HomeMy Public PortalAboutResolution No. 23-101 - Resolution directing the ICM to compile a leave payout report for all city employees upon separation from employment.Sponsored by: Commissioner Kelley RESOLUTION NO. 23-101 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, DIRECTING THE INTERIM CITY MANAGER TO COMPILE A LEAVE PAYOUT REPORT AND PRESENT TO THE CITY COMMISSION AT THE NEXT REGULAR CITY COMMISSION MEETING THE CURRENT STATUS OF LEAVE PAYOUT FOR ALL CITY EMPLOYEES UPON SEPERATION FROM EMPLOYMENT; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 4.2 of the City of Opa-Locka's Charter permits the city commission to make good faith inquiries to a City Manager through passage of a resolution by the City Commission; and WHEREAS, various complaints have been made to City Commissioners regarding the lack of information made available to city employees for leave payout upon separation from the City of Opa-Locka ("City"); and WHEREAS, it is necessary for the City Commission to understand the current status of leave payout for union employees, non-union employees and all categories of employees who could be subject to leave payout upon separation from employment from the City of Opa-Locka; and WHEREAS, the City Commission desires to direct the City Manager to compile a leave payout report showing methods and present said report to the City Commission detailing the current status of leave payout for all city employees, including union employees, non-union employees and any category of employee who could be subject to leave payout upon separation from employment with the City; and WHEREAS, the City Commission is directing a leave payout report no later than the next City Commission meeting; and WHEREAS, the City Commission has determined that a leave payout report is in the best interest of the City of Opa-Locka and its residents. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: SECTION 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. Resolution No. 23-101 SECTION 2. AUTHORIZATION The City Commission of the City of Opa-Locka hereby directs the Interim City Manager to the compile a leave payout report detailing the method and current status of leave payout for all city employees, including union employees, non-union employees and all categories of employees who could be subject to leave payout upon separation from employment with the City of Opa-Locka. SECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors, which do not affect the intent of this Resolution may be authorized by the Interim City Manager, following review by the City Attorney, without need of public hearing, by filing a corrected copy of same with the City Clerk. SECTION 4. EFFECTIVE DATE This Resolution shall take effect upon the adoption and is subject to the approval of the Governor or Governor's Designee. PASSED and ADOPTED this 12th day of July, 2023. Staff Summary: City employees accrue annual and sick leave during their tenure. Upon separation from the City, most employees are entitled to receive a leave payout. City Staff shall provide a payout leave report on the current status of payout for separated employees. Financial Impact - There is no financial impact associated with this Resolution. Proposed Action: It is recommended that the City Commission approves the legislation directing the Interim City Manager to prepare a payout leave report on the current status of leave payout for all City employees upon separation from the City.
