City of Richmond, Indiana,
Monday December 23rd, 1929.
The Board of Public Works of the City of Richmond, Indiana, met
in regular session at the office of said Board, Monday December
23rd, 1929, at 9 o °clock A. I. All the members of said Board,
Messrs, McFail and Henley being present. The following proceed-
ings were had, to-wit :
The Board approved the contract and bond of E. A. Mariani Con-
tractor- under Improvement Resolution No. 905-1929.
Upon reques-0 of J.F.Hipskind contractor for Clear Creek Outfall
Sewer,Pumps, etc. , under Imp. Res. No.848-1928, the Board together
with the City Atty. , met with said J .F.Hipskind and representatives
of the Fairbanks, Morse & Co. , in an effort to settle a controversy
of a claim of Fairbanks,Morse & Co. , against said J.F.His, ind in
amount of $666. 70 for pumps furnished said contractor on improvement.
Mr.Hipskind, claimed that the city had penalized him in the sum of
$350.00 on account of delay in finishing said contract, which delay
he claimed was caused by the city changing the specifications for
pumps, & .Fairbanks,Morse & Co. , by not having the pumps delivered in
proper working order, therefore he had withheld payment in sum of
$350.00 to Fairbanks,Morse & Co. , charging them with the penalty,
claiming further that the repair bill was an unjust charge against
him as the pumps- were not properly constructed, & it was the duty of
the company to make proper repairs without 'charge, ini ordesto have
said pumps in proper order. After some discussion on the matter,
the Board decide that the City was probably responsible for some of
the delay, and now order that Mr.Hipskind be reimbursed in amount
of $350.00, heretofore charged against him for said delay..
' The representatives of Fairbanks,Morse & Co. , agreed that as the
city was to reimburse Mr.Hipskind the amount .of 4 350.00, they would
assume $200.00 of the account, thus leaving "Mi'.Hipskind the amount
of $116.. 70 to pay on the repair account, which terms Mr.Hipskind
refused to accept.-
The Board then on motion decide, that as the city would pay Mr.
Hipskind $350.00 the amount he was penalized, they were not in
any way liable for the balance of said bill, as. the pumps had not
been accepted by the City until September 26, 1929, and the balance
of the bill was a matter to be adjusted by and between the Fair-
banks, Morse & Co. , and said J.F.Hipskind, contractor, the Board
now direct that the Finance Department pay to J. F.Hipskind, the
sum of $y350.00, amount. of penalty heretofore taken from him.
Claims in amount of 62,827.44 were allowed.
The Board then adjourned.
