INSURANCE COVERAGE REVIEW Overview Last year, the Commission contracted with ARM Tech to perform an analysis of RCTC's insurance coverage. They have completed the review and Chuck Young of ARM Tech will be present at the meeting to report on the results of their review. 5. PERSONNEL MATTERS Overview This item is to: 1) Change the title and salary of the Public Information and Media Relations Officer to Director of Public Information; and, 2) authorize staff to recruit to fill the Program Manager position created by the change in position and assignment of the Director of Public Information. 6. COMMISSIONERS' PER DIEM Overview This item is the change the monthly maximum per diem meetings from four to six meetings. Staff feels that this change is warranted because of the continued increase in meetings that the Commissioners are requested to attend each month. 7. CALL TO ORDER Chairman John Tavaglione called the meeting to order at 8:25 a.m., on Wednesday, December 11, 2002, at the Riverside County Transportation Commission's Conference Room "A", 4080 Lemon Street, 3rd Floor, Riverside, California 92501. APPROVAL OF MINUTES M/S/C (Kelly/Miller) to approve the minutes of the November 12, 2002 Executive Committee meeting. 4 STATUS OF METROLINK NORTH MAIN CORONA STATION FARE Stephanie Wiggins, Program Manager, stated that in response to RCTC's request to assign the same fare to the North Main Corona Station — Zone 5, as the West Corona Station - Zone 4, Metrolink informed staff that it would cost $10,000 to do so to pay the vending machine vendor to drive to each of the stations to reprogram the vending machines. She said that there are surplus funds in FY 01 operations and RCTC could either authorize Metrolink to take the $10,000 out of the surplus. Chairman Tavaglione asked if Metrolink has plans to add cars. He additionally asked if there is possibility to lease cars. Stephanie Wiggins said that the service lines are up to nine cars. She reminded the Committee that for six plus cars, another conductor is added. Metrolink received 28 cars and all cars are allocated. There are 18 cars pending release of a Request for Proposal and delivery of the cars is in three years. The other option for additional cars is to purchase Amtrak's old cars. M/S/C (Tavaglione/Miller) to direct SCRRA to deduct the $10,000 from RCTC's operating surplus funds. 5. EXECUTIVE DIRECTOR CONTRACT Eric Haley, Executive Director, distributed information showing salaries/benefits of Executive Directors of comparable agencies to the Committee. Based on the salaries of the Executive Directors of comparable agencies and the fact that he has attained all of his goals set from the last year, he requested an amendment to his contract for: a) a 6.5% salary increase; and, b) an extension of the contract through December 31, 2004. Vice Chairman Roberts praised Eric Haley for his ability to work with the Commissioners and by keeping the Commissioners apprised at all times by providing information whether or not it is good or bad news. 6. BACKGROUND INFORMATION: The Commission has a number of ongoing projects, including acquisition of properties. The increase in Commission activities, coupled with the September 11 2002 event, raised a concern whether its exposure and insurance coverage is sufficient to meet the activities and services that the Commission provides. Therefore, the Commission approved a contract with ARM Tech for the following: 1. Exposure to Loss - Analyze RCTC's exposures to property, liability, crime and workers compensation loss to determine the potential type of loss RCTC is subject to and potential cost of such loss, and also consider exposure to: a. General liability arising from RCTC's operations, facilities and the operations of others serving RCTC under contract. b. Automobile liability losses. c. Public official's errors & omissions liability. d. Employment practices liability. e. Railroad liability. f. Property loss, including direct damage to RCTC-owned property and indirect Toss (such as added expense or loss of revenue from damage to RCTC's property or the property of others that RCTC depends on). g. Workers compensation loss resulting from injury to employees. h. Crime loss arising from theft of RCTC's money, securities or other financial instruments. 2. Insurance Coverage - Analyze RCTC's insurance policies to determine if the scope of coverage and limits is reasonable for the exposures identified above, as well as analyze policies purchased on behalf of RCTC for park & ride lots and agreements with Metrolink and Amtrak to determine if the scope of insurance protection offered through those documents meeting RCTC's exposure needs. 3. Insurance Program Structure - Evaluate the manner in which the policies are arranged and the published financial ratings of the insurers, and review the level of policy deductibles in relation to RCTC's willingness and ability to assume risk. ti 4. Indemnity and Insurance Clauses - Review the insurance requirements and indemnity provisions in sample contractor and consultant agreements and comment on the requirements and indemnification agreements. ARM Tech has completed their analysis and a detailed report is included in the Executive Committee's agenda packet. Chuck Young of ARM Tech will make a presentation at the meeting. • • • • AGENDA ITEM #5 • • • RIVERSIDE COUNTY TRANSPORTATION COMMISSION DATE: February 12, 2003 TO: Executive Committee FROM: Naty Kopenhaver, Director of Administrative Services THROUGH: Eric Haley, Executive Director SUBJECT: Personnel Matters STAFF RECOMMENDATION; That the Executive Committee approve: 1) Changing the title and salary level of the Public Information and Media Relations Officer to Director of Public Information; and, 2) Fill the position vacated by the Public Information and Media Relations Officer with a Program Manager position. Salary and benefits for the Program Manager position will be funded through the Commuter Assistance Program. BACKGROUND INFORMATION: Proposal to Upgrade the Public Information and Media Relations Officer to Director of Public Information The Riverside County Transportation Commission has and will continue to increase project activities, especially with the passage of Measure "A" and continuation of bi-county activities. The Commission has a number of ongoing and future projects; thus, there is a need for a staff member to serve as a central source of information about the Commission and will act as the official channel of communication between the Commission and the public. This position will administer a wide range of public relations activities. This position will also assist the Executive Director and members of the Commission in coordinating meeting requests for speaking engagements, and maintain effective relationship with civic, corporate and education organizations; develop and participate in news conferences, special events and other programs of public interest. The responsibility of the position also requires a working knowledge of State and Federal legislation, as well as the workings of local government, which is yet another reason for the request for a slight upgrade for this position. Staff proposes a change from a Program Manager to Director range because of the difference in the level of responsibility. The Director of Public Information will report to the Executive Director. Salary will change from $5,495-$7693 to $6041- $8457. Attached is the job description for this position. Fill Vacancy Created by the Upgrade of the Public Information and Media Relations Officer The Commission's Commuter Assistance Program serves as a full service regional rideshare provider and implements ride matching and teleservices to employers and commuters in the Inland Empire. As the Committee may recall RCTC no longer contracts with SCAG for primary services but maintains a limited contractual relationship in support of regional rideshare marketing and coordination services. The Public Information and Media Relations Officer reported to the Director of Regional Programs and Public Affairs. To accommodate a realignment of work assignments several years ago, the existing Commuter Assistance Program Manager position was absorbed by the Public Information and Media Relations position. With the proposed upgrade, there is a need to restore the original Program Manager position. Staff recommends that the Committee authorize staff to recruit for the Program Manager position to fill the vacancy created by the change in the position and assignment of the proposed Director of Public Information. Examples of Essential Functions: 1. Develops, maintains and monitors an effective public information program; assists in the development of strategies for addressing critical issues. 2. Develops public education opportunities and programs on RCTC and countywide issues; researches and writes news releases, media advisories, public service announcements, facts sheets, media kits, articles for trade journals, and other publications. 3. Develops, in partnership with the Director of Regional Programs and Public Affairs, various RCTC publications and communications tools. 4. Serves as liaison with community organizations and public agencies to coordinate public information gathering and distribution. 5. Participates on various committees and task forces to facilitate, define and communicate RCTC policies on subregional/regional and intergovernmental matters, as assigned. 6. Serves as a liaison with state and federal legislative offices and works in cooperation with the Director of Intergovernmental and Legislative Affairs. 7. Coordinates work of RCTC consultants in relation to public information and Commission special projects. 8. Develops and implements RCTC media events, news conferences and other promotional events; and contributes content for the RCTC Web Site. 9. Provide input and work in cooperation with program staff and/or consultants on RCTC audio/visual and graphic presentations. 10. Develops strategic marketing plan for RCTC programs and activities; participates in management team meetings to discuss related policies and programs. 11. Maintains Speakers' Bureau program, makes presentations at community and business organizations regarding RCTC activities and provides assistance to other Speakers' Bureau participants. 12. Qualifications Guidelines Education/Traininq/Experience: Required: A Bachelor's degree in Communication, Public Relations, Journalism, English, Public Administration or related field. Five years of increasingly responsible public affairs and marketing experience, including work in a governmental or transportation environment. • • • Knowledge: Principles, techniques, and methods used to develop, plan and coordinate an effective comprehensive public information program: graphics production including the use of desktop publishing and various printing technologies; writing, editing, photography and video production; practices and procedures used in both print and electronic journalism; marketing principles and public relations strategies; media event development and coordination; program evaluation practices and strategic planning techniques; report writing methods and techniques. Skills/Abilities: • • Communicate effectively both orally and in writing; establish goals and priorities; research and analyze information on a wide range of topics; effectively articulate and interpret RCTC position on a variety of topics and program to media and other audiences; maintain effective relationships and communications with RCTC staff, elected officials, city officials and staff, other agencies, members of the general public; advise RCTC management of strategies to advance the organization's mission; develop marketing partnerships with public and private sector; analyze and solve complex problems; coordinate and review the work of contractors and business partners; plan, organize, and complete work independently and within established deadlines; operate personal computer and standard office equipment; establish and maintain effective communications with legislative representatives, agency representatives, local officials, staff, management, private industry representatives, and related parties. Special Requirements: This position is expected to travel off -site and overnight to attend day and evening meetings and to interact with legislative, political and administrative representatives. Possession of a valid Class C or Class 3 California driver's license and an acceptable driving record. Physical Elements: This is primarily a sedentary classification and the employee works in an office environment with moderate noise levels, controlled temperature conditions and no direct exposure to hazardous physical substances. The employee interfaces with staff, management, other departmental representatives, transportation and government officials, business representatives, and the general public in explaining agency policies, requesting and providing information, and making presentations. Finger dexterity is needed to access, enter and retrieve data using a computer keyboard or calculator and to operate standard office equipment. The position occasionally bends, stoops, reaches, pushes and pulls drawers to retrieve and file information and lifts and carries reports and records that typically weigh less than 20 pounds. • AGENDA ITEM #6 RIVERSIDE COUNTY TRANSPORTATION COMMISSION DATE: February 12, 2003 TO: Executive Committee FROM: Nqty Kopenhaver, Director of Administrative Services THROUGH: Eric Haley, Executive Director SUBJECT: Commissioners' Per Diem STAFF RECOMMENDATION: That the Committee: 1) Approve the change of the number of maximum per diem meetings per month from four to six; and, 2) Direct the Executive Director to work with the Commission's State lobbyist to include the change in the per diem in a future legislation. BACKGROUND INFORMATION: Members of the Riverside County Transportation Commission receive per diem payments for attending Commission meetings, meetings of other agencies representing the Commission, and other transportation -related business. The current per diem is $100 per meeting day, up to four meetings per month. The per diem payments are set up whereby when a Commissioner attends two or more meetings in a day, the per diem remains at $100 for that day. The last per diem increase for the Commissioners was through Assembly Bill 665 (Johnson) in 1989, wherein the amount of the per diem per meeting day changed from $75 to $100. Things have changed over the 13 -year period. Staff has and will probably continue to request the Commissioners to dedicate more time to Commission business because of a number of new and continuing issues in the County and throughout the State. The number of meetings will continue to increase and, therefore, staff is proposing changing the cap from four to six meeting days per month. The Commission, since its formation, has placed per diem amendments in legislation, and staff is proposing that the Executive Director work with RCTC's State lobbyist to find a legislation to include the per diem change. The attached survey of per diems provided by other agencies to their Board members will provide the amount of their respective per diem as well as the maximum number of meetings covered by per diem per month.
