IN THE WILLIAM F. KOCH, JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order Mayor Morgan called the meeting to order at 9:00 A.M. II. Pledge of Allegiance Mayor Morgan led the Pledge of Allegiance. III. Roll Call Present and Participating: Scott W. Morgan Mayor Thomas W. Stanley Vice Mayor Paul A. Lyons Commissioner Joan K. Town Attorney Police Chief Town Clerk A. Regular Meeting of December 13, 2019. Commissioner Orthwein made a motion to accept the minutes of December 13, 2019, and the motion was seconded by Commissioner White with all voting AYE at roll call. V. Additions, withdrawals, deferrals, arrangement of agenda items There were none. VI. Announcements A. Regular Meetings and Public Hearing 1. February 14, 2020 at 9:00 A.M. 3. March 13, 2020 at 9:00 A.M. 4. April 9, 2020 at 9:00 A.M. 5. May 8, 2020 at 9:00 A.M. 6. June 12, 2020 at 9:00 A.M. Mayor Morgan called attention to these dates, moving the April meeting from Good Friday to the Thursday before, April 9, 2020. VII. Communication from the Public (3 min. maximum) Kristine De Haseth stated that once again the Civics Class from Gulf Stream School will be coming to either the March or April meeting. VIII. Reports A. Town Manager 1. Utility Undergrounding Town Manager Dunham referred to Steve Rosa for an update from Comcast. Mr. Rosa stated that 64 out of 100 homes were finished and they hope to be completely finished by the end of January. Water Main Update Town Manager Dunham held up the bid document and stated it was ready to go out for bid and would be put in the newspaper on January 26, 2020 and added it would be available to bidders on January 28, 2020. Mr. Dunham said there would be a mandatory pre-bid conference with bidders on February 13, 2020 and then all bids would have to be submitted by 2:00 PM on April 3, 2020. He added dependent on how many bids were received that there will be a review and recommendation by Baxter & Woodman on April 24, 2020 but could be sooner. Mr. Dunham stated they were looking to award the bid at the May 8, 2020 Commission Meeting and giving the notice to proceed by June 1, 2020 and be completed by December 31, 2020, if not sooner. 3. CIP Discussion Town Manager Dunham referred to the implementation schedule for 19/20 as showing a year of construction and 2020/21 to work on the northern core area for road work and water main. Mr. Dunham then introduced a smaller project for minor drainage and edge pavement repairs that he would like done in 2020. The focus areas would be Polo, Gulfstream, Old School, Banyan and Lakeview, and Baxter & Woodman would be preparing a scope of work and repairs, generally minor in nature, to address roadside ponding and rutting. Mayor Morgan summarized that while the Town's financial infrastructure focused on the AIA Water Main and possibly extending it into County and Little Club Roads plus considering expenditures going from septic to sewer, it would be wise to address the issues of very narrow roads and water pooling if it could be done relatively inexpensively and quickly. B. Architectural Review & Planning Board 1. Meeting Dates a. January 23, 2020 @ 8:30 A.M. c. February 27, 2020 @ 8:30 A.M. d. March 26, 2020 @ 8:30 A.M. e. April 23, 2020 @ 8:30 A.M. f. May 28, 2020 @ 8:30 A.M. Mayor Morgan called attention to those dates. C. Finance Director 1. Financial Report for December 2019 D. Police Chief 1. Activity for December 2019 Chief Allen requested that the reports be accepted as submitted with a couple of minor changes. One being there were two burglary autos and one smashed window, and the burglary residence is an ongoing investigation, being a distraction burglary. Mayor Morgan extended his compliments to the Police Dpt., especially Sgt. Passeggiata, who was doing the ongoing investigation on the distraction 2 Minutes of Town Commission Regular Meeting & Public Hearing Held January 10, 2020 @ 9:00 A.M. burglary, stating that Sgt. Passeggiata had gone above and beyond the call of duty. Mayor Morgan accepted all reports as submitted. IX. Items for Commission Action A. Ordinances Assistant Town Attorney Nazzaro stated that when codifying the ordinances, MuniCode noticed a scrivener error in Section 70-148 and this corrects that error. 1. NO. 20/1; AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, ELIMINATING REFERENCES TO ITEMS CATEGORIZED AS DISCOURAGED AND DECLARING THEM PROHIBITED BY AMENDING THE TOWN CODE OF ORDINANCES AT CHAPTER 70; ARTICLE V; DIVISION 3, GENERAL LANDSCAPE STANDARDS, SECTION 70-148, PRINCIPLES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. (First Reading on January 10, 2020) Commissioner Orthwein moved to approve Ordinance 20/1 and the motion was seconded by Commissioner White with all voting AYE at roll call. Assistant Town Attorney Nazzaro stated that other scrivener's errors were caught by Town Clerk Taylor and this corrects those errors. 2. NO. 20/2; AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AMENDNG THE CODE OF ORDINANCES AT CHAPTER 66; ARTICLE VII; SECTION 66- 321, CREATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. (First Reading on January 10, 2020) Commissioner Orthwein moved to approve Ordinance 20/2 and the motion was seconded by Commissioner White with all voting AYE at roll call. B. Establishment of Auditor Selection Committee Pursuant to Section 218.391 of Florida Statutes. Town Manager Dunham explained that the new Florida Statutes have changed the selection procedure for auditors. The Town needs to comply with that change which includes creating a three-person committee that will develop and approve a bid document for that service. The chair for that committee must be someone from the Town Commission and Mr. Dunham stated that he asked Commissioner Lyons to be be the chair and Commissioner Lyons agreed. Other requirements are that no staff can be on the committee, so Mr. Dunham stated that Linda 3 Minutes of Town Commission Regular Meeting & Public Hearing Held January 10, 2020 @ 9:00 A.M. Stumpf from the Town of Manalapan and Tracey Stevens from the Town of Ocean Ridge will round out the committee. Commissioner Orthwein made a motion to approve an Auditor Selection Committee with Commissioner Lyons as the Chair with Linda Stumpf and Tracey Stevens as the other members. Vice Mayor Stanley seconded the motion with all voting AYE at roll call. C. Items by Mayor & Commissioners Commissioner Lyons wanted to discuss the issue of parking in the Core District. He stated that some of the residents in town are concerned with parking on the Town's right-of-way. Commissioner Lyons said there is confusion because some residents plant vegetation and others pave areas that are on the Town's right-of-way. He provided pictures of people who are parking 24/7 in these areas. Assistant Town Attorney Nazzaro stated there had been a similar issue in Place Au Soleil and the HOA prohibited parking on the street, which is how they were going to handle the situation if it hadn't already been resolved by the HOA. Mayor Morgan stated that if the roads are expanded to allow better control of traffic, this would remedy cars parking overnight on the right-of-way because it would now be a road. Commissioner White questioned who had paved the right-of-way to which there was no answer. Commissioner Orthwein wondered if people would be in shock if the Town started taking over to which Mayor Morgan said it would all be done very slow and Town Manager Dunham said that the residents would be well-informed. Mayor Morgan asked Commissioner Lyons how big of an issue this was and suggested talking to the resident about the constant parking for days on end. Mayor Morgan asked Chief Allen if it was a safety issue to which Chief Allen said it was a gray area and if a fire truck or ambulance could get through then the car is off the road enough. Commissioner Orthwein didn't think they should make an ordinance for one specific incident and Commissioner Lyons agreed, as did Town Manager Dunham. Vice Mayor Stanley suggested writing down the problem areas in Town and to keep an eye on them and talk to the culprits individually because he agreed it was all going to change once the roads are expanded. Mayor Morgan agreed and stated the rights -of way were going to start to be enforced more. Mayor Morgan mentioned the passing of Town Employee, Brian Dietrick, who died on December 29, 2019 after fighting a long, courageous battle with cancer. Mayor Morgan stated Brian had been the head of maintenance and grounds for almost 20 years and was professional, knowledgeable, personable and well -loved by the residents. Brian had a genuine, quiet friendliness about him and while he earned respect with his competence, he earned friendship with his kindness, Mayor added. Commissioner Lyons commented on the passing of Town residents, Barry Merrill and Pete Dye, saying they would both be terribly missed and that he considered himself fortunate to be in this 4 Minutes of Town Commission Regular Meeting & Public Hearing Held January 10, 2020 @ 9:00 A.M. community with such great people.
