General Fund Available Fund Balance will be utilized. Proposed Action: Staff recommends the City Commission approve the legislation authorizing the Interim City Manager to take all necessary steps to apply for Annexation.
