HomeMy Public PortalAbout2008-07 - LEASE OF SPACE FOR CONSTRUCTION VEHICLES AND DUMPSTERS® ORDINANCE 2008 - I AN ORDINANCE REPLACING SECTION 8 -48 OF THE GREENCASTLE CITY CODE REGARDING THE LEASE OF SPACE FOR CONSTRUCTION VEHICLES AND DUMPSTERS WHEREAS, Section 8 -48 of the Greencastle City Code sets out the requirements and procedures for applying for and obtaining a permit to lease certain city right -of -way for the purpose of the temporary placement of construction vehicles, equipment and dumpsters; and WHEREAS, the language in Section 8 -48 should be amended to set fees, add the specific provision for dumpsters, and to make other minor language changes. NOW THEREFORE be it ordained by the Common Council of the City of Greencastle that it hereby repeals Section 8-48 of the Greencastle City Code, and replaces it with the following: Sec. 8 -48 Lease of Spaces for Construction Vehicles and Dumpsters. a. Notwithstanding any other provision of this Code conceming the stopping, standing, or parking of vehicles, the City may lease for the parking of construction vehicles or dumpsters one (1) or more parking spaces, including parking meter spaces, located on any street or in any municipal parking facility or • alley within the City to any person who has been issued an improvement location permit by the Building Commissioner for the location, erection, alternation, or repair of any structure, the change of any real estate adjacent to the parking space, or for the purpose of removing debris from or around a structure. An application for leased space under this section shall be submitted to the Clerk - Treasurer on forms provided by the Clerk - Treasurer, along with the lease fee specified in Subsection c. The Clerk - Treasurer shall forward each application received to the Mayor for his /her consideration. c. There shall be a permit fee of ten dollars (S 10.00) per day for each day that the permit is issued. Payment shall be submitted to the Clerk - Treasurer prior to the issuance of the permit. d. The Mayor shall: review each application for a leased space, determine whether the requirements for the leasing of spaces specified in conditions, approve the application, with or without conditions, or deny the application; specify for all leased space reasonable terns and conditions; and adopt such additional policies as may be necessary to implement this ordinance. • " performed to a level whereby parking areas on the property, other leased parking spaces, or both are able to accommodate the construction vehicles required. " 3. Violation of this Code or any policies of the City. A parking permittee may terminate a permit at any time before its expiration date. A pennittee shall not receive a refund of any fee paid if the permit is terminated or revoked before its expiration date. i. A vehicle that is stopped, stood, or parked in a leased space, other than a vehicle authorized to be parked in the space pursuant to a permit, is subject to a parking violation assessment of not more than one hundred dollars ($100.00) in favor of the City. (Ord. No. 86 -18, Sec 444 -45, 8- 16 -86) j. The permittee shall be responsible for any damages to persons or property resulting from the permittee's use of the space. The permittee shall restore the city property to the condition it was in prior to the permittee's use of the space. This Ordinance shall have full force and effect upon passage of the Greencastle Common Council and its approval by the Mayor.
