Jones Clerk- Treasurer GREENCASTLE COMMON COUNCIL EXECUTIVE SESSION TUESDAY, MARCH 9, 1999 6:00 P.M. PUTNAM COUNTY LHiRARY The Greencastle Common Council met in Executive Session Tuesday, March 9, 1999, 6:00 p.m. at the Putnam County Library. Council -at -Large David Masten called the meeting to order. On the Roll Call, the following were found to be present: Councilor Roach, Councilor Hammer, Councilor Green and Councilor Baynard. Mayor Michael was late, arriving at 6:35 p.m. Also present were: City Attorney Laurie Robertson, Attorney Selvia, Bill Dory, Bob Hutchings and City Engineer Ron Smith. Bill Dory presented the Council with a comparison of six and ten year abatement figures for F.B. Distro as requested at the February 23, 1999 meeting. Discussion ensued regarding abatement for an expansion project at F.B. Distro, Inc. Mayor Michael arrives at 6:35 p.m. ® Attorney Selvia discussed Finding of Fact and Conclusion of Law regarding Mary Anne Trapp v. City of Greencastle, Greencastle City Council, Greencastle Planning Commission and DePauw University, filed with Putnam County Circuit Court February 24, 1999. Attorney Selvia stated Judge Brown ruled Bill Dory did have an indirect conflict of interest, therefore, the request to close College Street will be on the Plan Commission Agenda March 29, 1999 for a new vote with Bill Dory abstaining from voting and discussion. Attorney Selvia told the Council that they have the right to appeal, but she feels it would be futile. Attorney Seliva further stated her bill is approximately $2,100.00, but could have been more if DePauw had not prepared Finding of Fact and Conclusion of Law and the Order that had to be prepared. Councilor Roach stated we have already spent too much money on this issue. Councilor Masten stated we don't want to minimize this finding, but don't want to be gun shy either. Move on and allow to go to Plan Commission. Councilor Roach asked the status of Carol L. Deom vs City of Greencastle, Indiana. Mayor Michael stated the Request for Production of Documents has been submitted. Motion to adjourn made by Councilor Masten, seconded by Councilor Hammer. Vote was unanimous. Nancy A.
