All the members of said Board, Messrs, Ford and Schnieder, being pres- ent. The following proceedings were: had, to-wit : The minutes of the preceeding meeting were read and approved. Permission was granted 8. C.Stimmel, . to cut the curb for drivew y on west side of South 8th Street, at Lot 140 Beallview,Addit iori. I/ Uomplaints from council we e received and referred to proper heads of departments. Permission was granted Jas/. H. 0harmock, of- Miller Curb Number Co. , to solicit householders and paint the house numbers on the _ curbs directly in front f the house in residentiatl districts with concrete paint, at/price of 35¢ for house number complete to the householder, without any cost to the city, subject to revocation of the permit at any time, should the Uurb No. Co. , not carry out the work as aforesaid. The Board approved/ Plat of "Bussen 's, Sub-Div. , of Out-Lot No. 6, I .Y.ii. of Friends Out-Lots, between West Main, Southwest "A" and between West 8th & 9th Streets. The Board. approved a re-plat of Linden Hill, J .P . Smith and Anna M.Jacksons Addition, between South lath & 20th & "A" & "B" Sts. , The City Civil Engineer reported the completion of contract under Improvement Resolution No. 919-1931, for cement roadway in alley 1st North Of PEarl St, and alley between Northwest 6th & 7th Street, from North end of alley to Northwest 7th Street The Board accepted the same, and ordered assessment roll. 11 Wilfred Jessup Atty. , for the D. Connelly Boiler Co. , appeared _ before the Board, in matter of tentative award of contract for . boilers made. to said company, voicing the opinion that in the event the Public Service Commission rendered its decision in fajor of the City in the rate case pending, the City was legal . band by the. tentative award. made to said company. The City Att . expressed the opinion that a tentative award of" a contract by a. municipality had no standing. under the law. After. a lengthy discussion entered into by the attorneys, the Mayor, Sup 't. , o Light Plant and Board the matter of confidential advice of in- formation received by the Mayor & City Attorney, that the city could. save from $Q10,000.to $15,000. on said boilers, by readve tizing for bids. sir. Jessup, stated that in his opinion the ma 'or has not been justified in withholding such information from th Special Council. Committee regarding the possibility of securing more favorable bids, and that in his opinion the mayor cannot with propriety withhold from other administrative officers of the city any information in matters concerning. the expenditure of • public funds, even if the information has been submitted to hi in a confidential manner, this opinion of Mr. Jessups was dis- puted by both the mayor and city attorney, it was however the opinion of various persons present, that much of the agitation for readvertising for boilers was caused by disgruntled bidder- who competed against the fortunate bidders last February.
