HomeMy Public PortalAboutORD 34_Amendment to Parking Vehicles, RVs, ect._02101977CITY OF IONA ORDINANCE NO. 77-34 AN ORDINANCE OF THE CITY OF IONA, IDAHO, REGULATING THE PARKING OF AUTOMOTIVE VEHICLES, TRAILERS RECREATIONAL VEHICLES, RECREATIONAL UNITS, BOATS, CAMPERS, AND TRUCK BEDS IN OR UPON LOTS AND PROPERTIES AND ON THE STREETS ADJACENT THERETO WITHIN THE CITY LIMITS OF IONA, STATE OF IDAHO: REGULATING THE UNSCREENED STORAGE OF OLD, UNUSED, JUNK AND OTHER AUTOMOBILES, AND OTHER EQUIPMENT NOT USABLE, WITHIN THE CITY OF IONA, STATE OF IDAHO:RPROVIDING FOR A PENALTY FOR THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE AND FOR AN EFFECTIVE DATE THEREOF: WHEREAS, the parking of automotive vehicles, trailers, recreation vehicles, boats, campers, truck or pickup beds, covers or shells or other manufactured units upon the public streets, roads and highways, or upon that portion of the front yard of a residential dwelling lot, when such units are not regularly used for transportation, in a manner which causes a sight restriction for motorists, bicyclists or pedestrians, is hazardous to the flow of traffic and detrimental to the safety and welfare of the citizens of the City of Iona: and WHEREAS, the regulation of parking and storage of automotive vehicles not licensed and regularly used for transportation, recreation vehicles, boats, campers, truck or pickup beds covers or shells, or other units manufactured is deemed in the best interests of the citizens of the City of Iona, and will promote the safety and welfare of the citizens of the City of Iona and will improve the aesthetic environment in said City: and WHEREAS, the parking and storage of old, unused, junked and nonregistered automobiles and other vehicles not in operable condition, and any other vehicles, machinery, implements, which is not regularly used or which is no longer safely usable for the purposes for which it was manufactured, is a public nuisance and is a menace to the public health, safety and welfare. NOW, THEREFORE, be it hereby ordained by the Iona City Council, County of Bonneville, State of Idaho: SECTION 1: That no automobile or automobile body which is not properly and correctly licensed and in operating condition; or any stripped, dismantled, or junked machinery, automobile, body or parts may be parked, stored or main- tained upon any roads, streets, sidewalks, or highways in the incorporated city limits of the City of Iona, and that none of the items described above may be parked, stored or maintained on any residential premises at a location between the building set -back line and the road right-of-way. SECTION 2: That all recreational vehicles, trailers, campers, boats, motorcycles, commercial vehicles and farm machinery not used for private trans- SECTION 2: That all recreational vehicles, trailers, campers, boats, motorcycles, commercial vehicles and farm machinery not used for private trans- portation shall be stored or parked behind the building set -back line for the residential dwelling unit when stored or parked and behind the side yard set- back line for corner lots for the side yard facing the street, road or highway, or screened from public view. SECTION 3: No person shall stop, stand or park a vehicle except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or traffic control device, in any of the following places: -1- Mill a. On a sidewalk. b. In front of a public or private driveway. c. Within fifteen (15) feet of a fire hydrant. d. Within thirty (30) feet upon the approach of any flashing beacon, stop sign or traffic control signal located at the side of a roadway. e. Within twenty (20) feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within seventy-five (75) feet of said entrance when properly sign -posted. f. At any place where official signs prohibit stopping. SECTION 4: REPAIRING OR STORING VEHICLES ON STREET: It shall be unlawful for any person to use any street or portion thereof within the City for the purpose of repairing any vehicle except for temporary emergency repairs, and shall be unlawful for any person to store or abandon any vehicle upon any of the streets of the City. Any vehicle left standing or parked for a period of forty-eight (48) or more consecutive hours in the same area shall be deemed to have been abandoned and the officers of the Police Department shall cause the same to be removed and impounded in such place as the Depart- ment shall determine, for safekeeping. SECTION 5: That a violation of any of the provisions of this ordinance shall be a misdemeanor, and shall be furnishable by a fine, not to exceed Three Hundred Dollars ($300.00), and that no violation citation shall be issued until the offender has received at least one (1) warning and has been given a period of eight (8) days to comply with the ordinance after notice of violation, that each day during which the condition is allowed to exist subsequent to official notice or by registered mail of a second or continuing violation shall be deemed a separate offense. SECTION 6: Variances to this ordinance will be considered on an individual merit basis, upon written application to the City Council of Iona. SECTION 7: This ordinance shall become effective upon due passage and publication. Passed by the Iona City Council, Bonneville County, State of Idaho this loth day of February, 1977. ATTEST: AMMENDMENT TO CITY OF IONA ORDINANCE NO. 77-34 Section 1: That no automobile or automobile body which is not properly and correctly licensed and is operating condition, or any stripped dismantled, or junked machinery, automobile, body or part may be parked, stored or maintained upon any roads, streets, sidewalks or highways in the incoporated city limits of the City of Iona, and that none of the items discribed above may be parked, stored or maintained on any residential premises at the location between the building set back line and road right of way. Furthermore if any of these above mentioned items are stored on the back lots they must be screened. Igr�'gsyI Dear Property Owner/Occupant: The City of Iona Code # 77-34 prohibits the parking of recreational vehicles, utility trailers, unregistered automobiles, farm equipment and other objects on the City Right of Way adjacent to the street. This code is to provide safety for pedestrians and moving vehicles on our city streets. Please remove your vehicle which is parked in violation of the City of Iona Code # 77-34 within forty-eight (48) hours or citations will be issued for the violation. Thank you for your cooperation.
